MINUTES OF
PUBLIC HEARING - APRIL M 1991
COMMUNITY CENTER
J Chairperson, Mary Salinas called the public hearirg to order at
7:30 PM.
Members present were Glynn Gavasos, Bill Cromer., Roger Hurlbut,
ROD Kovach, Joe Moniz and Mary Salinas. Cliff Hallmark was
absent.
Staff present were Ted Rowe and Kathy Turner.
The purpose of the public hearing was to hear citizens comments
regarding the proposed Business 287 Overlay District.
Mr. Roger Hurlbut briefed the audience on how the committee was
formed and how Arlington, Mansfield and Kennedale came about to
create an Overlay Zoning for the highway.
Mr. Ted Rowe presented a slide presentation showing highlights of
the proposed ordinance. Mr. Rowe stated that the overlay
district will lay transparent over the current underlying zoning
ordinances., The ordinance will not change any zoning, but will
change some requirements. The district will include 300' baGk

Mr. Blake Edwards representing the Overlay Zoning Committee and
.Planning and Zoning Commission from the City of Mansfield stated
that the proposal was presented Monday, April 15, 1991 to the
City of Mansfield and received favorable support of the
commissioners. Discussed some of the items in the proposal and
felt some were open for further discussion after the hearing but
as a whole felt the ordinance was a very good idea for the City
of Mansfield. Mr. Edwards reiterated that the ordinance is not•
to disturb existing businesses but to overlay Liu-' current zoning
ordinances.
Mr. john Berry a resident in Kennedale presented a petition in
support of the 287 Ordinance. He stated the petition was signed
by 24J business owners, employees in Kennedale and residents.
While circulating the petition a wide variety of residents,
employees and business In were approached, both young and
oid, employees and residents who have worked or resided in
Kennedale for 6 month to 35 years. Even though there was a wide
V1 riety of age groups, time of residency, work or employment, _all
want the same thing - they support the ordinance to clean up 267.
Hs. 1,c-Joie Horton stated that she is employed in Kennedale and is
President of the Kennedale Chamber of Commerce. M2. Horton
presented a resolution by the Board of Directors of the Kennedale
Chamber of Commerce in favor of the proposed ordinance for
Business 287.
Mr. Danielle Corbeille stated he has been a resident of Kennedale
for 3 in half years. Hr' does not consider Kennedale an
embarrassment at all. However, Mr. Corbeille is for the 287 plan
and would like to Bee Kennedale improve the appearance along the
highway. He wanted the 00111100 people to know that the citizens
of Kennedale are not trying to cause them harm in any shape or
way. Ile also expressed that when Lite ordinance goes into effect,
he would be more than willing to organize a group within his
neighborhood and community to help with the clean-up.

Mr. Raymond Birch, resident of Kerinedale and Vice President of
Shady Creek Community. Association presented a letter in support
of the 287 clean-up.
Mr. John Berry cited a letter from Harris Graphics Corporation
stating that Harris has a deeply invested interest in the
Nennedale community and would appreciate the movement in the
direction. of beautifying 287 to enhance the overall business
climate of the community.
Mr. William Abbott who resides in Kennedale stated that this
:reminded him of the turmoil the city encountered with gravel
trucks on Dick Price Road. Mr. Abbott said the city 12
reproached by people who are not citizens of Kennedale and that
the junk yards are not inside the .city limits. Mr. Abbott hoped
that the board and Council will listen to the citizens and
businesses of Kennedale and that all the outside voices would not
override the citizens. Also stated would like to see a leniency
for the businesses that are already in the overlay.district. He
feels the businesses could not take on the overlay requirements
until the business climate improves.
Ni. Tim Cecil who owns Kennedale Campers stated that he was for
the clean-up in Kennedale. He doesn't agree with the proposal
for existing businesses and said if it was to be enforced there
would be a lot of vacant buildings since the economy is depressed
now. If Mr. Cecil was to put in a greenbelt he would loose space
to park campers and is shy of space as is. Mr. Cecil felt the
city should start by enforcing current zoning ordinances and
enforce the overlay on new construction. Also, stated that when
the highway is widened, then the businesses would have to move
back and could comply with code at that time.
Kr, Roger Pearce who is a resident of Rennedale stated that he
was upset with the idea of outsiders who do not own property on
the highway to come in and tell someone to clean-up their
property. They do not pay taxes and he said hedid good to make
his payments and tried -Lo keep his property clean lox the people
who did have to look at it. Mr. Pearce did not see a problem for
the new businesses to comply . with the overlay zoning but doesn't
think that this is the time to start enforcing such restrictions.
Mr.. Manuel Acevedo, jr. who has a Kennedale address but 12 in
Arlington city Limits and pays Kennedale school taxes brought
forward a copy of a petition that he presented to the City of
Arlington against a wrecking yard business that wants to go in
across from his home. He also showed the 1'&Z some pictures of
what he has to look at everyday facing the wrecking yards. He
stated that the commission wants to take care of Business 287 but
does not care what happens to the people behind 287. He has to
deal with mosquitoes, rats and rodents from the junk cars, loud
noise from smashing cars in late evening hours, and the traffic
from speeding cars taking. Mansfield Cardinal ac a short cut for
easy access to the wrecking yards. Mr. Acevado wanted P&Z to
know that he appreciates what the city is trying to do with the
highway but to please think of the citizens that it affects who
own property and lIVO2 behind 287 as well.

Mr. Ken Pearce who has• a wrecking service and has been in
business f or. 32 years, and has lived in the city for 55 years
stated that there is not a wrecking yard in the City of
Kennedale. Mr. Pearce expressed that he is the only man that
could put L wrecking yard in the city limits if he wanted to, but
he doesn t. .He wanted to know what he is going to d h o wit his
lots that are 90 ' wide and 60 ' deep. What is he supposed to do
with these lots once the ordinance goes into ef fect? Mr. Pearce
said that the citizens of Kennedale should attend the meetings
not the people who live outside the city. He also said that the
city needs to tear It old houses and this would help the city
look better..
B. Mannis who has a salvage yard outside the city limits
stated that the ordinance was not intended to bother the business
man who is presently here unless something iS torn down, run over
or burned, then the ordinance would go into effect. 1I said that
the ordinance refers back to the zoning book but uu one has seen
i t. Mr. Mannis feels there will be a select attempt 1.0 enf orce
the OrAnnance, He said that if the city eliminate-3 auto salvage
yards then citizens are going to have to 1 ace junk automobiles in
their neighborhoods. H Mannis questioned the fact why the
ordinance stopped at 1187 instead of going through the City. of
Mansfield like it does in Kennedale. He doesn t see how the
beautif ication of the highway 1 going to bring tax dollars to
the city. He wants the business man to study the ordinance and
look a little further.. down the road because when the highway
widens it will eliminate a lot of business on the highway and
will change the appearance of every business.
Ms. Sandra Knykendall stated that she has an auto salvage on 1u
highway and that the highway has been a heavy industrial area -I. or
salvage yards f or many years. Ms. Knykendall said that salvage
yards were the original recyclers and knows that the junk,
wrecked vehicles are ugly, but what would you do if there were
not any salvage yards. These cars would be sitting in your
driveway and backyards. She said salvage yards have layers and
layers of ordinances that they have to comply by and at this time
a business can not survive this type of expense. Ms. Kuykendall
said that if the city was to enf orce such an ordinance, the
highway would be nothing but a hunch of weeds and stated that
they could not af f ord to comply with the ordinances. Said the
salvage yards are here and Lio were here 50 years ago and to
give them a chance, they are family owned businesses and that
they are not crooks or dirty people and they try to operate their
business in as clean and legal manner.
Mr. Charles Robeson as resident of Kennedale Bt at ed he has lived
in Kennedale f or f ive years and wanted to take time to commend
the committee fur what they are doing. He said bol in moving to
Kennedale he was involved with city government and what the
commission is trying to do is very dif icult. Being involved
with the Texas Municipal League seeing small towns struggle with
this type _of thing Lo the past. The towns that failed to set
some type of vision of change continued to go down. if Kennedale
continues to go down, the businesses that are here today will be
the only thing around, and he doesn '.1 think this is where
Kennedale wants Lo go. He understands the businesses and the
problems they are having and he is very sympathetic with that and
thinks every consideration should be made uu to the timing and so
f orth to where people can meet the requirements, but do not let
anything stop you from having vision to look to the future 1)1
Kennedale or Kennedale will continue to go down hill. Kenneda le
has a lot of prospects and is a good community.

Mr. Ted Rowe read a letter from Kennedale Police Department

the highway right-of-way.

ITEM NO. 2 Consideration trot Amendment to Zoning Ordinance
Section 1S-14 (54)(A) and Section 13-24 (1),
requested hy Ms, Barbara Holt,
Hs. Holt was present to ask a person-0J request Lu erect a Gt
fence along hel property line to the street right-of-way. She
stated she recently went. through u divorce and she was awarded
Lot 11 with the house and 1i ex-husband was awarded Lot 10. She
felt that this fence would be in hey hest interest Lo eliminate
possible hoIassment and the unsightly view of junk.
Mc. JUL MOIAZ made a motion to deny the request by Ms. Barbara
Holt, second by Ron Kovach. Motion carried unanimously.
ITEM NO. 3 - Consideration of Proposed Ordinance for Business
287 Overlay DisLxict„
Mr, Run ho V0( made 0 motion to furwald the Proposed Ordinance
for Business 287 Overlay District Lo Council with the following
revisIons:
(11) Turfs-to colrect the spelling of Bermuda Gass Hybrids
to reud Bermuda Grass Hybrids,
2- (1) Packing Regulations: odd (G) 0 months to comply for
parking fegulutions.
S. (h)(2) Change 12 months to 34 months with the ability Lu
go before the 1311A fur an extension of 4('J months.
4, (i)(7) Change 12 months to 24 months.
5. (j)(1) Loading Dock Regulations: There should be a colon
after Business 28/ instead of as period in the second
sentence,
add (4) Existing uses will not be affected,
G, (h) Landscape Standards: Delete paragraphs (2)(A)(1)
and (2)(A)(2) in their entirety, and delete the word
"and regularly" out of' 3(0)„
Kovach, Hurlbut, Cromer and Salinas voted aye. Moniz and Cavasos
opposed, Motion carried.
