04.20.2000 PZ MinutesPg. 68 N CITY OF KENNEDALE MINUTES OF PLANNING AND ZONING COMMISSION PUBLIC HEARING 20 APRIL 2000 COMMUNITY CENTER Chairman Conroy called the Public Hearings to order at 7:10 P.M. Commission Members Present: David Conroy, Jerry Miller, Ray Cowan, Bryan Lankhorst, Jody Risinger, and Brian Johnson. Tiffany Spencer was not in attendance. City Staff Present: Mort Wetterling, Planning/Code Enforcement Department; Chrissy Knapp, Permit Clerk PUBLIC HEARING NO. 1— The Planning and Zoning Commission will hear citizen's comments relative to the amending of Ordinance No. 143, the City of Kennedale's Subdivision Ordinance, regarding Masonry Screening Wall construction regulations. Mr. Frank Collier of 1517 Gilman Road, spoke against the masonry requirement stating that metal could also be an acceptable material for fencing and screening walls. Mr. Ron Formby of 812 Pennsylvania Avenue also spoke against the masonry requirement, stating that there are other materials that would be suitable for fencing and screening walls. He then gave suggestions for appropriate materials, using metal, PVC, vinyl, and cement as examples. With no further questions or comments from citizens, Chairman Conroy closed the Public Hearing at 7:24 P.M. PUBLIC HEARING NO. 2 — The Plamung and Zoning Commission will hear citizen's comments relative to the amending of Section 17 -405.D (i), Accessory Building Requirements, of the City Code, regarding accessory building construction material regulations. Mr. Frank Collier of 1517 Gilman Road, spoke in favor of metal as an acceptable material for accessory building construction. He then explained the cost difference between metal and masonry, stating that masonry would be a lot more expensive. He also said that the location of the property and accessory building should be taken into consideration when reviewing material requirements. Ms. Christine Mitchell of 1000 Oak Ridge Court, also spoke in favor of metal as an adequate material for accessory buildings. Conunission Members Present: David Conroy, Jerry Miller, Ray Cowan, Bryan Lankhorst, Jody Risinger, and Brian Johnson. Tiffany Spencer was not in attendance. City Staff Present: Mort Wetterling, Planning/Code Enforcement Department; Chrissy Knapp, Permit Clerk ITEM NO. 1— Approval of the minutes of the regularly scheduled meeting of the Planning and Zoning Commission, dated 16 March 2000. Jerry Miller made a motion to approve the minutes as drafted. Jody Risinger seconded the motion and all Commission Members voted in favor. ITEM NO. 2 — Commission review and recommendation for approval of an amendment to Chapter 17, of the Kennedale City Code, revising Accessory Building Regulations. After discussion among Commission Members, the recommended changes to Chapter 17 of the City Code read as follows: "Accessory Buildings, in the zoning classifications "R -1 ", "R -2 ", "R -3 ", Duplex, and Old Town, are those structures that are subordinate to the main residence, on the same lot. Accessory buildings include detached garages, bathhouses, greenhouses, bomb /fallout shelters, and barns. Storage buildings that contain more than 175 square feet of space are included this category. Accessory buildings shall be located at least five feet from the residence, eight feet from the side lot line, and eight feet from the rear lot line. An accessory building shall not be positioned in any required front yard, side yard, public utility easement, or drainage easement. Accessory buildings shall be of new construction and have exterior walls made of wood, stone, brick, or vinyl siding. Textured metal panels may be utilized, but only if they have a baked surface emulating any of the above listed approved products. The use of galvanized and/or unfinished steel or metal products is expressly prohibited." Ray Cowan made a motion to recommend approval. Jody Risinger seconded the motion, and all Commission Members voted in favor. ITEM NO. 3 — Commission review and recommendation for approval of an amendment, revising paragraphs A. and C. of Section 355 of the Kennedale Subdivision Regulations. After discussion among Commission Members the recommended amendments read as follows: A. The Developer of any lot located in a newly platted residential subdivision or resubdivision of existing residential lots, adjacent to a collector street, or larger, as shown on the prevailing Master Thoroughfare Plan, shall be required to construct a screening wall along and adjacent to said collector street. The screening wall shall be constructed of brick columns with connecting panels of brick, stone, concrete, fired masonry, vinyl, or exposed aggregate tilt -wall type material. Metal panels may be utilized, but only if the surface of both sides of the panel consists of a baked enamel finish that emulates any of the previous listed products. A re -plat of an existing one lot residential subdivision is exempt from this requirement. Pg. 68i B. Any subdivision screening wall shall be constructed in accordance with the standards and specifications contained in the Public Works Design Manual as well as a set of construction plans that have been approved by the Building Inspector. A combination of masonry and landscaping, at street intersections and subdivision entrances, is considered to be satisfactory, however, no subdivision screening wall shall be constructed within the right -of -way. Bryan Lankhorst made a motion to recommend approval. Brian Johnson seconded the motion and the motion was passed with a four to one vote with Jerry Miller being opposed. ITEM NO. 4 — Staff Comments: In addition to matters specifically listed below, staff continents may include updates on ongoing or proposed projects related to their department and may address posted agenda items, • Code Enforcement/Planning Department Staff Report Mr. Wetterling updated Commission Members on the status of the drafting of a Noise Ordinance and Tree Ordinance for the City. He then advised Commission Members that Legal Counsel is reviewing the City's Sign Ordinance draft. Mr. Wetterling then went on to address the change in the Park Dedication Fee for residential lots in the City of Kennedale. Chairman Conroy then advised other Commissioners and City St ff of his leave of absence, which will take place for the next four months.
