A RESOLUTION OF THE CITY OF KENNEDALE, TEXAS,
AUTHORIZING THE MAYOR TO EXECUTE A RELEASE OF A
DRAINAGE EASEMENT ON AND OVER LOT 6, BLOCK 1, SHADY
CREEK ADDITION, PHASE 1; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the City of Kennedale is a home rule city acting under its charter adopted
by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the
Local Government Code; and
WHEREAS, the City Council of the City of Kennedale finds that a drainage easement on
and over Lot 6, Block 1, Shady Creek Addition, Phase I, is no longer necessary for use by the
City because such easement has been replaced by another drainage easement at a better location.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KENNEDALE, TEXAS:
SECTION 1.
That the Mayor is authorized to execute a written release of the City of Kennedale's
interest in a drainage easement located on and across Lot 6, Block 1, Shady Creek Addition,
Phase I, according tot he plat thereof recorded in Volume 388-170, Page 80 of the Public Records
of Tarrant County, Texas, and the City Secretary is directed to record such release with the
County Clerk of Tarrant County, Texas.
SECTION 2.
This resolution shall be effective from and after its passage and adoption by the City
Council.
ADOPTED this 8th day of March 2007.

APPLICATION FOR THE VACATION/ABANDONMENT OF A
DRAINAGE EASEMENT SITUATED IN
SHADY CREEK ADDITION, PHASE 1,
AN ADDITION TO THE CITY OF KENNEDALE, TARRANT COUNTY, TEXAS

TO THE CITY OF KENNEDALE:
The undersigned hereby makes application for the vacation and abandonment of that
portion of the drainage easement situated in the above named addition, and particularly
described in Exhibits 'A' and'B', attached. In support of this application, the undersigned
represents, warrants and submits the following:
Attached as Exhibit 'A' is a metes and bounds description of that portion of
the drainage easement proposed for abandonment.
2. Attached as Exhibit'B' is a survey plat showing the legal description of the
property rights to be abandoned.
The following questions should be answered completely.
Why does the property owner wish to vacate this drainage easement?
This easement is to be vacated in return for granting a new drainage
easement elsewhere on Grantor's property.
2. How is this drainage easement currently being used?
This easement is currently used for conveyance of storm water from an
adjacent property. Storm water will be conveyed within the new drainage
easement mentioned in the above question 1 answer once proposed
improvements are completed.
3. How does the property owner propose to use the area of the drainage
easement, if vacated?
The area will be used as part of the property's rear yard.

EXHIBIT `A'
ABANDONMENT OF EASEMENT
Being all of a 10 feet wide Drainage Easement located in Lot 6 in Block 1 of
Shady Creek, Phase I, (Basis for bearings) as it appears upon the plat recorded
in Volume 388-170, Page 80, Plat Records of Tarrant County, Texas and
situated in the City of Kennedale, Tarrant County, Texas.
The said Drainage Easement shown on said Plat does not have bearings and
distances for the location, therefore an approximate location has been used.
Beginning at a point in the south line of said Lot 6, from which a'/z" iron rod found
for the southwest corner of Lot 6 bears S 88°15'59" W, 63.50 feet.
Thence N 53°35'30 E, 106.84 feet to the east line of said Lot 6.
Thence S 00°17'07" E, along the said east line of Lot 6, a distance of 6.13 feet to
a '/Z" iron rod found for corner.
Thence S 53°56'25" E, continuing along the said easterly line of Lot 6, a distance
of 5.19 feet.
Thence S 53°31'44" W, 90.34 feet to the said south line of Lot 6.
Thence S 88°15'59" W, along the said south line of Lot 6, a distance of 17.56 feet
to the place of beginning and containing 0.022 of an acre, more or less.
Surveyed in April 2006.
