BE IT ORDAINED BY TFT, CITY ALDM/IAN OF TW CITv OF KINNEDALE, TTKAS: ARTICLE I WORDS AI,TD PHRASES DEFINED Section 1. Wherever in this ordinance the folloring tenas are used, they shall have the meanings respectively ascribed to than in this section. STREET OR EIGHagf. Every way set apart for public travel, except foot paths. PRIVATE ROAD OR DRIVE0AY. Evers road or driveway not, open to the use of the pub- lic for purposes of vehicular travel. ROADWAY*. That portion of a street or highway between the regularly established curb lines or that parl, devoted to vehicular traffic. IETTPFECTION. The area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more streets or highways which join one another at an angle whether or not one such street or highway crosses the other. VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a public highway, excepting devices moved by humPn power or used exclusively upon stationary rails or tracks. MOTOR VEHICLE. Every vehicle, as herein defined, which is self-propelled. AUTHORIZED EMERGENCY maCLE. Vehicles of the Fire DeparLaent, Police Vehicles and such ambulances and emergency vehicles of municipal departments or public service corporations as are designated or authorized by the Chief of Police. RIGHT OF WAY. The privilege of the imnediate use of the street or highway. PARKING. The stPnding of a vehicle, whether occupied or not, upon a roadway, otherwise than temporarily for the purpose of an while actually engaged in loading or unloading, or in obedience of traffic regulations or traffic signs and signals. OFFICIAL TRAFFIC SIGNS. All signs, markings and devices, other than signals, not inconsistent with this ordinance, placed or erected by the Chief of Police for the purpose of guiding, directing, warning or regulating traffic. OPERATOR. Any person who is in actual physical control of a vehicle. PEDESTRIAN. Any person afoot. HAND SIGNALS. All signals made by the operator by use of the hand and forearm for the purpose of indicating his intentions of turning, stopping, or changing the course of the vehicle. SIDE:ALK. Dist portion of a street between the curb lines and the adjacent pro- perty lines. CROSSWALK. That portion of a roadway ordinarly included within the prolongation of curb and property lines at intersections, or any other portion of a roadway clearly indicated for pedestriPn crossing by lines or other markings on the surface. SAFETY ZONE. That area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a tafety zone. TRAFFIC. Pedestrians, ridden or herded Pri-rals, vehicles, street cars and other conveyances either singly or together while using any street for purposes of travel. POLICE OFICER. Every officer of the Municipal Police Department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. ARTICLE II AUTHORITY OF POLICE Sectionl. POLICE TO DIRECT TRAIII:IC. It shall be the duty of the Police De- partment of this city to enforce the provisions of this Ordinance. Officers of the Police Department are hereby authorized to direct all traffic either in person or by means of visible or audible signal in confornance with the provisions of this ordi- nance, provided that in the event of a fire or other emergency or to expedite traffic or safeguard pedestrians, officers of the Police or Fire Lepsrtment may direct traffic, as conditions may require, notwithstanding the provisions of this ordinance. L,0 Section 2. THE LARSEAL AUTHORIZED TO ADOPT EKERGENCY EIGULAIRIONS. The Marshal is hereby empowered to make and enforce regulations necessary to make effective the provisions of this Ordinance and to make and enforce temporary regulations to cover emergencies or special conditions. - 'Section 5. BUS STOP AND TATTC13 STANDS. The governing body shall have the right -to establish bus stops and tsxicab stands on such public streets in such 'Places and in such =ober as it shall determine to be of the greatest benefit and convenience to the public, and every such bus stop and taxicab stana so established shall be designated by appropriate signs. Section 4. OTHEa 7EHICLES PELEIBITLD FROM PA,J;2(11NCT IN BUS STOPS AND TAI1CA3 STANDS. It shall be unlawful for the operator or driver of any vehicle other than a bus to stand or park in ,-171 officially designated bus stop, or for any vehicle other than a bus or taxicab to stand or park in an officially designated tPxicab stand, except that the operator or driver of any passenger vehicle may temporarily stop in any such stop or stand for the purpose of and while actually engaged in loading or unloading passengers. Section 5. BUSES AID TA7TCA3S PROHIBITED Faom FRELUNG ExcEPT IN DESIGNA_TED STANDS. It shell be unlawfnl for the operator of any bus or texicab to stand. or park upon any street in any business district at any place other than at a bus stop or taxicab stand resPectively, except that this provision shall not prevent the operator of any such vehicle from temporarily stopping in accordance with other .stopping or parking regulations at any Place for the Purpose of 2nd while actually engaged in loading or unloading passengers. Section 6. PARKING PROHIBITED IN CERTAIN PLACES. (a) It -shall be uyllawful for any operator to stop, stend or park any vehicle upon a street, other than an alley, in such rsnner or under such conditions as to leave available less than ten feet of the width of the roadway free for movalsnt of vehicular traffic, except on streets on which no parking is sllowed daring the actual unloading or loading of passengers or Then necessary in obedience to traffic regulations or traffic signs or signals or a police officer. (b) It shall be unlawful for any operator to park a vehicle within a alley in such manner or under such conditions as to leave available less than ten (10) feet of the width of the rosflway for the free movement of vehicular traffic. (c) It shaJl be unlawful for any operator to park any vehicle within three hundred (500) feet of any burning building or structure or thing where fire fighting apparatus is being used for the purpose of extinguishing ssme, except under the direction of the Chief or other officer of the Fire Department, or a police officer of the City. Section 7. RARKINa P2OHI3ITED DURING CERTAIN ROUES IN DESIGNATED PLACES. The operator or driver of any vehicle shall not park such vehicle between the hours of 8:00 A.M. and 5:00 P.H. of any day within the district or streets designated by the governing body, by resolution, except in accordance with the time liTnit specified on the official signs and signals and other provisions of this ordinance; Sundays and legal holidays excepted. Signs sh211 be placed. or erected and maintained in each block designating the provisions of this section upon the passage of such resolution. Section 8. ILL NIGHT PALKI.N_T PROHIBITED. It shell be unlawful for the operator of any vehicle to park said vehicle for a period of time longer than thirty (30) 70-mites between the hours of 12 midnight and 6 A.H. on any street designated by reso- lution of the governing body. Section 9. STANDING OR PARKING CLOSE TO CURB. (a) Except when necessary in obedience to traffic regulations- or traffic signs or signals, the operator of a vehicle shsll not :stop, stand or park such vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of the traffic, and with the curb -side wheels of the vehicle within six inches of the edge of the curb except upon those streets which 'have been marked or signed for angle parking in which case vehicles shall be parked at the angle to the curb indicated by such sign. (b) The governing body shell determine by resolution upon what street angle parking shall be permitted and shall, at the time of such determining, provde for the marking or signing of such streets. Section 10. USING VEHICLES FOR PRIHARY PUPPOSE OF DISPLAYED ADVERTISING PRCIal EIBIT7.n. It shs31 be unlawful for any person to park on any street any vehicle for the primary purpose of displaying advertising. -Ind signals required hereunder for a particular purpose shall zo far as cable be uniform as to type and location throughout the City. (b) No provision of this Ordinance for which signs are required shall be en- forced against an alleged violator if, at the time and place of the alleted viola- tion, the sign herein required is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective without signs being erected to give notice thereof. Section 2. It shall be unlawful for any operator or driver of any motor vehicle or vehicle of any kind to disobey the instruction of any official traffic sign or signal placed in accordance with the provisions of this ordinance, unless otherwise directed by a police officer. Section Z. TRAFFIC CONTROL SIGNAL LTGEND. (s) Whenever traffic at an inter- section is controlled by traffic control signals eyllibiting colored lights or the words uGou, uCaution, and "'Stop", said lights nn.d terms shall indicate as follows: Green or uGo" - Traffic facing the signal may proceed, except that vehicular traffic shall yield the right of way to pedestrians and vehicles lawfully within a crosswalk or the intersection at the time such signal was exhibited. Yellow or nCaution, when shown alone following the green of "Go n - Traffic facing the signal shall stop before entering the nearest crosswalk at the intersection unless so close to the intersection that a stop can not be made in safety. Red or Stop8 — Traffic facing the signal shall stop before entering the nearest crosswalk at the intersections or at such other point as may be designated and remain standing until green or "'Got' is show alone. (b) The operator of a vehicle (or street car) intending to turn to the left at an intersection where traffic is controlled by traffic control signals or by a po- lice officer shall proceed to make such left turn with proper care to avoid accident and only upon the ugon signal, unless otherwise directed by a police officer. Section 4. It shall be unlawful for any person to place or to display upon of in view of any street any unofficial sign, signal or device which purports to be or is an imitation of or resembles an official traffic sign or signal or which attempts to direct the movement of traffic or which hides from view or interferes with the effectiveness of any official sign or signal. Every such prohibited sign, signal or device is hereby declared to be a public nuisance, and the Chief of POlice is hereby empowered to remove the same, or cause it to be removed, without notice. Section 5. It shall be unlawful for any person to wilfully deface, injure, move, obstruct, or interfere with any official traffic sign or signal. Section S. CHIEF OF POLICE AUTHORIZED TO DESIGNATE CROSSWALKS. The Chief of Police is hereby authorized to establish and to designate and shall thereafter main- tain or cause to be maintained, by appropriate devices, marks or lines upon the sur- face of the roadway, crosswalks at intersections where in his opinion there is parti- cular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary. Section 7. CHIEF OF POLICE AUTPCRIZED TO DESIGNATE SAFElY ZO1f17S AND LANES FOR TRAFFIC. (a) The Cbief of Police is hereby empowered to establish safety zones of such kind and character and at such places as he may deem necessary for the protect- ion of pedestrians. (b) The-Maeal is also authorized to mark lanes for traffic on _street pavements at such places as he may deem advisable consistent with the provisions of this ordinance. _ARTICLE IV. PK)ESTR=ST RIGHTS PqD DUTIES Section 1. P7MSTRIANSI EIGHT OF WAY. (a) The operator or driver of any ve- hicle, motor or otherwise, shall yield the right of way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at the end of a block, except at intersections There the movement of traffic is being regulated by police officers or traffic control signals. Provided, however, that after such ope- rator or driver shall have stopped Ms vehicle, or brought same under control, so as to permit such pedestrian to safely pass, he may cross the marked crosswalk or inter- section withou4 waiting for other pedestrians not endangered thereby. 4 (b) Whenever any vehicle has stopped at a marked crosswalk or at any intersec- tion to permit a pedestrian to cross the roadway, it shell be unlawful for the opera- tor OT driver of any vehicle approaching from the rear to overtake and pass such stopped vehicle, but the operator or driver of such stopped vehicle shall not impede the progress of vehicles in the rear any longer than is reasonably necessar under the circumstances, and safety is to be considered. (c) Every pedestrian crossing a roadway at any point other than within a marked or umnarked crosswalk shall yield the right to way to vehicles upon the roadway, provided that this section shall not relieve the driver of a vehicle from the duty to exercise due care for the safety of pedestrians. ARTICLE V. STANDING, PA=ING AND STOPPING Section 1. STOPPING PROBIBIT±A) IN SPECIFIED PLACES. It shall be unlawful for the operator of a vehicle to stop stand or park such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal: (a) In the center of the street. (b) Within a street intersection. (c) On a cross walk. (d) Upon any bridge, or viaduct, or in any subway and the approach thereto. (e) Within twenty-five (25) feet from the intersection of curb lines, or, if none, then within fifteen feet of the intersections of property lines at an inter- section, except at alleys. (f) Within thirty (30) at upon the approach to any flashing beacon, stop sign or traffic control signal located at the side of the roadway. (g) Within fifteen (15) feet of the driveway entrance to any fire station. (h) Within ten (10) feet of any fire hydrant. (i) In front of any private driveway, except with the consent of the owner. (j) On a sidewalk. (k) Alongside or opposite any street excavation or obstr_Iction when such stop- ping, standing or parking would obstruct traffic. (1) At any places where official traffic signs have been erected prohibiting standing and parkin. (n0 On the roadway beside any vehicle stopped or parked at the right hand edge or curb of a street. It is the intention of tbis paragraph to pro-nibit what is com- monly known as double parking or double line parking. _Section 2. ELL:NI:1Na F0 LOADING OE UNLOADING ONLY IN CEPIAIN PLACES. (a) The Chief of police shall have authority by and with the consent of the governing body, by resolution, to determine the location of passenger zones and loading zones and shall erect, and maintain or cause to be maintained appropriate signs indicating the same and stating the hours during which the provisions of this section are applicable. (b) The Chief of Police shaal not hereafter designate OT sign any cur' loading zone upon special request of any person unless such person makes application for a permit for such zone and for two signs to indicate the ends of each such zone. The City traffic engineer upon granting a permit and issuing such signs shall collect froni the applicant and deposit in the city treasury a service fee of ) per year or fraction thereof and may be general regulations impose conditions upon the use of such signs and for reimbursement of the city for the value thereof in the event of their loss or damage and their return in the event of -nisuse or upon expiration of Permit. Every such permit shall expire at the end of 1 year. (c) It shall be unlawful for the operator of a vehicle to stop, stand, or park said vehicle for a period of tine longer than necessary for the epeditious loading or unloading of Passengers in any place marked as a passenger zone during hours when the regulations applicable to such curb loading zone are effective, and then only for a period not to exceed three (3) minutes. (d) It shall be unlamful for the operator of a vehicle to stop, stand, or park said vehicle for a Period of time longer than is necessary for the a.x.peditious loading or unloading of passengers or for the unloading P-'1(7 delivery or pick up and loading materials, in any place marked as a loading zone. In no case shall the stop for load- ing and for unloading of materials exceed thirty (30) _minutes. Section 3. OBEDIENCE TO POLICE. It shall be nnlawful for any person to refuse to -or fail to comply with any lawful order, signal or direction of a police officer ,or fire department official. Section 4. PUBLIC EMPLOYEES TO OBEY TRAFFIC EMULATIONS. The provisions of this Ordinance shall apply to the operator of any vehicle owned by or used in the service of the U. S. Government, This State, County or City and it shall be vnlawful for any said operator to violate any of the provisions of this Ordinance, except as otherwise permitted in this Ordinance. Section 5. hi:KAPTIONB TO.MTEDRIZED EKEEGENCY VEHICLES. (a) The provisions of this ordinance regulating the operation, parking, and standing of vehicles shall apply to authorized emergency vehicles, as defined in this ordinance, except as fol- lows: A driver when operating any such vehicle in an emergency, except when otherwise directed by a police officer, may-- (1) Park or stand notwithstanding the provisions of this ordinance; (2) Proceed past a red or stop signal or :stop sign, but only after slowing down as may be neceszacy for safe operation; (5) Exceed the prima facie speed limits so long as he does not endanger life or property; (4) Disregard regulations governing direction of movement or turning in specified directions so long as he does not endanger life or property. (b) Those exemptions hereinbefore granted in reference to the movement of an aeL+1-.arized emergency vehicle shall apply only when the driver of said vehicle sounds a siren, bell, or exhaust whistle as may be reasonably necessary, and the vehicle displays a lighted red lamp visible from the fron as a warning to others. (c) The foregoing exemptions shall not, however, protect the driver of any such vehicle fram the conseouences of his reckless disregard of the safety of others. Section 6. _AUTHORITY TO IMPOUND VEHICLES. (a) Members of the police depart- ment are hereby authorized to remove a vehicle from a street or highway to the near- est garage or other place of safety, or to a garage designated or maintained by the police department, or otherwise naintained by this city u#der the circumstances here- inafter enrmerated. (1) When any vehicle is left unattended upon any bridge, viaduct, or causeway, or where such vehicle constitutes an obstruction to traffic. (2) When a vehicle upon a highway is so disabled as to constitute an to traffic traffic and the person or persons in charge of the vehicle are by reason of physi- cal injury incapacitated to such an extent as to be unable to provide for its custody or reaoval. (5) When any vehicle is left unattended upon a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic. (b) Whenever an officer removes a vehicle from a street as authorized in this section and the officer knows or is able to ascertain fromthe registration records in the vehicle the name and address of the owner thereof, such officer shall immediately give or cause to be given notice in writing to such owner of the fact of such removal and the reasons therefor and of the place to which such vehicle has been removed. In the event any such vehicle is stored in a public garage, a copy of such notice shall be given to the proprietor of such garage. (c) Whenever an officer removes a vehicle from a street under this section and does not know anii is not able to ascertain the mile of the owner, or for any other reason is unable to give the notice to the owner as hereinbefore provided, and in the event the vehicle is not returned to the owner within a period of three (5) days, then and in that event the officer shall immediately send or cause to be :sent written report of such removal by mail to the State department whose duty it is to register motor vehicles, and shall file a copy of such notice with the proprietor of any public garage in which the vehicle may be stored. Such notice shall include a complete description of the vehicle, the date, time, and place from which removed, the reasons for such re- moval, and name of the garage or place where the vehicles is stored. ARTICLE III. TRAFFIC SIGNS AND SIGNALS Sectionl. COUNCIL TO DETERMINE CHARACTER .AND LOCATION OF SIGNE AND SIGNALS. (a) The governing body shall, by resolution, determine and designate the char- acter or type of all official traffic signs and signals, and shall designate the location where the same shall be installed. Subject to this selection, the Chief of Police is hereby authorized, and as to those signs and signals required hereunder, it shall be his duty, to place and main- tain or cause to be placed and maintained all official traffic signs and signals. T2TTCLE 171. OPTION OF V774TCLES Section 1. DRIVE ON RIGHT SIDE OF STREET. Upon all streets, and other Public roadways, the operator of a vehicle _shall drive the same upon the right half of such roadway, and the operator of a slowly moving vehicle shall drive the same as close as possible to the right hand edge or curb of the roadway unless it is npracticable to travel on such :side of the roadway, and except when overtaking and passing another vehicle. Section 2. OILLILTAKING OTHER TIEICLES. Vehicles overtaking other vehicles proceeding in the sane direction shall pass to the left thereof and shall not again drive to the right of the roadway until the roadway is reasonably clear of such over- taken vehicle. It is the duty of the operator of such overtaking vehicle to sound audible and suitable signal before passing a vehicle proceeding in the sane direction. It is the duty of the operator of any vehicle about to be overtaken and passed to give way to the right in favor of the overtaking vehicle on suitable and audible signal, given by or on behalf of the operator of such overtaking vehicle. Section 5. TJRNING AT INTERSECTIONS J_UiD OTHLa PLACES. (a) Right turns. The operator of a vehicle inzeneing to tarn to the right at an intersection or into an alley or driveway shall approach the point of turning on that portion of the roadway nearest the right hand edge or curb of the roadway. (b) Turning left. The operator of a vehicle intending to turn to the left at an intersection or into a driveway shall approach the point of turning on that part of the roadway ne.L to the center thereof, and, unless otherwise directed by utueoning markersu, the operator of a vehicle in turning left at an intersection shall pass to the right of the center of the intersection before turning left. Section 4. STOPPING VIZIOLE AT INTWRSECTION. It shall be unlawful for any operator of a vehicle to approach any street intersection without bringing such ve- hicle to a fell stop within a distance of five (5) feet from the line of intersection and before crossing such line of intersection when and where a "stop" sign shall be displayed by being plainly marked or painted and displayed in the street or sidewalk area in full view of such operator or operators of ve'licles at such street intersections. Such stop sign locations shall be designated by resolution of the City Council. Section 5. RIGHT OF WA/. (a) Except where traffic is controlled by official sign or signal, or by police officers, the operator of a vehicle approaching an inter- section shall yield the right of way to any vehicle approaching from his right when such vehicle is within fifty (50) feet of the intersection. (b) The operator of a vehicle entering a public street fraa a private road or driveway shall yield the right of way to all vehicles approaching on such public road- way. (c) The operator of a vehicle on a roadway shall yield the right of way to author- ized emergency vehicles when the latter are operated upon official business and the operators thereof „sound audible signal by bell, siren: or exhaust whistle. Section 6. =D SIGNLIS. If an operator wishes to turn, stop, or back his ve- hicle or to move from one lane of traffic to another, he shall indicate such intention by a signal of the hand and forearm. made as follows: (a) Left Turn. Extend a hand and the foreara beyond the operator's side of the vehicle, in a horizontal position. (b) Right Turn. Extend a hand and the forearn beyond the operator's side of the vehicle, at an angle of 45 degrees pointing upward. (c) Stop. Extend a hand and the forearm beyond the operator's side of the vehicle, at an angle of 45 degrees downward. (d) Back. Extend a hand and the forea.Lj1 beyond the operator's side of the ve- hicle, moving same in an up and down motion. (e) Turning from one lane of traffic to another, same as for a turn in the same direction. Section 7. STOPPING, TURNING AND BACKING. The operator of any vehicle upon any Public highway before turning, stopping, or changing the course of such vehicle shall see first that there is sufficient soace for such movement to be made in safety; and if the movement or operation of other vehicles nay reasonably be affected by such turning, stopping, or changing of course, shall give plainly visible signal to the operator of such vehicle of his intentions so to turn, stor or change the course in accordance with section 6 hereof. Bection 8. PASSING TRAINS; INTERURBANS AND STRITTIC CARS. Before attempting to pas any rail-Poad train, interurban car or street car stopped for the purpose of re- ceiving or discharging passengers, every operator of a vehicle approaching the sane from. the rear and proceeding in the same direction shall bring such vehicle to a full stop and .shall not again start up or attempt to pass until the said railroad train, interurban car, or street car has finished receiving and discharging its passengers. Section 9. PASSING ON HILLS AND CURVES. Every vehicle, vhen moving along such portions of the roadway Where the curvature of the roadway prevents a clear view for a distance ahead of one hundred yards, shall be held under control. Section 10. OPERATION OF VEHICLES ON APPROACH OF AUTHORIZED EY7RGENCY VEHICL7S. Upon the approach of any authorized emergency vehicle or vehicles giving audible signal by bell, siren, or exhaust whistle, the operator of every other vehicle shall immediately drive the sane to a position as near as possible and parallel to the right hand edge or curb of the street, clear of any intersection, and shall stop and rRmpin in such position until the authorized emergency vehicle or vehicles shall have passed, unless otherwise directed by a police officer. Section 11. FOLLOWING _LIRE APPARATUS PROHISITED. Upon the sounding of gongs or warning devices used upon fire apparatus, operators shall stop their vehicles as near to the right curb as possible and shall remain standing until such fire apparatus has passed or until five minutes after the official fire siren has started sounding. It shall be unlawful for the operator of any vehicle to follow any fire apparatus in response to a fire alarm closer than three hundred (300) feet from the rear of such apparatas. ARTICLE VII MIECZ,LANEPOUS PROVISIONS Section 1. UNLAWFUL TO DRIVE THROUGH PROCESSIONS UNIT:SS DIRECTED BY TRAFFIC CONTROL SIGNALS OR BY A POLICE 01?ICTR. It shall be unlawful for the operator of any vehicle to drive between the vehicles comprising a funeral or other authorized procession while they are in motion. This provision shall not apply at intersections -where traffic is controlled by traffic control signals or by police officers. Section 2. ELERGING FROM ALLEY OR PRIVATE DRIvEAY. The operator of a vehicle aaerging fraa an alley, driveway or building sh11 stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across such alleyway. Section 3. V_6HICLE SHILL NOT BE DRTVEN ON SIDElraALK. The operator of a vehicle shall not drive within any sidewalk area except at peruianent or temporary driveways. Section 4. MOTOR VEEICLES LEFT UNATTENDED, BRAKES TO BE SELI2 AND ENGINE STOPPED. No person having control or charge of any motor vehicle shall allow such vehicle to stand on any street unattended without first setting the brakes thereon and stopping the motor of said vehicle, and when standing upon a perceptible grade, without turning the front wheels of such vehicle to the curb or the side of the street or highway. Section 5. INTOXICATED OPERATORS. It shall be unlawful for any person while in an intoxicated condition or under the influence of narcotic drugs to operate or attempt to operate any vehicle. Section 6. TRAtIIC NOT TO BE OBSTRUCTED. No vehicle shall be operated or allowed to renain upon any street in such manner as to fora an unreasonable obstruction to the traffic thereon. Section 7. UNNECESSARY NOISE. It :shall be unlawful to operate a vehicle which makes unusually loud or unnecessary noise. Section 8. ItanLER RTUIRED. No vehicle shall be operated upon any roadway un- less the sane is provided with a Dirfsfler which is in efficient and actual working con- dition, and the use of a cut-out is prohibited. Section 9. SPIED, RITZLII;SF DRIVING. Any operator of a vehicle on a roadway shall operate the sane at a careful and prudent speed not greater than is reasonable and pro- per, having due regard to the traffic, surface and width of the roadway and of any other conditions then existing, and no operator shall drive any vehicle upon a roadway at such speed as to endanger the life, limb or property of any person. Rates of speed in excess of the following are nprima facien evidence of violation of this section. (a) ( b) (c) In the business district 30 M. P. H. In a residence district 30 M. P. H. When passing a school building or the grounds thereof during school recess while children are going to or leaving school during opening and closing hours E. P. H. r- - 7 - .4=7 It shall be unlawful for any person to drive cry vehicle ueon a roadway carelessly and heedlessly in wilful or wanton dizregard of the rights of safety of others, or without due caution or circumspection and at a speed or in a manner so as to endenger or be likely to endanger any person or property. Section 10. LIGHTS. fll motor vehicles with the exception of motorcycles shall be orovided with at lease two suitable lights for the front and one for the rear of said vehicles. All other vehicles sha.31 be provided with at lease one light in the front and rear, when being operated or moved along the road after dark. All such lights shall be lighted during the period of one-half hour after sunset to one-half hour before sunrise. Section 11. LIGHTS, ON P2,2KED YIHICLES. Whenever a vehicle is parked or stopped on a street during the times between one-half hour after sunset and one-half hour before sunrise or at any other tie when there is not sufficient light to render clearly discernible any vehicle upon the street from a distance of 200 feet, there shall be displayed upon such vehicle one or more 1Pmps, projecting a white light visible under normal conditions from a distance of 500 feet to the front of such vehicle and pro- jecting a red light visible under like conditions from a distance of 500 feet to the rear, except that such parking light or lights need not be displayed upon any vehicle stopped or parked in accordenee with other provisions of this ordinance upon any street where there is sufficient light to reveal such vehicle within a aistance of 200 feet upon such street. Section 12. FLLG AT END OF L01.1. Yhenever the load of any vehicle shall extend more than four feet beyond the rear of the bed or body thereof, there shall be dis- played at the end of such load in such position as to be clearly visible at all times from the rear of such load, a red flag not less than twelve inches in length and width. Section 13. UNLAWFUL TO el -DE OUTSIDE OF Vee1CLE. It shall be unlawful for any person to ride on any portion of any vehicle nob designated or intended for the use of passengers when such vehicle is in motion. This provision does not apply to an employee engaged in the necessary discharge of his duty nor to persons riding within truck bodies intended for merchandise. Section lel. -10TRRORS. No person shall operate any motor vehicle upon a public roadway unless such vehiele is equipped with a mirror so located as to reflect to the operator a view of the roadway for a distance of two hundred feet to the rear of such vehicle. Section 15. RAILUAY TPATNS NOT TO BLOCK STREETS. It shall be unlawful for the directing officer or the operator of any steam railway train or car to direct the operation of or to operate the same in such a manner as to prevent the use of any street for purposes of travel for a period of time longer than five minutes, except that this provision shall not apply to trains or cars in:motion other than 'hose en. - gaged in switching. ARTICLE 71IT PMULTIFS Section 1. PENALTY. Any person. violating any of the provisions of this ordinance or any rule or regulation mnde in compliance therewith shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by fine not to exceed one hundred (61-00-20) dollars. Section 2. OWNER PRIMA. FACIE Pi7SP0NSIBLE FOR ILLEGIL PJI.RKING. If any vehicle is found upon any road.nay in violation of any provision in this ordinance regulating the stopping, •standing, or parking of vehicles and the identity of the operator cannot be determined, the oJeler or person in whose name such vehicle is registered, shall be held prima facie responsible for such violation. Section 3. GONSTITUTIONI,LITY. If any part or parts of this ordinance shall be held unconstitutional, such unconstitutionality shar not affect the validity of the rereflining oarts of this ordinance.
