O61-04KEN'NEDAT ORDINANCE NO, 61-4 AN ORDINANCE ALTERING TEE PRIMA FAC SPEED LIMITS ESTABLISHED FOR VEHICT07S UNDER THE PROVISIONS OF SECTION 8. OF ARTICT,E 827a, VERNON' S TEXAS PENAL CODE, UPON TEE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF TEE CITY OF KENNEDALE, TEXAS, AS SET OUT IN TEE ORDINANCE; NAD PROVIDING A PENALTY OF A FINE NOT TO EXCEED 32OG.00 FOR VIOLATION OF THIS ORDINANCE. WHEREAS, Section 8, of Article 827a, Vernon's Penal Code of the State of Texas,provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable orEafe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, whiC.h shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, nowtherefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 8, of Article 827a, Vernon's Texas Penal Code, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as, follows: ON U. S . HIGHWAY NO. 287: 1. From the West City Limits of Kennedale at Station 548 4- 18 (being the point of intersection of the West City Limits of Kennedale and said Highway 237), Southeast to a point 1.136 miles East of said West City Limits, 45 miles per hour. 2. From a point 1.136 miles East of the West City Limits of Kennedale, for a distance of 0.315 miles to a point 1.451 miles East of said West City Limits, 35 miles per hour. 3. From a point 1.451 miles East of the West City Limits of Kennedale, for a distance of 0.183 miles to a point 1.640 miles East of said West City Limits, 30 miles per hour at all times that a sign is placed thereon designating same as a school crossing, and 35 miles per hour at all other times. 4 From a point 0.852 miles West of the East City Limits of Kennedale (that is, from the intersection of the East City Limits of Kennedale and said High- way 287), for a distance of 0.600 miles to a point 0.252 miles West of said East City Limits, 35 miles per hour. 5. From a pofiat 0.252 miles West of said East City Limits of Kennedale, for a distance of 0.252 miles to said East City Limits, 40 miles per hour. Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than $200.00.
