BROADWAY ST. - COMMUNITY CENTER 7:30 PM Mayor Abbott called the meeting to order at 8:12 p.m. Members present were Mayor Abbott, Councilmen Wright, Mundy, Barrett, Boone and Kovach. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Linda Royster, Jerry Trammell, John LaPorte, David Geeslin and legal counsel, Wayne K. Olson. ITEM NO. 1 - Approval of minutes: Special Meeting - August 8, 1995 Public Hearing -August 10, 1995 Regular Meeting - August 10, 1995 Special Meeting - August 15, 1995 Special Meeting - August 17, 1995 Public Hearing -August 22, 1995 Special Meeting - August 22, 1995 Public Hearing -August 24, 1995 Special Meeting - August 24, 1995 Special Meeting - August 29, 1995 Special Meeting - August 31, 1995 Special Meeting - September 5, 1995 Public Hearing - September 7, 1995 Special Meeting - September 7, 1995 Councilman Mundy moved to approve the minutes as they were submitted, seconded by Councilman Kovach. Motion carried unanimously. ITEM NO. 2 - Action on Public Hearing - Approval of Ordinance No. 78 authorizing a zoning change to "OT" Old Town District. Councilman Kovach moved to approve Ordinance No. 78, Zone Case 95-03, authorizing a zoning change to "OT" Old Town District, seconded by Councilman Boone with none opposed. ITEM NO. 3 - Approval of Ordinance No. 75, authorizing a zoning change to "OT" Old Town District. Councilman Wright moved to approve Ordinance No. 75, Zone Case 95-01, authorizing a zoning change to "OT" Old Town District, seconded by Councilman Kovach. Motion carried with none opposed. ITEM NO. 4 - Approval of Ordinance No. 79, authorizing a transfer of cable service to Marcus Cable Associates, L.P. Councilman Kovach moved to approve Ordinance No. 79, authorizing a transfer of cable service to Marcus Cable Associates, L.P., seconded by Councilman Mundy. Motion carried unanimously. 2181 ITEM NO. 5 - Approval of Ordinance No. 80 annexing Tract 3H, W. H. Hudson Survey, Abstract 716. Councilman Kovach moved to approve Ordinance No. 80 annexing Tract 3H, W.H. Hudson Survey, Abstract 716, seconded by Councilman Barrett. Motion carried without opposition. ITEM NO. 6 - Approval of Ordinance No. 81 annexing Country Estates, Lots 1 through 14. Councilman Mundy moved to approve Ordinance No. 81 annexing Country Estates, Lots 1 through 14, seconded by Councilman Kovach. Motion carried unanimously. ITEM NO. 7 - Approval of Ordinance No. 82 adopting the Budget FY 95/96. Councilman Barrett moved to approve Ordinance No. 82 adopting the Budget for Fiscal Year 1995/96, seconded by Councilman Mundy. Councilman Barrett, Mundy and Boone voted aye, with Councilman Kovach and Wright opposed. Motion carried. ITEM NO. 8 - Approval of Ordinance No. 83 adopting the 1995 Tax Rate. Councilman Mundy moved to approve Ordinance No. 83 adopting the 1995 Tax Rate of $0.582525 per $100 of taxable value, seconded by Councilman Barrett. Motion carried with none opposed. ITEM NO. 9 - Approval of Ordinance No. 84 establishing new water and sewer rates. Councilman Barrett moved to approve Ordinance No. 84 establishing new water and sewer rates, seconded by Councilman Wright. Motion carried unanimously. ITEM NO. 10 - Approval of Contract No. 95-13 with Forensic Consultant Services. Councilman Barrett moved to approve Contract No. 95-13 with Forensic Consultant Services, seconded by Councilman Boone and motion carried with none opposed. ITEM NO. 11 - General Discussion. Ted Rowe advised that the State Highway Department requested that the water line be moved from Dick Price Road to Loop 820/I20 by March 1, 1996 for the highway expansion. In addition, the city's engineer has recommended the city go out for bids at the first of October in order to assure that the work is completed by the March 1st date. Councilman Boone thanked staff for their hard work and time put into the budget work shops over the last month. There being no further business, Mayor Abbott recessed the meeting at 8:25 p.m. Mayor Abbott reconvened into open session at 8:40 p.m. before entering into executive session at 8:41 p.m. 2182 EXECIITIVE SESSION ITEM NO. 12 - The City Council met in closed session to discuss advice about pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the City under the Texas Disciplinary Rules of the Professional conduct of the State Bar of Texas conflicts with the Texas Open Meetings Act, pursuant to Section 551.071, Texas Government Code. RECONVENE INTO OPEN 3ESSION Mayor Abbott reconvened into open session at 8:59 p.m. ITEM NO. 13 - Action on executive session, if necessary. No action was taken on this item.
