07.11.1989 PZ MinutesPage 295 Minutes of Worksession July 11, 1989 City Administrator, Ted Rowe called the meeting to .order at 7:30 PM Members present were Bill Cromer and Mike McCarty. Roger Hurlbut, Mary Salinas and Joe Moniz arrived late. Other persons present were Mayor Steve Radakovich, Councilmen Robert Mundy and Bill Abbott, Eddie Cheatham, City Engineer - Cheatham & Associates, Greg Last - Cheatham & Associates, and Ron Quarles - City of Arlington. Mr. Rowe presented members with a Memo from the City of Arlington regarding the Preliminary Plat of Quail Creek Addition, Quail Creek Drainage Easement Request, and a letter from Di Sciullo & Terry, Inc. Consulting Engineers. (Attached) Motion was made by Roger Hurlbut that the commission acknowledged that it has made a determination based on the course of events of the June 22d Regular Meeting from the additional acceptance of the Preliminary Plat of the Quail Creek Addition, and informa- tion provided by Cheatham & Associates, and that acknowledgment be recognized that the conditions of acceptance of the Preliminary Plat have not been met and /or cannot be met before the expiration of 30 days from submission of the Preliminary Plat by the developer of this development for the following reasons: 1. The Planning & Zoning Commission has been advised by the City Engineers, Cheatham & Associates, that the conditions that the developer meet the concerns of our City Engineer in their letters of June 19, 1989, perhaps another letter has not been met and the developer has made some specific objections to concerns and has not contacted Cheatham & Associates to meet those concerns, 2. Conditions that a water study be completed. This cannot possibly be done in a short period of time that the City has been given since the June meeting, based on the advice of the City Attorney, Don Driver, and the necessary funding dif- ficulties for that type of study. The information available is inadequate to give us a professional and qualified opinion as to the adequacy to the present water system to service this development Page 296 Worksession - July 11, 1989, Con't. as proposed by this developer., 3. Condition for acceptance of Preliminary Plat was based upon a study and /or facts concerning the impact of the drainage and has not been met at this point or cannot be met and the acknowledgment of the commission at this time that these conditions cannot possibly be met before the end of the 30 day period from the time of the plat was submitted, therefore make this acknowledgment and determination based upon these events and at this point recognize and vote that the Preliminary Plat conditional acceptance has not been met and that therefore, will not be approved by this commission based upon the above and we would certainly as a side note hope that the developer would voluntarily withdraw and try again, second by Mike McCarty. No further discussion, Bill Cromer made a motion to adjourn the meeting, second By Mike McCarty. Meeting adjourned at 10:30 PM.
