03/14/1991, Regular Meeting MinutesPage 1767 iiEliNEDALE CITY GOUNCIL REGULAR MEETING - MARCH 1~., 1y91 COMMUNITY CENTER Mayor :~teve Radakovich o.alled the meeting to order at 7::i2 PM. Members present were hiayor Radakovich, Robert Mundy, Tom Boone and George Roberts. Members absent were Mark Wright and t'ete Kirkpatrick. Ted Rowe gave the invocation. Mayor Steve Radakovich presented a Certificate of Appreciation to Jerry Buckner and Gerald Dawson of Dawson 'l'ire Service for lending a helping hand to the Fire Department in an emergency situation. ITEM ND. 1 - Approval of minutes dated February 14 & 18, 1y91. With no correction to the minutes, Mayor Radakovich declared the minutes approved as submitted. ITEM ND. 2 - Adoption of Impact Fee Drdinance and Approval of Water & Wastewater Impact Fees. Robert Mundy was impressed with the Advisory Committee and their hard work. The property in the ETJ will be charged impact fees as such time as they hook onto Ker,nedale water or sewer service. Page 1768 Motion by Robert Mundy, second by Tom Boone to adopt the Impact Fee Ordinance as submitted. Motion carried unanimously. ITEM HO. 3 - Approval of Amending Plat, Lot 1-R, Block 4, Shady Creek Addition. George Roberts moved to approve the amending plat from Lots 1 & 2 to Lot 1-R, Block 4, Shady Creek Addition. Second by Robert Mundy and passed unanimously. ITEM NO. 4 - Proposal to Increase Lone Star Gas Rates. Rudy Flores, Lone Star Gas Zone Manager requested a 4. 1% rate increase that would take effect today, March 14, 1991. An alternative was to suspend action for 9~ days (June 14, 1991) to allow time for a workshop .for a Lone Star Representative to explain the details in calculating the increase and to conduct a study. Motion by George Roberts, second by Tom Boone to postpone action until June 14, 1991. Motion carried unanimously. ITEM NO. 5 - Amendment to City Ordinance 89-9 to Include Appendices to the Uniform Fire Code 1988. Fire Chief, Jerry Kirkpatrick informed Council that the appendices were inadvertently left out when adopting the 1988 Uniform Fire Code. The appendices would provide guidelines and restrictions on what was required of businesses. Jerry's main concern was life safety for schools, day-care, nursing homes and churches. Requirements could be as simple as lighted exit signs. The following appendixes were considered: APPENDIX SUBJECT I-A Regulations for Existing Buildings II-A Suppression & Control of Hazardous Fire Areas II-B Protection of Flammable or Combustible Liquids in Flood Areas. II-E Hazardous Materials Management Plan & Inventory i~ Page 1769 Statement. III-A Fire Flow Requirements for Buildings III-B Fire Hydrant Location & Distribution III-C Testing Fire Extinguishing Systems III-D Basement Pipe Inlets IV-A Interior Floor Covering Materials V-A Rationally Recognized Standards of Good Practice VI-A Hazardous Materials Classification VI-B Emergency Relief Venting for Above Ground Tanks VI-C Model Citation Program VT-D Reference Tables from Uniform Building Code George Roberts stated he was for fire safety and fire prevention, however, he didn't want to harass businesses in Kennedale. Ted Rowe offered to supply the appendices at the next meeting. Motion by Tom Boone to adopt the appendices stated above. Motion died due to a lack of a second. Robert Mundy moved to table the adoption of the appendices, second by 'Tom Boone. Motion carried unanimously. ITEM H0. 6 - Approval of Ad Valorem Tax Refund. Linda Jones explained that an improvement was taxed on lot 31, Block 5, Shady Creek Addition as of 1/1/89. On 2/21/91 Tarrant Appraisal District sent a correction to remove the improvement from the 1989 Tax Roll. The building permit was issued 10/21/90 and completed 1/21/91. A refund that exceeds 5500 must be approved by the Council. The refund would be 5585.96. Mayor Radakovich suggested that the refund money be withheld and applied to the outstanding debt owed by the G.W. Robbins Company for developer and engineering fees. Mayor Radakovich was informed that the money had to be refunded according to the State Property Tax Board. however, Mr. Cooper could voluntarily apply the refund to his debt. Roger Hurlbut inquired as to the status of alternate sources of water, other than well water. Alternate sources of water are Fort Wu th, Arlington, Mansfield, Trinity dater Authority and a water treatment plar;t per Ted Rowe. The Mayor stated that Council will continue to consider this item with proper emphasis.
