08/10/1995, Regular Meeting Minutes2165 MINUTES OF KENNEDALE CITY COUNCIL REGULAR MEETING - AUGUST 10, 1995 100 E. BROADWAY ST. - COMMUNITY CENTER 7:30 PM Mayor Abbott called the meeting to order at 7:36 p.m. Members present were Mayor Abbott, Councilmen Wright, Muncy, Barrett and Kovach. Councilman Boone was absent. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Linda Royster and legal counsel, Wayne K. Olson. ITEM NO. 1 - Approval of Minutes: Regular Meeting - July 13, 1995 Special Meeting - August 1, 1995 Special Meeting - August 3, 1995 Councilman Mundy moved to approve the minutes as they were submitted, seconded by Councilman Kovach. Motion carried unanimously. ITEM NO. 2 - Approval of Ordinance No. 7~ authorizing a zoning change to "OT" Old Town District. Councilman Kovach moved to approve Ordinance No. 76 authorizing a zone change to "OT" Old Town District, seconded by Councilman Barrett. Councilman Wright questioned if the property owners had submitted metes and bounds descriptions which related to Exhibits A through J and if Council should act until all exhibits had been submitted. Mr. Olson, legal counsel replied that all exhibits should be attached to the ordinance before Council acted. Councilman Kovach then withdrew his motion. Councilman Mundy moved to table Ordinance No. 75 until exhibits A through J describing the metes and bounds were provided, seconded by Councilman Wright. Motion carried unanimously. ITEM NO. 3 - Approval of Ordinance No. 76 authorizing a zoning change to "MH" Manufactured Housing. Councilman Mundy moved to approved Ordinance No. 76 authorizing a zoning change to "MH" Manufactured Housing, seconded by Councilman Barrett. Motion carried with no opposition. ITEM NO. 4 - Approval of Ordinance No. 77 authorizing an increase in Lone Star Gas Company's local gas rates. Mr. A.Z. Drones, area representative for Lone Star Gas recommended Council table this item until their special meeting scheduled August 17, 1995. Councilman Mundy moved to table this ordinance, seconded by Council Kovach. Motion carried without opposition. 2166 ITEM NO. 5 - Approval of Contract No. 95-10, Friends of the Library. Councilman Wright moved to approve Contract No. 95-10 with Friends of the Library, seconded by Councilman Barrett. Motion carried unanimously. ITEM NO. 6 - Approval of Contract No. 95-11, Tarrant County Health Department for Food Establishment Inspections. Councilman Barrett moved to approve Contract No. 95-11, Tarrant County Health Department for Food Establishment Inspections for the period of October 1, 1995 through September 30, 1996, seconded by Councilman Kovach. Motion carried without opposition. ITEM NO. 7 - Approval of Contract No. 95-12, Tarrant County for Ad Valorem Tax Collections for 1995. Councilman Kovach moved to approve Contract No. 95-12 with Tarrant County for Ad Valorem Tax Collections for 1995, seconded by Councilman Mundy and motion carried with no opposition. ITEM NO. 8 - General Discussion. Councilman Barrett inquired about an assessment fee for the library being placed on the city's water bill allowing the citizens to opt out if they decide not to donate. Mayor Abbott directed staff to review this option and see what surrounding cities were doing. Legal Counsel advised that the city must allow the citizens to opt out and would research this in more detail if the city advised. Mayor Abbott announced that the annual barbecue cook-off would be held in the city park August 25th and 26th benefiting the Kennedale Library and Chamber of Commerce. Mr. Rowe informed Council that work is progressing on the New Hope Bridge and is expected to be completed by the end of August, 1995. There being no further business, Mayor Abbott recessed the meeting at 7:50 p.m. Mayor Abbott reconvened into open session at 8:04 p.m. before entering into Executive Session at 8:05 p.m. EXECIITIVE SESSION The City Council met in closed session to discuss advice about pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the City under the Texas Disciplinary Rules of the Professional conduct of the State Bar of Texas conflicts with the Texas Open Meetings Act, pursuant to Section 551.071, Texas Government Code. ~, 2167 RECONVENE INTO OPEN SESSION Mayor Abbott reconvened into open session at 8:36 p.m. ITEM NO. 9 - Action on executive session, if necessary.
