O62-02KENNEDALE ORDINANCE NO. 62-2 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OF KENNE- DALE, TEXAS; PROVIDING THAT SUCH AREA SHOULD BE MADE A PART OF SAID CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL TRF, ENTITLED TO ALL THE PRIVILEGES OF OTHER PROPERTY OWNERS AND CITIZENS OF SAID CITY, AND SHALL BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE FTER ADOPTED; FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID CITY AS HERETOFORE ADOPTED, AND FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Article 974, Texas Revised Civil Statutes of 1925, as amended, three inhabitants of the hereinafter described territory, ea-ch of whom is qualified to vote for members of the State Legislature, have heretofore executed and filed with the Mayor of the City of Kennedale, Texas, their affidavit reciting that an election has been held in and among the inhabitants of said hereinafter described territory, who are qualified to vote for members of the State Legislature, and that a majority of such inhabitants who are so qualified to vote have voted in favor of said hereinafter described territory becoming a part of the City of Kennedale, Texas, which affidavit has been duly certified by the Mayor to the City Council of said City of Kennedale, Texas; and WHEREAS, the City Council of the City of Kennedale, Texas, as provided by law, has duly and legally considered the same, and it appearing to the City Council that all statutory requirements in connection with said election and affidavit and the annexation of said hereinafter described territory have been fulfilled, that an election was in fact held as recited in said affidavit, that a majority of the inhabitants of said territory, qualified to vote for members of the State Legislature, have voted in favor of annexation, that said territory is adjacent to the present boundaries of the City of Kennedale, Texas, and is not more than one-half mile in width, and that it would be to the best interest of the City of Kennedale and its inhabitants, as well as the inhabitants of said territory, to annex the same, all of which the City Council so finds; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. That the hereinafter described territory, lying adjacent to the existing boundaries of the City of Kennedale, Texas, be, and the same is hereby annexed and brought within the corporate -limits -and hereby made an integral part of the City of Kennedale, Texas, said land and territory being described by metes and bounds as follows, to -wit: BEGINNING at a present southeast corner of the existing corporate limits of the City of Kennedale, Tarrant County, Texas, said point being 384.5 feet south 88 deg. 15 min. west of the southwest corner of the E.C. Cannon Survey, Abstract No. 378, and being the southeast corner of that certain land and territory in the R. C. Richey Survey, Abstract No. 1327, in Tarrant County, Texas, as described in and annexed to the City of Kennedale by Kennedale Ordinance No. 61-6, recorded in Vol. 3568, at page 110, of the Tarrant County Deed Records; THENCE north 88 deg. 15 min. east 384.5 feet to the southwest corner of the said E.C. Cannon Survey, Abstract No. 378; THENCE east with the south line of said E.C. Cannon Survey and the south line of the Franklin Wood Survey, Abstract No. 1628, to the southeast corner of said F. Wood Survey in the west line of the B. Jopling Survey, Abstract No. 880; THENCE south with the west line of said B. Jopling Survey to the southwest corner of said survey, and continuing south with the west line of the J. Russell SurveY, Abstract No. 1328, and the east line of the W.H. Hudson Survey, Abstract No. 716, an additional 795 feet to a point in said survey line 25 feet due west from the southwest corner of a seven acre tract of land as des- cribed in deed from Thomas P. Randall and wife, to W.E. Hughes, recorded in Vol. 2355, at page 281, of the Tarrant County Deed Records; T CE east 25 feet to the southwest corner of said W.E. Hughes Tract, and continuing east along the south line of said Hughes Tract and crossing the Old Mansfield Road to the easterly right-of-way line of said Old Mansfield Road; THENCE northwesterly with the easterly right-of- way line of said Old Mansfield Road to its inter- section with the existing corporate limits of the City of Kennedale, Texas, in the east line of the said F. Wood Survey, said point being in the east boundary line of that certain property annexed to. the City of Kennedale by and described in Kennedale Ordinance No. 60-8, recorded in Vol. 3484, at page 162, of the Tarrant County Deed Records; THENCE southerly, and then westerly, northerly, etc., with the meanders of the existing corporate limits of the City of Kennedale, Texas, to the place of beginning; all of the aforesaid property and territory being situated in Tarrant County, Texas. Section 2. That the owners and inhabitants of the area hereinabove described and annexed shall be entitled to all the rights and privileges of other owners and citizens of the City of Kennedale, Texas, and shall be bound by all of the acts and ordinances of the City of Kennedale now in full force and effect and that may be hereafter adopted. Section 3. That the official map and boundaries of the City of Kennedale, Texas, as heretofore adopted, be, and the same are hereby corrected and amended so as to include the hereinabove described area and territory as a part of the City of Kennedale, Texas. Section 4. This ordinance shall become effective immediately upon itspassage and approval by the Mayor, duly attested by the City Secretary. City Secretary, City 0 Knnedae Texas 20PADO PETITION FOR ANNEXATION TO THE HONORABLE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: The undersigned, Trinity Valley Seminary, a Texas corporation, of Tarrant County, Texas, acting by and through its duly authorized undersigned officers, being the only owner of all of the hereinafter des- cribed land and territory lying contiguous and adjacent to the existing corporate limits of the City of Kenne- dale, Texas, hereby petitions the Mayor and City Council of the City of Kennedale, Texas, to institute all pro- ceedings and to adopt all ordinances and do things neces- sary to annex the said hereinafter described land and territory and make the same a part of the City of Ken- nedale, Texas, said land and territory being more par- ticularly described as follows, to -wit: BEING a part of the E. C. Cannon Survey, Abstract No. 378, in Tarrant County, Texas, and described by metes and bounds as follows:. BEGINNING in the present southerly corporate limit line of the City of Kennedale, Texas at the point of inter- section of the north line of said E. C. Cannon Survey, being also the south line of the J. B. Renfro Survey, Abstract No. 1260, and the east right of way line of U. S. Highway No. 287; THENCE. southeasterly with the east right of way line of said U. S. Highway No. 287 to the southwest corner of a tract deeded to J. S. Compton by warranty deed recorded in Vol. 3129, Page 406, Tarrant County Deed Records, and the northwest corner of a tract deeded to Trinity Valley Seminary by warranty deed recorded in Vol..3596, Page 534, Tarrant County Deed Records, said point being the northwest corner of petitioner's property in the north- east right of way of the Fort Worth -Mansfield Road (U. S. Highway No., 287 to the southwesterly right of way line of said U. S. Highway No. 287; THENCE northwesterly along the southwestern right of way line of said U. S. Highway No. 287 to the north line of the said E. C. Cannon Survey, said point being in the present corporate city limits line of the City of Kennedale, Texas; THENCE east, with the present city limits of the City of Kennedale, Texas to the place of beginning. It is the intention to herein describe for annexation the entire property of Trinity Valley Seminary as described in and acquired by a warranty deed from the trustees of Bethel Baptist Church to Trinity Valley Seminary, recorded in Volume 3596, at Page 534, of the Deed Records of Tarrant County, Texas, together with that portion of U. S. Highway No. 287 abutting said pro- perty on the west and intervening between such abutting portion of the highway and the present south corporate limit line of the City of Kennedale, Texas, on U. S. Highway No. 287. Petitioner represents and hereby shows the said Mayor and City Council of the City of Kennedale, Texas, that the above described property is contiguous and adjacent to the present city limits of the City of Kennedale, Texas, is less than one-half mile in width, is not now a part of any other municipal corporation, and that less than three qualified voters reside on said land and territory. E. Miller, as de facto president of Trinity Valley Seminary, a de facto corporation, being the same organization as the Trinity Valley Seminary for which we are Trustees, and the afore- said de facto secretary, G.
