MINUTES OF
PLANNING ZONING COMMISSION - SEPTEMBER 20, 1990
COMMUNITY CENTER - 7:30 PM,
Chairperson, Mary Salinas called the meeting to order at 7:35 PM-
Member present were Cliff Hallmark, Roger Hurlbut, Jo e Honiz and
Nary Salinas. Glynn Cavasos, Dill Cromer and Ion Kovach were
absent.
Ad hoc members of the Impact Fee Advisory Committee present were
Chuck Shyties, ETS. Representative and Wayne Winters, Real Estate
Representative.

NO. 1 - Approval of Minutes dated August 1G, 1990,

ITEMNO, 3 - Appointment and Actions of the P&Z as the Impact
Fee Advisory Committee.
Mr. hike Monroe representing Cheatham & Associates was present to
brief members on the guidelines for the Impact Fee Advisory
Committee.
Monroe stated the definition of impact fees was"a fee charged
by municipalities to cover the cost of building new
undifferentiated system-wide infrastructure and charged against
new developments." [he basic reason for this is to get new
growth to pay for itself.

Mr, Monroe stated that Senate Bill 336 passed in 1987 grants
cities the right to charge impact fees, and on tberieveloyer side
cities have to prove that the fee charged has e rational basis.
The bill has gone through some legislative cbangeo. One item not
covered is wholesale oustomeru. Wholesale customers are cities
that buy water, sewer or both services from a wholesaler, i.e.
City of Fort Worth is o wholesaler and Keuuedale would be a
wholesale customer.
Mr. Monroe replied thot it is important that the City of
Kennedele charge for impact fees or the existing tau payers will
have to provide the fee for all new construotiou. The money
collected from the fee must be spent on infrastructure coot
related to the new development. The money must be spent within
10 years or it has to be returned to the property owoer with
interest.
Mr. Monroe spoke briefly on other areas of the impact fees and
stated that the Advisory Committee would receive material
randomly and would schedule several meetings to review the
process prior to recommending final action to the City Council.

Yard Requirements in "U", «E", "Fv, "G", and "G-1"
Zoning Districts.
