Mr. Morris, Chairman called the meeting to order at 7 :30 p.m.
Members present: Mr. Flowers, Mr. Billingsley, Mr. Brown.
Member absent: 1VIr. Cromer.
I. Old Business
a. Rex and Roger Pennington -.308 E. Mansfield Hwy. came
before the Board in regards to a request in rezoning from "E"
Commercial to "G" Industrial on a portion of Lot 34, C. A.
Boaz Subdivision.
The Board explained to Rex and. Roger that the Board would like
to use this item as part of the study of the rezoning of the
area. The Board stated that they would rather not start spot
zoning at this time. The Board stated that if or when the
Penningtons decided to sell their property and got a prospective
buyer that the Board would be willing to work with them and
discuss the possibility of issuing another variance.
II. Building Permits
a. Richard Brown - 417 E. Mansfield Cardinal Road has
erected a two story frame barn on Lot. 12, Block 1, Harris Hill
Estate without acquiring a- building permit. A review of the
location of subject structure reveals it is built approximately
16 feet across the 30 foot building line.
Mr. Brown has requested a building permit for this structure,
but in view of the encroachment on the building line the Board
disapproved the building permit request. Due to disapproval
from the Board, Mr. Brown has requested a variance for the barn
until the dedicated street that is on the subject property is
opened. The Board stated that they would have to check with
Mr. Marshall, City Attorney on the legality os such a variance.
Mr. Mike Harris, son of Mrs. Harris property owner, came before
the Board and stated that he opposes the barn and the only two
alternatives that Mr. Brown had were either buy the rest of the
land or move the barn.
Mr. Morris stated that the Board would need to explore all pos-
sibilities.
Motion made by Mr. Flowers, seconded by Mr. Billingsley to table
this item until a legal opinion has been stated by Mr. Marshall.
Motion carried with none opposed.
III. Miscellaneous - NOT ON THE AGENDA
a. Mr. Elmo Cornelius from Bomex Products - 901 E. Mansfield
Hwy. came to find out exactly what his property was zoned. When
he bought his property he was told that it was zoned "Light
Industry." Mr. Morris stated that it is zoned "E" Commercial.

Mr. Cornelius was mainly interested in listening in to what
the Board had to say to Rex and Roger Pennington in case he
ever decided to sell his property.
b. The Board further explained to Rex and Roger Pennington
as to why they couldn't just go in and approve changing the
zoning at this time to "G" Industrial.
IV. Board Members
None
V. There being no further business, motion was made by Mr.
Flowers, seconded by Mr. Brown that the meeting adjourn. Motion
carried with none opposed.
