MINUTES OF
PLANNING & ZONING COMMISSION - REGULAR MEETING
AUGUST 15, 1991 - COMMUNITY CENTER
Chairperson Mary Salinas called the meeting to order at 8:35 PM.
Members present were Jauue 8rimer, Glynn Cava000, Bill Cromer,
Cliff Hallmark, Roger Hurlbut, Joe 8ouiz and Mary Salinas.
Melinda Gsoo was absent.
Staff present was Ted Rowe and Kathy Turner.
- Approval of minutes dated April 18, 1991.
There being no correction to the minutes, Bill Cromer made u
motion to approve them a2 submitted, second by Joe Quniz. Motion
carried.
- Consideration of zone change from "A" Single Family
to "0° Commercial, requested by Mr. C.F. Bedford
and hr. Grady Clifton.'
Mr. Crnmer made a motion to accept the zoning change and forward
to. Council for final approval, second by Glynn Cavamos, Cliff
Hallmark voted aye. Jannm Brimer, Roger Hurlbut, Joe 0ouiz and
Mary Salinas voted nay. Motion failed to carry.
Mary Salinas stated the P&Z feels that area should he commercial,
but at this ,point and Lime, we dm out have enough information,
enough safe guards for you and the residential areas. Said P&Z
has covered this area before but due to your application for a
change, recommended to go before Council to reconsider P&Z
earlier recommendations that we do need more commercial, and
answers with more defined terms.
Mr. Mouiz said some of the P&Z members feel this is s p"t zoning
the way it is being presented, but we believe the way we all are
thinking about it, is not having a spot zone, but have a
comprehensive zoning, so the denial tonight may not be denied the
next time around.
Mr. Hurlbut recommended P&Z to look at the particular use and
actually list out the types of things we do come up with which
may be very likely - what kind of uses the city wants and would
like to see. He suggested a committee be formed to review these
actions so they can forward an answer to Council. Jaooa 8rimer'
Boger 8urlburt and Cliff Hallmark were selected to be on the
committee.
ITEM MO. 3 - General Uioouasiou,
Dr. Rowe replied he had a proposal for constructing a new zoning
ordinance and subdivision ordiomuce and said they would meet with
P&%. He doesn't remember the cost, but would try and see if it
could be figured in this years' budget. He Stated codification
company does not do thiS type of work and he had u proposal from
Cheatham & Associates.
There being no further discussion, motion to adjourn at 9:25 Pb,,
was made by Roger Hurlbut. Second by B 1 Cromer. Motion
carried.

AUGUST 15, 1991 - 7:30 PM.
COMMUNITY CENTER
Chairperson, lary Salinas called the public hearing to order at
7:35 pm.
Members present were Glynn Cavasos, janna Brimer, Roger Hurlbut,
Mary Salinas, Joe Mnniz, Bill Cromer and Cliff Hallmark.
Staff present was Ted Rowe and Kathy Turner.
The purpose of the public hearing was to receive citizens
comments regarding a zone change from "A" Single Family to
Commercial located East of Little School Road at the
intersection of Kennedale Sublett Road, requested by Mr. C. I.
Bedford and Mr. Grady Clifton,
Mr. Clifton was present to state that he owns one acre and a
hail behind Mr. Bedford place and intends to build a house on
the back lot and use the front lot as commercial use. He had
seen . that this area was in the activity center for commercial
and planned on building an open air market to see what kind of
traffic he could generate with this being at the end of an
intersection. II it worked out, eventually he would like to
build a store.
Mr. Charles Robeson, a Shady Creek Resident reminded the
commission of the lengthy discussions that were held on
commercial activity in regurds to Little School Road. Through
that activity at that time we were assured that before anything
went commercial on Little School Road, it would be part of the
Master Plan as it developed- The main concern was the
restrictions, and beautification of yards to present a better
reputation than in the past. From this point, we had agreed
-that anything that was done commercially ought to be part of the
Master Plan. He felt that allowing this type of activity was
spot commercial zoning with no control, and this would open the
door for multiple uses which would destroy the potential .fur
Little Road.
Nt. John Berry stated that we need to stay within the uses of
the Master Plan. He said that spot zoning creates havoc which
we have all had to deal with along Highway 287, Mr, Berry
questioned what kind of city services would be necessary, what
kind of income would the Gity generate from a business like
this. As the overall economic growth of the city, what is this
business goino to du for Kennedale - will it spur . additional
growth commercially or spur quality commercial growth, is it
going to take away commercial activity, is it going to take away
houses? We need to do the right thing for the city. What
effect will this have on the traffic on Little Road - will
people be pulling off the side of the road and creating more
problems - need to look at traffic studies. Mr. Berry said that
he was not, asking that Commercial be stemmed, things not be
done, all he is asking is that P&Z take a long hard look at it
and do what is right for the community and do what is right for
the city in terms of tax dollars.

Mrs Hill Pranks who stated he had five lots adjacent to Mr.
Clifton's propelsiey, and said that if anyone who shOps goes to
Arlington and up Little School Road, and didn't know what the
plans are for Highway 287 but the road wu s. dead and it will
always be dead- Stated Little Road is the only viable- road for
tax revenue for- the City and one of these days it will be t�,iaa®
11 1)1 to the community. Mr. Franks had no objections to the
market going in but stated if he was oging to start something,
to start it right with the 30' easement being paved, paved
parking, meet the minimum requirements for building. sizl1 ,. and
brick or something of nice structure.
Mr. Clifton stated he could not understand why this was being
considered 13311 zoning because across the street in Williamsburg
Square it is zoned "E'• Commercial.
Ili s Hurlbut stated that spot zoning steps in when you try and
rezone smaller acre tra(.....sts, and you need to study the area. to
see if the change can be justified. The rationale behind spot
zoning is it can affect the surrounding propertiess
hr. Robeson stated that he was not against commercial zoning. of
this property, but is concerned with piece by piece zoning
without as master- plan. There shouldn't be any commercial
activity 11105 i2 downgrading, commercial should be good revenue

Mr. Berry said what goes in as first commercial can either
attract or it can detract other businesses, and what he wants
for the City i2 something that 5 going to attract more quality
businesses to Kennedale and be a tax revenue 1,n the city.
Mr,. Hurlbut stated that the Po/ is not establishing a business
cominginto the community. What we are doing is changing zoning
and allowing one hundred. other different uses that are not
currently available there, .30 all the good merits that may be
with this business, that's not what we are deciding tonight,
what we are deciding is what's goin(5 . to be there three years
after- you move out, what's going to be in there and that's what
we have to decide on. We must be put in the right planning
situation and to be confronted with an individual citizen
request and change the whole future to allow that one use, then
we need to be concerned. with the ratifications fox- all the other
additional uses that are goin11 . to be swept in. The problem we
have with this right now, is that we're shackled with an
ordinance that is very old and arcaie with very many
categories. We do not have a category that has less than 100
initial uses that are going to be brought in to get Mr.
Clifton's business.. We need something a little more tailored,
a little more precise.
Mr, Boone questioned an overlay district for this pa1 ticular.
piece of property when the Master Plan was approved- Mrs Rowe
replied that 1111' overlay was north of the "S" curve on Little
School Road beginnin13 with 11111 ELL Mr. Boone suggested P&Z to
look into these kind of things arising more oiten, Since there
is already a master 5)151(1 that indicates as potential for
commercial zoning along. the nodules, something should ho' done to
decide what the city is going to do with it because applications
are. going to be continuouss He recommends looking :into the

Mr. Hurlbut agreed with Or. Boone and said we need a buffer
zone, and need something to protect the residences that are
'there from potential dramatic commercial changes. Me said we
need desperately to upgrade and update city ordinances and that
the P&Z hands are tied with something like this.
There being no further discussion, Joe Moniz made a motion to
adjourn the public hearing at 8:20 PM. Second by Roger
Hurlbut. Motion carried.
