KENNEDALE CITY COUNCIL
PUBLIC HEARINGS - JANUARY 13, 1994

7:00 PM
Mayor Abbott called the meeting to order at 7:10 p.m.
Members present were Mayor Abbott, Mark Wright, Robert Mundy, Pete
Kirkpatrick, Tom Boone and Ron Kovach.
Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Joey
Highfill, David Geeslin and Analeslie Muncy, City Attorney.
Public Hearing No. 1 - To receive citizens comments regarding a proposed
zoning change from "AG" Agricultural to "R-3" Single Family Residential
District requested by Mr. Miller.
Mr. Miller was present and spoke in favor of the zoning change.
No other persons wished to speak for or against the zoning change.
Public Hearing No. 2 - To receive citizens comments regarding a proposed
zoning change from "AG" Agricultural to "R-2" Single Family Residential
District requested by DiSchiullo & Terry, Inc.
Mr. Gary Cooper, 211 Oak Ridge Trail is working with Mr. Roy Light,
owner of the property to develop a 47 acre tract on Little School Road.
Mr. Cooper replied 10 acre tracts will be developed at a time, and the
plans have been revised to show "R-1" Single Family Residential District
as requested by the planning and zoning commission.
Councilman Boone questioned Mr. Cooper if he had given any thought as to
what is going to happen to the properties that adjoin this development.
Mr. Cooper replied no but he would be more than willing to cooperate
with any of the land owners. Mr. Boone is concerned because this is a
large block of land and feels that there should be more city planning of
what the future development is going to be, and is looking for the
ultimate land use for this area. Mr. Cooper stated that their plan
meets the master land use plan requirements.
Councilman Kovach asked how many lots would be projected in the entire
47 acres. Mr. Cooper replied there would be 16 in the first phase and
reiterated that he was here tonight for a zoning change.
Mr. Roy Light owner of the property spoke in favor of the zoning change
and stated that he would be building quality homes and would be more
than willing to meet with the surrounding homeowners.
Mr. Rusty DiSchiullo with DiSchiullo & Terry, Inc. presented staff with
a revised plat of the area meeting the recommendation from the planning
and zoning commission. Mr. DiSchiullo replied he took into account
future streets and that there should be three entrances and exits to the
property.
There being no further discussion Mayor Abbott adjourned the hearing at
7:27 p.m.

Public Hearing No. 3 - To receive citizens comments regarding Community
Development Block Grant (CDBG) for the Twentieth year (1994).
Mr. Ted Rowe presented questionnaires to citizens for their input on
upcoming projects needed for the city and stated the funds are for low
to moderate income neighborhoods. He also briefed on previous CDBG
projects and the benefits from these funds.
No one wished to speak during the hearing.
Mayor Abbott closed hearing no. 3 at 7:31 p.m.
Mayor Abbott recessed for five minutes before going into the Regular
Meeting at 7:32 p.m.
Public Hearing No. 2 - (reopned at Councilman Boone's request.)
'pN~flEC At 7:45 p.m., Councilman Boone requested reopening Public Hearing No. 2
prior to the regular meeting.' Mr. Boone stated that he finds himself
FEbfI,URR~/ Ia~H1'4 living within 200 feet of the subject property and therefore, is
disallowing himself from the vote on this particular petition, but as a
citizen would like to address the council on his views at which time he
will then stay out in the audience until after the vote is taken or he
will excuse myself from the room.
Councilman Kovach also excused himself as he also resides with 200 feet
of the petition.
Mayor Abbott reopened public hearing no. 2 at 7:47 p.m.
Mr. Tom Boone, 908 Little School Road expressed his opinion on the
zoning request. Mr. Boone showed no opposition to homes being
developed, but would like for the city to do extensive planning to see
what is viable for that area of town. Mr. Boone iterated council
ascertained that area agricultural just over six months ago during the
zoning rewrite which does allow for homes. The people that live in the
area would like to see agricultural stay and warehouse the land until
such time that something can be done fantastic in the area. Therefore,
Mr. Boone, asked council to deny the zoning request and maintain
agricultural zoning until such time council can do extensive planning.
Mr. George Harrison, 936 Little School Road stated the land adjoins his
property and would like to see the property remain under agricultural
zoning.
Mayor Abbott questioned council if they should deny a zoning change just
because property owners have an idea of what they would like to see
their property as in the future.
Ms. Cynthia Morrison, 304 Bowles Court spoke in favor of the zoning
change request.
Mr. Gary Cooper stated it is customary for changes to come in when block
zoning is done. Mr. Cooper feels he is hearing the same arguments as to
when Shady Creek was developed and feels there is no better use for this
property than residential.
Councilman Wright questioned Mr. Boone on the fantastic development for
the area. Mr. Boone presented a book "Seaside" that he feels would be

great for this area. Mr. Boone said it is a community within itself on
small acres of land with planned development.
Councilman Kovach stated the planning and zoning commission made a
recommendation to council for "R-1" Single Family Residential District
and feels council should follow their recommendations.
There being no further discussion Mayor Abbott adjourned the public
hearings at 8:00 p.m.
