EXECUTIVE SESSION The Planning and Zoning Commission will meet in closed session pursuant to Section 551.071 of t he Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict wi th the Open Meetings Act, including discussion of any item posted on the agenda and legal issues regarding amortization of nonconforming uses, litigation, settlement offers, and/or claims. B. PUBLIC HEARING 1) To receive citizen’s comments regardi ng Zone Change 03-06. Request is for Lots Tract 2 of the E.R. Mingus Survey from “R-1” Single Family Residential to “R-3” Single Family Residential, requested by MKP & Associates, Inc. 2) To receive citizen’s comments regarding an ordinance of the City of Kennedale establishing criteria and r egulations for the preservation of trees; providing for definitions; providing for permit requirements; providing a review process; providin g for restrictions on pruning and planting of trees; providing enfor cement procedur es; providing a cumulative clause; providing a severability clause; providing a penalty for violations hereof; providing for public ation; and providing an effective date. 3) To receive citizen’s comments regarding an ordinance adding Article VII to Chapter 17 of the City’s co mprehensive zoning ordinance, as amended, providing for regulations of signs within the City and its extraterritorial jurisdiction; prov iding that this ordinance shall be cumulative of all ordinances; providin g a severability clause; providing a penalty for violations hereof; providing a savings clause; providing for publication in the official newspape r; and providing an effective date. C. VISITORS/CITIZENS FORUM At this time, any person with busi ness before the Planning and Zoning Commission not scheduled on the Agen da may speak to the Commission, provided that a “Speaker’s Request Form” has been completed and submitted to the Planning and Zoning Commission Secretary prior to the start of the meeting. All comm ents must be directed towards the Chairman, rather than individual P & Z members of staf f. All speakers must limit their comments to the subj ect matter as listed on the “Speaker’s Request Form.” No formal action can be taken on these items. D.
