MINUTES OF
KENNEDALE CITY COUNCIL
PUBLIC HEARING CONTINUATION - AUGUST 26, 1993
COMMUNITY CENTER - 100 E. BROADWAY STREET
Mayor Abbott called the meeting to order at 7:16 p.nt.
Members present were Mayor Bill Abbott, Mark Wright, Robert Mundy,
Pete Kirkpatrick, and Tom Boone. Ron Kovach was absent.
Staff present were Ted Rowe, Kathy Turner, and Vicki Thompson.
Also present were David Lewis and Kirk Franklin with Governmental
Service Agency, Inc. (GSA).
Mr. Dennis Jerky, representing the Williams family who owns 71.7
acres at the southeast intersection of Sublett Road and Little
School Road questioned the first proposal o£ Planned Development
for this area, and he is aware that at the last meeting it was
changed to ag zoning. Courwilman Boone explained that this is the
highest and best use for this area. Boone also said that it
requires submittal of plans before the council fot• approval. Mr.
Jerky inquired about the market from five years from now, asking i£
a developer could build to suit the market at that time. Mr. Lewis
replied, "iri order to differ :from the zoning you would be
required to ask for a rezoning process." Mr. Jerky stated one of
the benefits of planned developtnerit zoning is that they would like
the flexibility so that when the market does lend itself to -the
development on that tract, -they would then present how they would
like to lay it out. The city really has the opportunity for more
input on how the land would be developed rather than if it was ag
or straight zoning. He would prefer to have the planned
development rather than straight zoning.
Mrs. Sue Hair stated that she sincerely appreciates the ef£or•t in
rewording the "Old Town District", and appreciated the council's
cooperation.
Mrs. Margie Lowery thanked Council for reconsidering the "Old Town
District" and appreciated the thoughtfulness.
Mr. Albert Soto was concerned about the separation in the zoning
districts and felt the city was prohibiting growth.
Mr. John Berry expressed his appreciation on what council has done,
he feels its a good plan, planning for the future, and this is what
Kennedale is about.

Mrs. Elaine Fountain questioned page 55 - D. Discontinued,
Conformance Required. Ms. Fountain pointed out a typographical
error in the last serrtertce, the word "land" should be changed to
"building or structure". Council agreed to allow a one year
extension on hardship eases for r•ecertt non-conforming buildings if
a hardship existed.
Mrs. Irene McDavid stated that there are 37.5 acres up and down
Little School Road that could be changed from single family to
commercial. She feels that it some nice businesses would come in
it would bring in revenue. She would like to see the first 300 to
400 feet go commercial and would like council to consider this.
Mr. Wayne Winters advised the public that council and the planning
and zoning commission held a work session with some citizens to get
the ordinance in a workable fashion and commended the council for
the time spent. Mr. Winters had a couple of comments regarding the
planned development classification. He felt this is for areas with
unique circumstances and it allows for business parks, office
buildings, shipping centers, motels, medical hospitals, industrial
parks, public or private schools, and residential uses. He feels
ghat if the area is designated as "PD" without a land use plan we
will be opening ourselves up for some severe problems.
Mr. Winters also addressed the Floodplan area and stated that it

Mr. Raymond Morris wants restrictions until the developer can show
his intentions.
Mr. Ken Pearce addressed auto storage lots, and stated the new
ordinance does not address it. Mayor Abbot advised Mr, Pearce that
he was grartdfathered iri and what council was doing had no affect orr
him.
Mr. Charlie Knouts stated he has plans before the city at this Lime
and did not catch the dust free driveways. He questioned the time
limit on existing businesses for dust free driveways. Mr. Lewis
advised only if expansion or new construction applies would he have
to meet this requirement. Mr. Rowe stated there was orte exception
and that was if it was declared a nuisance under present codes.
Mr. Knotty has a serious problem with his neighbor to the south due
to their dust. Mr. Knotty was advised to make a complaint at city
hall.
Mr. C.D. Fincher questioned the final zoning of his property. Mr.
Fincher was advised that it would be R3 Single Family Residence.
Council agreed to reduce the footage in R1 District to 20,000
square feet to accommodate Creekside and Shady Creek Addition.
Otherwise, there would not be a need for this district.
