AN 0INANCE RATIFYING THE PRIOR APPOINT-
MENT OF A ZONING COMMISSION OF THE CITY
OF i SALE, TEXAS, AND PROVIDING THAT
THE. ZONING COMMISSION AND CITY .COUNCIL.
OF THE CITY OF KENNEDALE, TEXAS, SHALL
HOLD A JOINT PUBLIC TARING ON JULY 25,
1963, TO CONSIDER TEE ENACTMENT OF A
CORELNSIVE ZONING ORDINANCE . OF . THE
CITY OF KENNEDALE, TEXAS.
WHEREAS, as heretofore recited in minutes of
the City Council of the City of Kennedale, Texas, said
Council has been unable to prevail upon other:' qualified
citizens to serve upon a Zoning Commission of the City
of Kennedale, Texas, and has heretofore appointed the
Mayor and members of the City Council as a Kennedale
Zoning Commission; and
WHEREAS, said Zoning Commission has heretofore
set the 25th day of July, 1963, as a time for public
hearing on the proposed enactment of a comprehensive
zoning ordinance for the City of Kennedale, Texas, and
it is the desire of the City Council that such meeting
be a joint meeting between the Zoning Commission and
the City Council to consider such proposed zoning
ordinance; now, therefore:
CITY OF
BE IT ORDAINED BY THE CITY COUNCIL OF THWKENNEDALE,
TEXAS:
1. That the prior action of the City Council
in appointing by resolution in its minutes a Kennedale
Zoning Commission composed of NormanhT0 Childres, as
Chairman, and Steve Radakavich, Roy Vick, Paul Winters,
Gene Harper and W. C. Helm, Jr., as other members thereof,
be, and the same is hereby ratified and confirmed, and
the said six men, Norman T. Childres (Chairn.n), Steve
Radakavich, Roy Vick, Paul Winters, Gene Harper and W. C.
Helm, Jr., are hereby appointed, confirmed and declared
to be and constitute the Kennedale Zoning Commission,
and previous acts and meetings of said appointees as
a Zoning Commission are hereby expressly ratified and
confirmed.
2. That as recited in the preamble hereof
it has been necessary for the Kennedale City Council
to appointits own members to act as a Zoning
Commission because of the failure and refusal of
other qualified citizens to consent and agree to
act as such.
3. That said`_Kennedale Zoning Commission
and the City Council of the City of Kennedale, Texas,
shall hold a joint public meeting at the Kennedale
Lions Club .Building, located at the intersection of
Broadway Street and New Hope Road, in the City of
Kennedale, Texas, at 7:30 o'clock P. M. on Thursday,
July 25th, 1963, to consider the enactment of a pro-
posed comprehensive zoning ordinance for the City of
Kennedale, Texas.
4. This provision for a Joint meeting is
in accordance with Article 1011f of the Texas Revised
Civil Statutes, as amended by the 57th Legislature,
and notices as required by law shall be given in
accordance with said act, and all prior notices of
said hearing are hereby ratified and confirmed by
this City Council.
5. This ordinance shall be in effect
immediately upon its passage and approval, and the
rytification of prior appointment of the Zoning
Cou!fission and prior notice of the aforesaid public
hearing shall be retroactive to the times thereof,
respectively.

The Zoning Commission of the City of Kennedale,
Texas, after public hearing held on the 25th day of July,
1963, and after giving due consideration to all objections
and discussions of inteiested citizens and property owners
at such public hearing, submits this its final report for
presentation as recommendations to the Kennedale City
Council with respect to the enactment of a co=rehensi
Zoning Ordinance for the City of Kennedale,
The Zoning Commission hereby adopts by reference
its preliminary report, dated May 21, 1963, and heretofore
submitted to the City Council of the City of Kennedale,
Texas, subject, however, to the following changes:
(1) It is recommended that the 300 foot wide strip
of land abutting the southwesterly right-of-way line of the
Southern Pacific Railroad be zoned "C" Light Industrial,
rather than "D" Industrial as set forth in the preliminary
report.

(2) It is recommended that the area within 200,
feet of either side of New Hope Road and lying immediately
southwest of the Southern Pacific Railroad right-of-way,
and for a distance of 300 feet from said right-of-way, be
zoned "A" Single Family Residential, rather than "D" Industrial
as shown.in said preliAitary report.
With the two above mentioned modifications, it i
the recommendation of the Zoning Commission that a compre-
hensive Zoning Ordinance be enacted by the Kennedale City
Council in accordance with the reco4mendations set forth in
said preliminary report of May 21, 1963.

PRELIEINARY REPORT
OF THE ZONING COMEISSION
THE. CITY OF KENNEDALE, TEXAS
This is a preliminary report of the Zoning
Commission of the City of Kennedale, Texas, outlining
tentative proposals for the enactment of a comprehensive
zoning ordinance for the City of Kennedale, Texas, as
formulated at a special meeting of the Zoning Commission
on May 21, 1963. This preliminary report is for presentation
and discussion at a Public Hearing to be held on July 25, 1963,
and after sch hearing, it is contemplated that the Zoning
Commission will adopt its final report for presentation as
recommendations to the Kennedale City Council with respect
to zoning.
ZONING DISTRICTS
It is recommended that the City of Kennedale be
divide into four zoning districts as follows:
District A - One -Family Dwelling District
District B - Business, Commercial and Multi -
Family Dwelling District
District C - Light Industrial District
District D Industrial District .
AREAS OF DISTRICTS
it is tentatively recommended that the areas of
the City of Kennedale comprising the above zoning districts
be as follows:
District A - SingleFamily Dwellings: All portions
of the City of Kennedale, including property hereafter annexed
until otherwise.zoned, except the specific areas hereinafter
expressly included in other districts. (Thus, District•A will
include essentially all of Kennedale except three hundred (300)
feet along either side of U. S. Highway No. 287, three hundred
(300) feet along the south side of Interstate Highway No. 820,
that portion of the E. C. Cannon Survey lying east of the Southern
-
Pacific- Railroad and west ofa three hundred (300) foot strip
along the west side of the Old Mansfield Road, three hundred
(300) feet along •the southwest side of the Southern Pacific
Railroad, Oak Crest Addition, and Lots _1-21, of Block 2, and
Lots 9, 23-28, of Block 1, Woodlea Acres Addition.)
District B - Business, Commercial and Multi -Family
Dwellings: All of the land within the City of Kennedale lying
within three hundred (300) feet of the easterly and westerly
right of way lines of U. S. HIV/way No. 287, and lying within
three hundred (300) feet of the southerly right o2 way line
of Interstate Highway No. 820. (Thus, District 3 will be a
three hundred (300) foot strip along either side cf U. S.
Highway No. 287, anda threehundred (300) foot strip along the
south Sid.0 of Interstate Highway No. 820.)
District 0 - Light Industrial: All of the E. C.
Cannon Survey, Abstract No. 378, lying between the easterly
right ofway line of the Southern Pacific Railroad on the
west and a line drawn parallel to and three hundred (300)
feet west of the westerly right of way line of the Old
Mansfield Road on the east. (Thus, District C will include
all of the E. C. Cannon Survey within the City of Kennedale
and lying east of the Southern Pacific Railroad, except for
a three hundred foot strip along the west side of the Old
Mansfield Road.)
District D industrial: All cf the Gak Crest
Addition, Lots 9 and 23-28, both inclusive, in Block 1, and
Lots 13-21, both inclusive, in Block 2, of Woodlea Acres,
that portion of the J. Prickett Survey, Abstract No. 1225,
and the Shelby County School Land Survey lying east of U. S.
Highway No. 287 and north of Lot 24, Block 1, Woodlea Acres
Addition, and a three hundred foot strip of land along the
southwest side of the Southern Pacific Railroad right of way,
except any portion of the Briarwood Addition therein.
USE REGULATIONS
It is recommended that buildings and lands in the
various districts be restricted to the following uses,
respectively:
District A: One -family dwellings, churches, .public
sthools, museums, libraries, parks and ether similar public
facilities, farming and truck gardening incidental to residential
use. (It is also recommended that the Zoning Board of Adjust-
ent-be, given authority to pernit duplexes in buffer zones, if
deemed -appropriate, at the outer_limits of this district, when
adjoining property being used as -permitted in District B.
District 3: Any use permitted in District A, two-
family dwellings, multiple (dwellings, boarding and lodging
houses, hotels, apartments, tourist courts, hospitals, doctors'
and dentists' offices, banks, restaurants, retail stores and
shops, grocery stores, gascline service stations, and similar
business and commercial uses, as distinguished from industrial
or manufacturing purposes or uses,
District C: Any use permitted in Districts A and
amusement parks, bakeries, bottling plants, creameries, build
inge material storage yards, cold storage plants, dog and cat
hospitals, kennels, electroplating, galvanizing, ice plants,
lumber yards, machine shops, patternshops, monument works,
printing shops, sheet metal shops, paint shops, welding shops,
wholesale houses, motor truck terminals and light Manufacture
of products from plastics, aluminum, brass, bronze, copper,
steel, tin or other metals, leather and wood, provided that
power not in excess of ten horsepower is employed in the
operation of any one machine.
District D: Any use permitted in Districts A, 3
and. C, cotton sins, brick works, dos pounds, egg processing,
meat and poultry process , _forge plans, structural welding,
and heavy manufacturing and processinc, of any provided,
however, no use which Is excessively obnoxious or offensive
by reason of dust, smoke, gas, noise or vibration shall be
permitted, and the o11owing uses are to be expressly prohibited:
slaughter house, produce house, rendering p7ant, giva factory,
acid or ammonia manufacture, blast furnaces, bailer works,
creosotemanufacture, charcoal manufacture, explosives man -facture
or storage, fertilizer manufacture, garbage or animal reduction
or dumping, gas manufacture or processing, petroleum refining
or storage, SZOOk yards, feeding pens, junk yards, tanneries,
tar or asphalt manufacture, used automobile junk yards.
HEIGHT AND AREA REGULATIONS
It is recommended that the following.: limitations
and regulations be Placed on property in the respective districts: •
LOT AREA: A minimum lot area of seven thousand
(7,000) souare feet, applicable to all districts, with
additional area to be provided if served by septic tank,
rather than public sewer, and a minimum lot width of seventy
(70) feet applicable to all districts.
HEIGHT REGULATIONS: A limit on height of buildings
to two and one-half (24) stories or thirty-five (35) feet in
District A, three (3) stories or forty-five (45),feet in
District 3, five (5)stories or sixty (60) feet in District C,
and no limit in District D.
FRONT YARD DEPTH: A front yard of at least thirty
30) feet indepth from the street in District A, twenty-five
25) feet in District 3, C and D.
REAR YARD DEPTH: A rear yard having a depth from
the rear of the lot of not less than twenty (20) feet in
District A, and not leeS than ten (10) feet in Districta„C and
SIDE YARD WIDTH: A side yard having a width from
the side of the lot to the building of not less than ten (10)
feet in District A, provided that on a corner lot thereshall
be a side yard of at least fifteen (15) feet in District A,
and a side yard of nbtless than fiVe (5) feet in District B,
C and D, provided that the Zoning Board of Adjustment should
be given authority, on special application, andwhen circum-
stances justify, to permit.joint party walls on the lot line
for adjoining commercial -buildings.
OTEER GERisRAL RECOMENDAiIONS
The following general observations and recommendations
have been tentatively agreed.upon by the Zoning Commission:
1. The zoning ordinance should provide regulations
to require adequate off-street parking for all business,
commercial and public buildings.
2. The zoning ordinance should completely forbid
the establishment or maintenance of auto junk yards in Kennedale,
and the use of house trailers except in approved trailer camps.
3. It is the tentative thought of the Zoning
Commission that requirements for minimum floor space of
houses and Other •buildings should not be included in the
zoning ordinance.
4. The ordinance on zoning should contain definitions
of terms, similar to those in the tentative ordinance draft
submitted to the Zoning Commission by the Kennedale City Attorney.
5. The zoning ordinance should provide for a
Zoning Board of Adjustment, with the powers granted by statute
to vary requirements in particular circumstances.
6. The zoning ordinance should provide for its
future amendment in accordance with law.
7, The above enumerated ses are not intended to
be exclusive, but it is the thought of the Zoning Commission
that the City Council and its Attorney in drafting and adopting
anordinance, will perhaps see fit to enumerate other uses, or
restrict some of the listed uses, in accordance with the intent
herein recommended.
8. There was some discussion on the advisability of
including a district for multi -family dwellings, but it was
tentativeidetermined that this should be eliminated, the feeling
of the Zoning Commission being that there would not be enough
demand in our municipality for multi -family housing to justify
a separate district, and that this could be a permissible use
in the business and commercial district.
9. There was also discussion concerning the advis-
ability of a district with an agricultural classification, to
include undeveloped land in the City of Kennedale until such
time as it is ready for development. The Commission was able
to come to a definite conclusion here, and as an alternative,
included agricultural and farming use as permissiole in the
single-faily dwelling district, thinking that amendment of
zoning could be had if property in its reasonable development
required another classification; however, the Zoning Commission
still has an open mind on the advisability of an agricultural
classification.
