04/13/1995, Regular Meeting Minutes2149 MINUTES OF KENNEDALE CITY COUNCIL REGULAR MEETING - APRIL 13, 1995 100 E. BROADWAY ST. - COMMUNITY CENTER Mayor Abbott called the meeting to order at 7:41 p.m. Members present were Mayor Abbott, Councilmen Wright, Mundy, Kirkpatrick, Boone and Kovach. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Michael Box, Mort Wetterling, and legal counsel, Wayne K. Olson. Councilman Mundy gave the invocation. ITEM NO. 1 - Approval of minutes: Special Meeting - March 9, 1995. Regular Meeting - March 9, 1995. Councilman Mundy moved to approve the minutes as they were submitted, seconded by Councilman Kovach. Motion carried unanimously. ITEM NO. 2 - Presentation of Proclamation to Chamber of Commerce. Mayor Abbott recommended that the City Council declare April 24 through April 28th Chamber of Commerce week and presented a Proclamation to Mr. Rusty Evans, President of the Chamber of Commerce. In addition, he said that it is the one organization that brings business, government and education together. Councilman Boone moved to approve the Proclamation, seconded by Councilman Kovach and motion carried with no opposition. ITEM NO. 3 - Consideration of a replat, Lot 1R, Block 24, Original Town of Kennedale, requested by First Baptist Church of Kennedale. Councilman Kovach moved to approve the replat of Lot 1R, Block 24, Original Town of Kennedale, seconded by Councilman Wright. Motion carried without opposition. ITEM NO. 4 - Approval of Contract 95-08, Interlocal Agreement with Fort Worth for Preparation and Shipment of Animal Heads Pursuant to Rabies Control Act. Mr. Wayne K. Olson commented that the Interlocal Agreement should contain language that payments should be paid out of current city funds. Mr. Olson noted that it does not include any language addressing this situation and should be included in next years agreement. Councilman Mundy moved to approve Contract 95-08, Interlocal Agreement with Fort Worth for Preparation and Shipment of Animal Heads Pursuant to Rabies Control Act, seconded by Councilman Kirkpatrick and motion carried unanimously. 2150 ITEM NO. 5 - General Discussion. Mr. Michael Box, Director of Development and Enforcement briefed council on the cleanup and stated this cleanup was far bigger than any that the city has had in the past. Next, Mr. Box stated that the top coat was spread over the bridge to hold it until the sidwalls are installed, all specs were met with state requirements, and there was some cost over run in the engineering requirements which may reflect in an over run on costs. If so, it will be brought before council for approval. Councilman Mundy questioned if there was an under run in other areas. Mr. Box replied yes in the box culvert but had to put back in for backfill because they had to go a little deeper and wider than anticipated. Mayor Abbott expressed a special "Thank you" for an excellent job well done to the street department, county employees and Commissioner VanRavenswaay's crew for the help provided to the City of Kennedale. Councilman Wright questioned the CDBG project and time limit. Mr. Box replied that by contract there is a 120 day completion time limit. Mr. Box said they are ahead of schedule and may be completed within three weeks. There being no further discussion, Mayor Abbott recessed the meeting at 7:55 p.m. Mayor Abbott reconvened into open session at 8:05 p.m. Mayor Abbott withdrew executive session from the agenda on the advise of legal counsel, Mr. Wayne K. Olson. ITEM NO. 6 - Action on executive session, if necessary. There was no action required on the item. There being no further discussion, Mayor Abbott entered into the workshop. Council discussed administrative fees as well as building related fees. There was a consensus that more information was required for review before any decisions could be made on increases, therefore this discussion will be continued at the next workshop which has not been established at this time.
