PLANNING & ZONING COMMISSION - MARCH 15, 1990
COMMUNITY CENTER - 7:30 PM
PUBLIC HEARING
Roger Hurlbut called the Public Hearing to order at 7:45 PM,
Members present were Tom Boone, Glynn Cavasos, Roger Hurlbut,
Joe Mouiz and Mary Salinas. Bill Cromer and Mike McCarty were
absent.
Public Hearing [No. 1 - To receive citizens input regarding a
a replat of Lots 19R1A and 19B18,
Block 2, Shady Creek Addition, Phase I,
requested by Mr. Gary Cooper,
Mr. Gary Cooper representing the G.N. Robbins Company was
present and stated his residence was located on Lot 19R1A and
decided to split a one acre lot off on the east side of Lot
19R1A, which will become Lot 19B18. All utilities are available
to service the lot. Mr. Cooper stated a 7.5' easement was left
off the northeast corner of the property line and should be
added.
No one else wished to speak for or against the replat.
Public Hearing No. 2 - To receive citizens input regarding a
replat of Lots 4R, 4R1, 4R2, 4R3, 4R4
4R5, Block 1, Williamsburg Square,
requested by Mr. Gary Cooper.
Mr, Cooper presented copies of the replat to the P&Z at the
meeting.
Mr. Cooper stated that the building located on Lot 4A was not
shown on the replat; the address is 619 North Little School
Road, and is the same size as Lot 1 and was sold with metes and
bounds but was not plotted. There will be a 60' easement
between Lot 4A and 4R1, the same as what is shown between Lots
4R3 and 4R4. Mr. Cooper said there were four existing lots
which contain Lots 1 (his office), 2 (at the corner of Little
and Sublett), and Lot 3 (where the Day care is located), and
everything else is on Lot 4 including the lot where the doctor's
building is located.
Mr. Cooper replied that the city was concerned with the access
onto Sublett and Little. Mr. Cooper recommended that on Sublett
another ingress/egress would be placed between Lots 4R4 and
4R5. A street easement 60' wide is located between Lots 4R3 and
4R4 and another ingress/egress between Lots 2 and 4R2.
Mr. Boone questioned what would be done in the center of Lot 4.
Mr. Cooper replied that in the future there would be some type
of office buildings in the center. Mr. Boone then questioned
the thoroughfare plan coming up North Little School Road and
asked if there needed to be an additional 20' dedicated for
right-of-way. Mr. Cooper said that there are two existing
building on the Little School Road side and when he platted the
property the first time he gave an additional 10' of
right-of-way down North Little School Road and on Sublett. Be
doesn't feel an additional 10' on the existing lots would belp.
The other critical issue is the drainage plan. Mr. Cooper said
that one was done on the original plat. The low spot on the
whole roperty is located directly behind the day care on Lot
3. Stated property has been engineered by Ken Groves and was

designed to bring the water down behind Lot 3 and go underground
out into the bar ditch beside Sublett Road. Mr. Groves passed
away last fall and his son is trying to locate this study and
will submit to city as soon as he receives it.
No one else wished to speak for or against the replat.
There being no further comments, motion to adjourn the public
hearing was made by Joe Mouiz, second by Mary Salinas. Motion
carried.

REGULAR MEETING
Roger Hurlbut called the Regular Meeting to order at 8:05 PM.
Members present were Tom Boone, Glynn Cave000, Roger Hurlbut, Joe
Mouiz and Mary Salinas. Bill Cromer and Mike McCarty were abseut.
ITEM NO. 1 - Approval of minutes dated February 15, 1990.
Motion was made by Joe Moniz to approve the minutes as submitted,
second by Tom Boone. Motion carried.
ITEM NO. 2 - Consideration of New Zoning Identification for
Shady Creek Residents.
Mr. Gary Nbigbtsil from 102 Meadonlabe Court stated that the
Homeowners Association is requesting that the current deed
restrictions be added to the zoning restrictions in the Shady
Creek area.
Mr. Lyle Brumley from 813 Shady Creek stated his point of view as
opposing the deed restrictions into the city ordioanoe. Said the
problem in the area started when he had a garage door installed
over his breezeway and closed his entry in. His garage has an
east entry and the property faces south which meets the deed
restriction reguiremeuto. The reason was to eliminate neighbors
K from looking into living area.

Mr. Wbi bt il replied the intent was to create a more restrictive
residential zoning and would eliminate squabbles between
neighbors.
Mr. Boone said he hated to see the city start trying to enforce
deed restrictions. He felt this would be difficult.
This item was tabled waiting on a response from City Attorney Don
Driver.
ITEM NO. 3 - Consideration of Re let of Lots 19R1 and 19B2,-�W'
Block 2, Shady Creek Addition, Phase I' requested
by Mr. Gary Cooper.
Mr. Mooiz questioned if any of this replat was in the flood way?
Mr. Rowe replied no it was not.
Mr. Hurlbut suggested labeling adjacent property owners.
Motion was made by Tom Boone to accept the replat contingent upon
labeling adjacent property owners and to forward a recommendation
to Council for approval, second by Mary Salinas. Motion carried.
ITEM NO. 4 - Consideration of 8eplat of Lots 4R, 4R1, 4R2,
4R3, 4R4 and 4R5, Block 1, Williamsburg Square,
requested by Ur. Gary Cooper.
Mr. Mooiz made a motion to accept the replat and to forward a
recommendation to council for approval contingent upon the
following items: 1. Show an additional 10' right-of-way
dedication on Lots 2 and 4R1, 2. Show existing structures, 3.
Label adjacent property ownership, 4. Show visibility triangles,
5. Present a drainage study, 6. Add right-of-way to dedication

clause, and 7. Show 7^5 utility easement in access between Lots
4R4 and 4R3 and Lots 4B1 and 4R, second by Glynn Cava000. Motion
carried.
ITEM NO. 5 - Briefing by Highway 287 Committee.
Mr, Hurlbut stated another meeting was scheduled for March 23,
1990 in the Community Center. The committee has sent invitations
to Fort Worth and Forest Hill hoping to receive comments on their
views as to what should be done along the highway.
A tentative date of April 26, 1990 has been selected as the date
for the public hearing at the community center in Kennedale.
Will send out letters, publish bulletins in the newspaper and
have news media coverage to encourage citizens to voice their
opinions.
ITEM NO. 6 - General Discussion.
There being no further discussion, motion to adjourn the meeting
was made by Glynn Cavasos, second by Tom Boone. Motion carried.
