DATE . _ WHEREAS, pursuant to the provisions of Art. 974—g, Texas Revised Civil Statutes of 1925, as amended, Jack M. ,I ngdon, Walter H. Clarke, Dennis R. Rose and James C. Estes, of Tarrant County, Texas, being all of the ox,ers of the real property hereinafter described, have 'ade application as by law provided to the Mayor and City Coun- cil of the City of Kennedale, Texas, requesting annexation to said City of the_area situated in the County of Tarrant, State of Texas, described as follows, to -wit: BEING a part of the E. C. Cannon Survey, Abstract No. 378, and the R. C. Richey Survey, Abstract No. 1327, in Tarrant County, Texas, and described by metes and bounds as follows: BEGINNING at the point of intersection of the south line.of,the J. Ba Renfro Survey, Abstract No. 1260, and the easterly right-of-way line of the H. & T. C. Railroad (also known as the T. & N. 0. Railroad), said point being in the present south corporate limits of the City of Kennedale, Texas, and being the northwest corner of a tract of land deeded to Bessie Sloan by Warranty Deed recorded in Vol. 3073, at page 348, of the Tarrant County Deed Records; THENCE west with the south line of said J. B. Renfro Survey and the north line of E. C. Cannon Survey, Abstract No. 378, to the northwest corner of said Cannon Survey; THENCE south along the west line of said Cannon Survey to a point in said west line 833.33 feet north of the southwest corner of said Cannon Survey, same being the northeast corner of a tract of land deeded to Jack Elliott and wife by warranty deed recorded in Volume 3322, at_page 312, of the Tarrant County Deed Records; THENCE west with fence line along the north line of said Elliott Tract 785.27 feet to an iron pin in the east line of the.Kennedale-New Hope Road, said point being in the present corporate limit line of the City of Kenne- dale, Texas; THENCE south 0 deg. 45 min. east with said east line of said road 501.35 feet to an iron pin at the south- west corner of said Elliott Tract; THENCE west along the south line of said Elliott Tract, same being an existing corporate limit line of the City of Kennedale, Texas, 384.5 feet to a point for corner, said point being a northeast corner of the area annexed to City of Kennedale by and described in Ke edale Ordinance No. 61-6, recorded in Vol. 3568, at page 110, of the :Tarrant County Deed Records; THENCE south 0 deg. 45 min. east on a line parallel to and 384.5 feet east of the east right-of-way line of said Ke :edale-New Hope Road, said line being an existing corporate limit line of the City of :annedale, Texas, 84 feet, more or less, to a point for corner in the south line of a 1.486 acre tract of land conveyed by Agnes O. Oldham, et vir,, R. T. 0ldha , to the undersigned petitioners; THENCE south 89 deg. 41 min. east along the south line of said tract conveyed by the Oldhams to the under- signed petitioners to the southeast corner of said tract in the west line of the said E. C. Cannon Survey, said point being 246.6 feet north of the southwest corner of said Cannon Survey; THENCE south along the west line of said Cannon Survey to the southwest corner of said survey; THENCE east along the south line of said E. C. Cannon Survey, Abstract No. 378, to the southeast corner of said Cannon Survey; THENCE north along the east line of said Cannon Survey and the west line of the F. Wood Survey, Abstract No. 1628, 49 varas, to a southwest corner of the presently existing corporate limits of the City of Kennedale, Texas, as described in that certain territory annexed to Kennedale by Kennedale Ordinance No. 60-8, recorded in Volume 3484, at page 162, of the Tarrant County Deed Records; THENCE north and northwesterly along the present city limit line of the City of Kennedale, Texas, as described in said Kennedale Ordinance No..60-8, (being the westerly boundary line of the territory a7i,exed_by said Kennedale Ordinance No. 60-8), to the point of intersection of said present corporate limit line with the north line of the E. C. Cannon Survey, Abstract No. 378; THENCE west with the north line of said Cannon Survey to a point 413.56 feet, more or less, east of the easterly right-of-way line of U. S. Highway No. 287, said point being the northeast corner of a tract deeded to J. S. Compton by warranty deed recorded in Volume 3129, at page 406, of the Tarrant County Deed Records; THENCE southeasterly along the northeast boundary lines of said Compton Tract, of a tract deeded to Trinity Valley Seminary by warranty deed recorded in Volume 3596, at page 534, Tarrant County Deed Records, and of a tract deeded to John P. Elrod by warranty deed recorded in Volume 2906, at page 58, Tarrant County Deed Records, 350.8 feet, more or less, to the northeast corner of said Elrod Tract; THENCE southwesterly along the southeast boundary line of said Elrod Tract 310.4 feet, more or less, to the easterly right-of-way line of U. S. Highway No. 287; THENCE northwesterly along the east right-of- way line of said U. S. Highway No. 287 to the north line of said E. C. Cannon Survey; THENCE west along the north line of said Cannon Survey to the westerly right-of-way line of said U. S. Highway No. 287; THENCE southeasterly along the westerly right- of-way line of said U. S. Highway No. 287, 858.2 feet, more or less, to the southeast corner of a tract deeded to Elmer Atkins by warranty deed recorded in Volume 2901, page 477, Tarrant County Deed Records; • THENCE southwesterly along the southeastern boundary line of said Atkins Tract 564.78 feet, more or less, to the southwest cornerof said Atkins Tract in the easterly right-of-way line of the H. & T. C. Railroad (also known as the T. & N. O. Railroad); THENCE northwesterly along the easterly right- of -way line of said railroad to the north line of said E. C. Cannon Survey; THENCE west along the north line of said Cannon Survey to the place of beginning; SAVE AND EXCEPT, that portion of the hereinabove described tract included in said H. & T. C. Railroad right-of-way, and a tract of land included in said above described property as described in warranty deed to G. L. Cayce, recorded in Vol e 3383, at page 141, of the Tarrant Courr Deed Records, said Cayce Tract abutting the east side of U. S. Highway No. 287 and.the south line of said E.C. Cannon Survey. (It is the intention to herein describe for annexa- tion all_of the land owned by the said petitioners, Jack M. Langdon, Walter H. Clarke, Dennis R. Rose and James C. Estes in the E. C. Cannon Survey, Abstract No. 378, which land was acquired by said petitioners by warranty deed from H. R. French, recorded in Vol. 3628, at page 483, of the Tarrant County Deed Records, and also to include all of the land owned by said petitioners in the R. C. Richey Survey, Abstract No. 1327, and acquired by separate warranty deeds from Jack Elliott and Agnes 0. O1dha,T, et vir., insofar as such land is not already within the heretofore existing corporate limits of the City of Kennedale, Texas,` plus all of U.S. Highway No. 287 lying within the said E. C. Cannon Survey.) WHEREAS, the City Council of the City of Kenne- dale, Texas, as provided by law, at a regular meeting on this 1st day of March, 1962, (which is more than five and less than thirty days since the filing of said petition with the City), duly and legally considered the said peti- tion, hearing_the arguments for and against such annexation, and it appearing to the City Council that all statutory requirements in connection with said application and petition have beer fulfilled and that all of said area, on which less than three qualified voters reside, is adjacent and contiguous to the present existing boundaries and limits of the City of Kennedale, Texas, and is not «ore than"one-half wile in width, all of which the Council so finds; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KE DALE, S Section 1. That the property hereinabove described lying adjacent and contiguous to the present existing boundaries and limits of the City of Kennedale, Texas, be, and the same is hereby annexed and brought within the corporate limits and made an integral part of the said City of Kennedale, Texas. Section 2. That the owners and inhabitants of the area herein annexed, be,, and they are hereby declared entitled to all the r: fiats and privileges of other property owners and citizens of the said City of Kennedale, Texas, and shall henceforth be bound by all the acts and ordinances of said City of Kennedale which are now in force and effect, and which may be hereafter adopted. Section 3. That the official map and boundaries of the City of Kennedale, Texas, as heretofore adopted and amended, be corrected and aHeded, so as to ielude the above described area and territory as a p-.r' of the City of Kennedale, Texas. Section 4. That this ordinance is adopted subsequent to the adoption of Kennedale Ordinance No. 62-2, and all of the land and territory herein described and hereby annexed is included within the boundaries of the land and territory described in and annexed to the City of Kennedale by said Kennedale Ordinance No. 62-2. The annexation by Kennedale Ordinance No. 62-2 was pursuant tG Art. 974, Texas Revised Civil Statutes of 1925, as amended, and the sole purpose of adopting this ordinance subsequent to the adoption of Kennedale Ordinance No. 62-2 is pre- cautionary, and in order to effect the annexation of the hereinabove described territory pursuant to Art. 974-g, in the ever.,t that the prior annexation of said territory by Kennedale Ordinance No. 62-2 should be held ineffective for. any reason. Section 5. That this ordinance shall become effective from and after its passage and approval by the Mayor, duly attested by the City Secretary. ADOPTED AND APPROVED this the 1st day of March, A.
