EXECUTIVE SESSION The Planning and Zoning Commission will meet in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meetings Act, including discussion of any item posted on the agenda and legal issues regarding amortization of nonconforming uses, litigation, settlement offers, and/or claims. B. RECONVENE INTO CHAMBERS Reconvene into chambers for regular session and consider action, if any, on items discussed in Executive Session. C. PUBLIC HEARING 1) To receive citizen’s comments regarding an amendment to the Sign Ordinance. An ordinance of the City of Kennedale, Texas amending Chapter 17, Article VII, of the Kennedale City Code (1991), as amended, providing additional regulations governing weekend advertising, sub-division, new development, real estate and construction signs; providing that this ordinance shall be cumulative of all ordinances; providing a severability clause; providing a penalty for violations hereof; providing a savings clause; providing for publication in the official newspaper; and providing an effective date. 2) Case #PZ 05-05 to receive citizen’s comments regarding a request for a Final Plat and Re- plat of James A. Arthur Addition for Arthur Elementary. Legal description is Lot 1, Block A of James A. Arthur Addition being Lot 7 thru 12, Block K of the Crestdale Addition, a 4.46 Acre Tract of the ER Mingus Survey, Abstract 1075, and 1.23 Acre Tract situated in both of the ER Mingus Survey, Abstract 1075 and the C. Rose Survey, Abstract 1285 of Kennedale, Texas, Tarrant County, as requested by Kennedale Independent School District D. VISITORS/CITIZENS FORUM At this time, any person with business before the Planning and Zoning Commission not scheduled on the Agenda may speak to the Commission, provided that a “Speaker’s Request Form” has been completed and submitted to the Planning and Zoning Commission Secretary prior to the start of the meeting. All comments must be directed towards the Chairman, rather than individual P & Z members of staff. All speakers must limit their comments to the subject matter as listed on the “Speaker’s Request Form.” No formal action can be taken on these items. E. REGULAR ITEMS 1) Approval of minutes: regular meeting dated and January 20, 2005. 2) Discuss and consider moving alternate member to a regular member and forward recommendation to City Council for approval. 3) To consider recommendation to City Council regarding an amendment to the Sign Ordinance. An ordinance of the City of Kennedale, Texas amending Chapter 17, Article VII, of the Kennedale City Code (1991), as amended, providing additional regulations governing weekend advertising, sub-division, new development, real estate and construction signs; providing that this ordinance shall be cumulative of all ordinances; providing a severability clause; providing a penalty for violations hereof; providing a savings clause; providing for publication in the official newspaper; and providing an effective date. 4) Case #PZ 05-04 to consider approval of a Preliminary Plat of Lot 1, Block A of the Jr. High Addition being 33.3393 acres situated in the Ephraim R. Mingus Survey, Abstract 1075, Kennedale, Texas, Tarrant County. The address is 930 Bowman Springs as request by Kennedale Independent School District. 5) Case #PZ 05-05 to consider approval regarding a request for a Final Plat and Re-plat of James A. Arthur Addition for Arthur Elementary. Legal description is Lot 1, Block A of James A. Arthur Addition being Lot 7 thru 12, Block K of the Crestdale Addition, a 4.46 Acre Tract of the ER Mingus Survey, Abstract 1075, and 1.23 Acre Tract situated in both of the ER Mingus Survey, Abstract 1075 and the C.
