EXECUTIVE SESSION The Planning and Zoning Commission will meet in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meetings Act, including discussion of any item posted on the agenda and legal issues regarding amortization of nonconforming uses, litigation, settlement offers, and/or claims. B. RECONVENE INTO CHAMBERS Reconvene into chambers for regular session and consider action, if any, on items discussed in Executive Session. C. PUBLIC HEARING 1) Case #PZ 05-20 to receive citizen’s comments regarding a request for rezoning of Lot 15A, Block 1 of Woodlea Acres Addition in the City of Kennedale, Tarrant County, Texas. The property is located at 821 N Bowman Springs Road. The zoning at the present time is “R- 3” (Single Family Residential) and is proposed to rezone to “C-1” (Restricted Commercial), as requested by Roland & Rebecca Schmitt. 2) Case # PZ 05-21 to receive citizen’s comments regarding a request for the City of Kennedale to vacate a portion of a public street. The subject property is locationally and legally described as the undeveloped and unused right-of-way of Main Street and Sixth Street located along the south side of West Broadway Street, across the junction with Main Street, City of Kennedale, Tarrant County, Texas. The property is the existing right-of-way in the City of Kennedale as requested by Paul McCreight. D. VISITORS/CITIZENS FORUM At this time, any person with business before the Planning and Zoning Commission not scheduled on the Agenda may speak to the Commission, provided that a “Speaker’s Request Form” has been completed and submitted to the Planning and Zoning Commission Secretary prior to the start of the meeting. All comments must be directed towards the Chairman, rather than individual P & Z members of staff. All speakers must limit their comments to the subject matter as listed on the “Speaker’s Request Form.” No formal action can be taken on these items. E.
