04.16.1992 PZ MinutesPage 379 MINUTES OF PLANNING & ZONING COMMISSION APRIL 1G^ 1992 - 7:30 PM COMMUNITY CENTER Chairperson Mary Salinas called the meeting to order at 7:35 PM, Members present were Jenne Brimer, Joe Moniz and Mary Salinas. Glynn Cavasoo, Bill Cromer, Melinda Esco, Cliff Hallmark and Roger Hurlbut were ebsent. Staff in attendance were Ted Rowe and Kathy Turner. ITEM - Approval of Minutes from Public Hearing and Regular' -------- Meeting dated March 19, 1992, and Workshop dated April 2, 1992. Motion by Joe Mooiz to approve the minutes as submitted of the Public Hearing and Regular Meeting dated March 19, 1992, and Workshop dated April 2, 1992, Second by Jouua 8zimer. Motion carried. ITEM NO. - Recommendation of Planning and Zoning Commissioners to Fill Terms that Expire in June' 1992. Janna Brimer/ Glynn Cavaaoo, and Bill Cromer expressed their desire to continue serving as planning and zoning commissioners. Joe Nooiz requested that Melinda Esco, Alternate, replace him. No other nominees were presented before the commissioners. No motion • was made on this item. ITEM iNO. 3 - Workshop on Re-Write of Zoning Ordinance. No action was taken on this item due to low number of commissioners present. ITG NO. 4 - General Discussion. Mr. Monte Johnson of Don's Battery & Scrap Metal presented P&3 with a drawing of a building he would like to build for future expansion. He has been planning on this for the last three months, and with the 9&3 in the process of doing a re-write of the Zoning Ordinances, he felt this would be a good time to address his expansion. Mr. Johnson stated he operates a legal non-conforming business and this bothers him. In the past he never had an option to build a new building, nor was it an option to make improvements that would make the city more attractive. The plans call ±or a full brick veneer building that is 60 a 140 with an 8 foot matching metal fence around the entire yard to enclose anything that might be considered an eye sore. Mro. Brimer questioned the concerns that Mr. Rowe had addressed. Mr. Rowe replied that the lot is not zoned correctly for Mr. Johnson's property. Mr. Johnson's property is zoned ^En Commercial and his business requires a ^G^ Zoning District. His business is a metal recycling business supporting mills and foundries. He processes i7. however the mills need it, and he buys in volume and ships in volume. Page 380 Mr, Rowe stated that 'u thing was evident, and that was that the surrounding areas consisted of light industrial U20:'_3 and that across the street it was zoned "G-1" Light Industrial. Mr. Rowe said we would all like to see more commercial uses in Kennedale but it was hard to compete with Arlington. Kennedale citizens are going to shop where they can get the best prices. What. type of retail business cati come into Kennedale and compete into todays market? If we can find clean light industrial uses for this area, it, need not be an unattractive area. Mr. Rowe said Mr, Johnson is trying to change what he is doing to upgrade it to include a place to park and a new building with a fence. The thing that is holding Mr. Johnson hack is that he's a non-conforming use in an inappropriate zoning which further limits what he can do as a non -conforming use, and he is not in an industrial zoning. B.0A. couldn't legally grant Mr. Johnson a request to build that building at his present location because the difference in the zoning. If on the other hand it was light industrial and if recycling use was authorized in the zoning, then he could build that building and make that portion of Mansfield Highway more attractive which might encourage more of the same in that area. Mr. Rowe indicated that Mr. Johnson has a good down to earth reasonable use to the land which Hr. Johnson has proven over the years, and Li recycling does take off one of the days, he will be a valuable asset to the city. Mrs. Brimer questioned the size of the lot. Mr. Johnson replied it is approximately two and a half acres with a little over 200' across the front and 500' deep. Mr. Rowe said that Mr. Johnson has already taken steps to comply with the overlay zoning ordinance by creating some off-street parking, and he put up a fence for screening to improve the looks. Mrs. Brimer asked what does P&Z need to do about it. Mr. Rowe stated that in review of the zoning ordinances, consider whether or not this area would be H good location to change to "G-1" Light [industrial. He also noted that this would not be considered spot zoning because it is light industrial across the street. Mr. Moniz said he has no problem with Mr, Johnson's business. He feels. that P&Z should be real careful on how the re-write should be written because of what types of businesses could move-in. He stated that citizens are already against wrecking yards. Mr. Johnson stated that this has always been a problem in the past. He is not in the wrecking yard business, and he doesn't deal with cars or vehicle. parts- In the recycling business, there are things that overlap and interweave. They happen to buy a lot of scrap from wrecking yards which is already dismantled, processed as far as they can process it, then they bring it in and bail it up and ship it out. He is not in the wrecking yard or auto salvage business, Ile is in the recycling business only. Mrs. Brimer had a concern with the truck traffic coming on/off the Mansfield Highway. Mr. Rowe also noted that this would require an amendment to the Master land Use Plan because it calls for commercial in that area, but in the book it suggested scrapping commercial use and going with light industrial to moderate industrial. Mr. Johnson stated a company can only grow so much- He has experienced growing pains for the last six years, they have out grown themselves. Re's at the point now of asking what would the city like? What can he do for the city in turn to get something that would be beneficial to him? How can he arrange it to catch the theme and the ideas on what the zoning commission has worked hard to accomplish? That is his goal for now. Page 381 Mr. Moniz questioned bon much set-back Mr. Johnson allowed for, Mr. Johnson said at the present he is going with what the overlay ordinance calls for which is 50' but is seriously thinking of adding another 50' to make a total of 100' to allow more accessibility. Mr. Mooiz then asked how far the existing buildings were sitting back. Mr. Johnson said the first building was approximately 58' and the second one was anywhere from 78' to 80' off the right-of-way. In his master plan he intends to do away with the small building and put a brick face on the existing building and use this building as a maintenance building. P&Z stated that they would keep Mr. Johnson's plans in mind and thanked him for coming. Said they need more community input like his to help direct them in the right direction. There being no further general discussion, Jaona Brimer made a motion to adjourn at 8:20 PM. Second by Joe Mouiz. Motion carried.
