R223CI~'Y SECRETARY OFFICIAL i~ILE COPY RESOLUTION NO. 223 A RESOLUTION OF THE CITY OF KENNEDALE, TEXAS ADOPTING A POLICY FOR RENTAL OF THE kENNEDALE COMMUNITY CENTER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City desires to allow the Kennedale Community Center to be rented for private functions; and WHEREAS, the City Council desires to adopt a policy containing requirements and guidelines for the use of the Community Center. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS, THAT: SECTION 1. The City of Kennedale Community Center Rental Policy attached hereto as Exhibit "A", is hereby by adopted. All use of the Community Center shall be in accordance with the Policy. SECTION 2. APPLICATION: Applications for use of the facility shall be reviewed by the Library Director or a designee. These rules are intended to prevent civil strife, unrest, mob, violence and property damage. If, after review of the application, the director/ designee finds that the intended use of the facilities would, in reasonable probability, promote unrest, or cause civil strife, mob violence, or property damage, or involve any illegal activity, he/she may DISAPPROVE the application. If the applicant disagrees with the decision he/she shall have three (3) days to bring an appeal to the City the Manager. The City Manager's decision will be the final decision on the appeal. 2. IN PERSON: Applicant must appear in person at the Library facility to apply for rental of the Community Center. And applicant must be 21 years of age. A copy of a driver's license or some form of picture identification that states the date of birth will be required for the application process. 3. DEPOSIT: All approved applications must be accompanied by a DEPOSIT as set forth in Section 2-3 of the Kennedale City Code and placed in the reservation log that's maintained by the Library Director. The entire deposit is refundable upon final inspection by city staff after the event has ceased. The community center must be presented to the staff inspector in the same condition, or better, prior to the rental event taking place in order to receive a refunded deposit. (See DAMAGES section on forfeiture of deposit). Allow up to 15 days after the event for the applicant to receive his/her refunded deposit, or a portion thereof. 4. FEES/PAYMENT: The rental fees are set forth in Section 2-3 of the Kennedale City Code. Rental fees shall be paid at least 3 DAYS prior to the date of actual event taking place. All completed applications and collected fees will be forwarded to the Finance Department daily, for processing. 5. BUSINESS HOURS: All facility usage requests and payments are required to be completed within the business hours of the Library, which are TUESDAY -SATURDAY. No rentals will be allowed prior to 8:00 A.M. daily. Rental availability will be from 8 A.M. to 10 P.M., Sunday through Thursday and from 8 A.M. to 12 A.M., Friday through Saturday. 6. RENTAL TIMES: All rentals applications must be filled out 2 WEEKS prior to actual event taking place. Reservations cannot be made more than 60 DAYS prior to actual event taking place. 7. RESERVATION AVAILABILITY: The user cannot gain access to the building NO MORE THAN 10 MINUTES prior to the scheduled reservation and MUST vacate the building promptly at the end of the reservation TIME. Set-up and Clean up time should BE INCLUDED in the Reservation time frame. EXHIBIT "A" KEY AVAILABILITY: Keys for the facility will be available at the Library during normal operating hours of the Library facility. And the keys will be available at the Police Department, during the times the Library is closed. The keys at either facility will be for pickup and drop off purposes. 9. RESERVATION LIMITATIONS: Facilities may be reserved by a USER or USER GROUP a maximum of 2 times per month with a maximum of 18 times per calendar year. 10. USER COLLECTING FEES: While the Community Center is being used, no user will be allowed to conduct financial transactions as part of the use of this rented facility. Therefore, no lotteries, auctions, games of chance drawings, raffles or any sale of merchandise, UNLESS authorized by the CITY MANAGER, by his/her signature on the application. 11. DECORATIONS: Decorations are allowed but are limited to those that do not cause damage to the walls, doors, ceiling (including sprinkler heads), and fixtures of the facility. Under no circumstances can anything be hung on the walls, doors, sprinklers or light fixtures. Decorations must be transportable and non-stationary. It must stand alone and not be attached to neither the walls, nor the ceilings, nor the light fixtures. Decorations are allowed to stand atop the tables, chairs, and/or the floor. 12. DAMAGES: The applicant agrees to assume all responsibility for any and all damages done to the Community Center facilities, and surrounding areas, including but not limited to, the patio area, the porch area, the lobby, and the restrooms facilities. The user will be charged for the total cost of the repair and/or replacement based on the assessment of any damages or violations of any rules. The deposit will be forfeited to pay the extent of the damages. If the damageable cost is less than the $150 deposit amount, the difference will be refunded back to the applicant. If the damageable cost is greater than the $150 deposit amount, the applicant will be responsible for paying the difference and will be subject to prevention of future rentals. It will be at the discretion of the City Manager to disallow future rentals from an applicant that is responsible for previous damages to the rental facility. 13. CHILDREN: All children under the age of 18 years, must be supervised at all times or applicant be subject to leave the premises and the rental event cancelled. All rental fees pertaining to the event will be forfeited to the City. No refund will be given to applicant for unused rental time. The applicant will be responsible for any damages committed by unattended/attended children. (See DAMAGES section on forfeiture of deposit) 14. TOBACCO/ALCOHOL: Under no circumstances shall the use of tobacco products or alcoholic beverages be allowed in the Community Center. If alcoholic beverages are discovered in the Community Center facilities or surrounding areas (porch, patio, lobby, restroom) of the center, the rental event will be immediately cancelled and all rental fees pertaining to the event will be forfeited to the City. No refund will be given to the applicant for unused rental time. Additionally, if there is evidence of illegal activity on the premises, the person(s) involved will be subject to the full enforcement of the law. 15. CLEAN UP FACILITY: The applicant will be responsible for keeping the Community Center and surrounding areas clean. The rental facility must be presented to the staff inspector in the same condition, or better, the applicant received it prior to the event. If the applicant fails to clean the rental facilities, the inspector will assess damages and determine the cost to clean the facilities and charge the DEPOSIT for payment of that cost. (See DAMAGES section on forfeiture of deposit). 16. REPORTING EMERGENCIES: Report any and all emergencies immediately to the Kennedale Police Department. EXHIBIT "A" 17. DISCLAIMER: The City of Kennedale reserves the right to change the rental rates, the deposit amount, the rules and regulations and/or any verbiage of this policy at any time and without notice.
