O62-07KENNEDALE ORDINANCE NO. 62-7 AN ORDINANCE REQUIRING THAT ALL DOGS WITHIN THE CITY OF KENNEDALE, TEXAS, BE VACCINATED FOR RABIES AND LICENSED; PRESCRIBING A PRO- CEDURE AND FEES FOR LICENSING; PROHIBITING THE RUNNING AT LARGE OF DOGS; PROVIDING FOR THE IT0UNDING OF DOGS, THEIR REDEMPTION AND DISPOSAL; PROVIDING FOR THE QUARANTINE AND CONFINEMENT OF BABIED OR SUSPECTED DOGS; FIXING PENALTIES FOR THE VIOLATION HEREOF; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. It shall be unlawful for any person within the City of Kennedale, Texas, to own, keep, possess, harbor or allow to remain upon premises under his control, or elsewhere within the City, any dog, male or female, without having obtained a license therefor. The fee for such license shall be $I.00 per year for each -dog, payable in advance. All licenses shall expire December 31st, and shall not be issued for less than one year. Section 2. No license shall be issued for any dog owned, kept, possessed, harbored or allowed upon any premises unless such dog shall have first been vaccinated against rabies by a veterinarian duly licensed to practice in the State of Texas, within twelve months prior to the issuance of such license. There shall be delivered to the City Secretary prior to the issuance of such license, a certificate signed by such duly licensed veterinarian certifying to the vaccination of such dog and the date of said vaccination. Section 3. Upon receipt of the certificate of vaccination and payment of the license fee, as provided in the two preceding sections, the City Secretary shall issue a receipt, license and numbered metal tag. Section 4. The metal tag provided for in the preceding section shall be securely fastened in some manner to such dog. It shall be unlawful for any person to remove such metal tag from any dog without the written consent of the dog's owner. Section 5. The City Secretary shall keep a register of all licenses issued in which shall be entered the name of the applicant, the applicant's address, des- cription of the dog, number of the license and tag issued, and the date of issuance and expiration. Section 6. Any police officer of the City of Kennedale, or any other person designated by the Mayor or City Council, shall pick up and impound any dog reported and found running at large within the City limits. Section 7. It shall be unlawful for any person to permit any dog possessed, kept or harbored by him to be at large, unless leashed, on the streets or public places, or on private premises not under the control of such per- son, within the City of Kennedle, whether license for such dog shall have been secured or not. Section 8. Any dog found running at large and picked up as prescribed in the second preceding section shall be confined in the City pound, or other appropriate place designated by the City Council, either within or without the corporate limits of the City of Kennedale, for a period of forty-eight hours, during which time the owner, upon satisfactory proof of ownership, may redeem his dog upon payment of a pound fee of $2.00, plus an additional $1.00 for each day the dog has been boarded in excess of one day, the license fee provided in this ordinance if the dog is not duly licensed, and proof of vaccination as herein required. Upon the compliance with said requirements, the person in charge of the pound shall issue an official receipt for the amount paid, and such fee shall be delivered to the City Treasurer and credited to the general fund of the City. Suitable and necessary sus- tenance for all dogs so impounded shall be provided at the cost of the City. Section 9. If the owner of any dog impounded under the provisions of this ordinance shall not apply for such dog and pay the required fees and provide or present proof of vaccination within forty-eight hours from the time such dog is confined in the City pound, any police officer of the City of Kennedale, or any other person designated by the Mayor or City Council, is hereby authorized to sell such dog at private sale, and the proceeds of such sale shall be deposited with the. City Treasurer and credited to the general fund of the City. In the event the owner fails to claim such dog within the time provided, and said dog cannot be sold, it shall be the duty of such person to destroy the same. Section 10. The person in charge of the pound shall make periodic reports, at such intervals as may be designated by the City Council, covering all dogs received into_the pound, showing the name of the owner, if known, date received, all dogs redeemed and date of redemption, all dogs sold and date of sale, together with the name of purchaser, all dogs destroyed, and all monies expended for the maintenance of such pound, and all monies received for the redemption and licensing of dogs. Section 11. Every animal of the dog kind that has rabies or symptoms thereof, or any dog that bites, scratches or otherwise attacks any person within the corporate limits of the City of Kennedale, shall be immediately and securely confined by the owner, or one having custody, by tying with a chain of good quality, or by confining within an escape -proof pen, for a period of fourteen days, in such place and manner that no other person or animal may be bitten by it, and there held subject to inspection from time to time so as to enable the person attacked or any official of the City to determine whether such animal is affected by rabies; or such animal shall be quarantined and held for a like time in any veterinary hospital ap- proved by the City Council, or shall be held at the City pound for fourteen days, at the owner's expense, a charge of 1.00 per day per dog being made therefor, after which time the dog shall be killed if in quaran- tine at the City pound and found to be rabied, or if not, redeemed by the owner. Section 12. Any animal of the dog kind that has rabies or symptoms thereof, or that is suspected of having rabies, or that has been exposed to rabies, shall be at once released to any police officer of the City of Kennedale for disposal. or confinement at the owner's ex- pense in a veterinary hospital approved by the City Coun- cil, or in the alternative, shall immediately and securely be confined by tying with a chain of good quality or penned in an escape -proof pen and kept under the super- vision of the Police Chief of the City of Kennedale for a period of not less than sixty days. Section 13. It shall be the duty of the owner or harborer of any dog, or any practicing veterinarian, or any other person, to promptly report to the Police Chief or a police officer of the City of Kennedale all cases of rabies with which he comes in contact or to which his attention has been directed within the City. Such report shall be immediately made upon diagnosis or sus- picion of such cases of rabies. Section 14. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any sum not to exceed S200.00 for each and every offense. Each day that any violation of this ordinance continues shall constitute a separate offense. Section 15. This ordinance shall take effect and be in force from and after its passage and publication as by law provided. 1962. The purpose of this ordinance is to prevent the running at large of stray dogs in Kennedale, to provide for the supervision and licensing of dogs belonging to or kept by Kennedale residents, and to safe- guard the public health and safety against attacks by vicious or rabied dogs. The ordinance provides a penalty by fine in any amount not to exceed $200.00 for any violation of the ordinance, and each day that a violation continues is declared to be a separate offense. The ordinance is declared to be effective immediately upon completion of publication as required by law.
