02.18.1988 PZ MinutesPage 265 Minutes of Public Hearing Planning and Zoning Commission February 18, 1988 Bill Cromer called the public hearing to order at 7 :30 p.m. Members present were Bill Cromer, Glynn Cavasos, Pat Turner, Mike McCarty, Joe Moniz, John Gregory and Sue Hair. Alternate Tom Boone was absent. Staff in attendance were Ted Rowe, David Geeslin and Linda Jones. The purpose of the public hearing was to receive citizens comments re- garding a special use permit to place a trade day /flea market at 800 West Mansfield Highway, requested by Mt. Dan Charles and Ms. Johnnie Krueger. Mr. Charles spoke in favor of the flea market and explained his plans for the business. Mr. Gary Cooper spoke against the request because it would detract from the new business going in on Mansfield Highway. There being no further business, motion was made by Pat Turner, seconded by Joe Moniz, to adjourn the public hearing. Motion carried unanimously. Alternate Tom B000ne was absent. Staff in attendance were Ted Rowe, David Geeslin and Linda Jones. The minutes of the public hearing and regular meeting dated January 21, 1988 were approved as submitted. I. Mr. Dan Charles and Ms. Johnnie Krueger requested a special use permit to place a trade day /flea market at 800 West Mansfield Highway. Traffic congestion, ingress, egress, parking, days open, revenue and animals were discussed. Motion was made by Pat Turner, seconded by Joe Moniz, to deny the spe- cial use permit based on the uncertainty of the traffic congestion and uncertainty of being able to utilize the rear of the property for in- gress and egress. Five members voted in favor of the motion,' with Glynn Cavasos abstaining. Motion carried. II. Mrs. Rita Lopez requested a replat from Lots 10 and 11 to Lot 10R, Block 1, Briarwood Addition. Motion was made by John Gregory, seconded by Sue Hair, to approve the replat and forward a recommendation to Council for final approval. Motion carried without opposition. III. Consideration of rezoning of David Strickland Survey, Abstract 1376 and the Dunlap Subdivision that was tabled July 23, 1987. This item was withdrawn due to the death of Mr. Milton Broyles. IV. Consideration of rules and regulations for mobile, modular and manu- factured housing. Mike McCarty informed the Commission that he was in the process of compiling data from other cities and will have it in the packet for the next meeting. Page 267 Regular Meeting - February 18, 1988, Cont'd. V. Consideration of restrictions on parking butane trucks on the street and public property. The Commission was furnished a copy of Ordinance No. 85 -22 on parking trucks, etc., on public streets or public property. There seemed to be some discrepancies on enforcing the ordinance and it did not address parking on private property. Motion was made by Glynn Cavasos, seconded by Pat Turner, to table this item for future research. Motion carried. VI. Consideration of increasing speed limit on Little School Road. Chief David Geeslin informed the Commission that the speed limit, of 30 mph on Little School Road is the most controversial single item in the City of Kennedale in alot of peoples minds. The Chief submitted statistics on the reduced rate of accidents and asked for the Commis- sions' input on the speed limit to forward to Council. The Commission will make its recommendation at the next meeting. VII. Mr. and Mrs. Marty Norrell requested approval to move a house into Kennedale to be placed on Block 69, Original Town of Kennedale. Mr. Norrell stated that they would not be able to complete the house in 90 days as required by the City Code. The P & Z recommended that he request a special exception or variance to the code from the City Council. Motion was made by Pat Turner, seconded by Mike McCarty, to approve the request for moving the house into Kennedale, subject to complying to the ordinance and providing the items stipulated under the ordinance and making application to the city. Motion carried. VIII. Consideration of a recommendation to Council on a zoning change on Tracts 32B1 & 31C, David Strickland Survey, Abstract 1376. The subject property is currently under annexation proceedings and the current businesses (liquor store and lounge) would be grandfathered. Motion was made by John Gregory, seconded by Joe Moniz, to make a re- commendation to Council for subject property to be zoned "A" Single Family District. John Gregory, Joe Moniz and Glynn Cavasos voted aye. Pat Turner, Sue Hair and Mike McCarty voted naye. Bill Cromer voted aye breaking the tie. Motion carried.
