Mayor Steve Radakovich called the public hearing to order at 7:30 F.M.
Members present were Mayor Radakovich, Mark Wright, Robert Mundy, Tom
Boone, and George Roberts. Pete Kirkpatrick was absent.
Staff in attendance were Ted Rowe and Linda Jones.
Impact Fee Advisory Committee members present were Mary Salinas, Bill
Cramer, Wayne Winters, and Rory Kavact-.
Ms. Mickey Fishbeck of Rimrock Consulting Company and Mib:t• Monroe ct
Cheatham & Associates were also present.
Citizens in attendance were Elmer Mosley, Frances Cromer, and Gene
Blessing of Kenrredale News.
Mayor Radakovich stated that the purpose of the public hearing is to
-receive public comment concerning the land use assumptions and the
water and wastewater capital improvements program underlying the
development of City water and wastewater impact fees, and concerning
the resulting impact fees derived according to the requirements of
Chapter 395 of the Texas Local Government Lode.
Ms. Fishbeck made a presentation to Council explaining the program
and legal requirements of the Impact Fee Study and adoption of an
ordinance.
The Advisory Committee recommendations were as fallow;:
1. Including in the fee calculations all ma 'or
off-site facilities needed to provide wa~er
and wastewater service throughout the service
area, with the exception of lines.
2. The City of Kennedale's corporate area and E't'J were
recommended for the water arzd wastewater- service
areas.
3. That fees be charged on a pooled cost basis rather than
disaggregated to smaller geographic areas.
4. That the City use the "living unit equivalent", or
LUE, as the basis for charging water and sewer im act
fees, and that the number of LUE's for a new deve~apmer.t
be based on the size of the water meter.
S. The Committee and Staff discussed the advisability o:f
including an inflation-based fee escalator and recom-
mended that such an escalator nut be adapted.
6. Collection of fees at time of building permit issuance
tfor inside-City developments), or, if a building permit
is r,ot required tsuch as for outside-City
developments) collection of fees at time of tap
purchase.
?. Regarding the amount of fees assessed, That fees be
established as X400 for water and 812 far sewer for a
3/4" water meter, plus any impact fees which might be
charged by the City of Fort Worth or other service
provider and that the City Council be provided the
flexibility to set the fees at the maximum 0937.50
for water and X12 for wastewater) ar at any lesser
amount for Kennedale-financed facilities.

8. That the ordinance provide that Council could fully or
partially waive fees for cases of economic hardship,
purposes of general economic development, septic tank
cutovers, fire protection purposes and automatic lawn
or landscape sprinkler systems. They also recommended
that in these cases, an extended fee payment program
could be approved in lieu of a lump sum payment
with Council approval.
g. That the ordinance provide that it shall be the City's
policy to revise its contracts with its wholesale
customers to charge them for new development in their
service areas in a manner similar to the City's retail
customers.
10. That an impact fee for fire flow capacity not be
collected.
11. That the ordinance allow the City to enter into
contracts with feepayers to construct or finance
portions of the utility in return for fee offsets.
12. That apppeals be allowed for tl) the amount of fee
due; (2) availability of fee offset or credit;
and ( 3 ) the amount of refund due.
13. That a single-family residential ratepayer who requests
a larger meter should not have to pay an impact fee.
14. The Committee strongly recommended that the City Council
take immediate and concerted action to seek, evaluate,
and obtain sources for water other than well water
including, but not limited to, the Trinity River Authority
and other regional efforts.
Elmer Mosley, 1208 Vera Lane, asked if he would be charged an impact
fee for switching from a septic system to the sewer line at a later
date. Mr. Mosley was informed that no fees would be charged to
existing single family residents, that it was for new developments.
Motion to adjourn at 9:20 P. M.
Motion carried unanimously.
