12/12/1996, Regular Meeting Minutes2272 MINUTES OF KENNEDALE CITY COUNCIL REGULAR MEETING - DECEMBER 12, 1996 100 E. BROADWAY ST. - COMMUNITY CENTER Mayor Mundy called the meeting to order at 7:34 p.m. Members present were Mayor Mundy, Councilmember's Wright, McCraw, Barrett, Boone and Kovach. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Linda Royster, Michael Box, and legal counsel, Wayne K. Olson. Councilmember Barrett gave the invocation. ITEM NO. 1 - Consideration of minutes: Council Workshop - October 23, 1996 Special Meeting - October 31, 1996 Regular Meeting - November 14, 1996 Councilmember Barrett moved to approve the minutes as corrected, seconded by Councilmember McCraw. Motion carried unanimously. ITEM NO. 2 - Consideration of Ordinance No. 121 authorizing zoning change 96-10 to "MH" Manufactured Home District for Lot 1, Block 1, Kim Addition, 501 South New Hope Rd. Mayor Mundy entered into executive session at 7:50 p.m. for discussion on item number two. Mayor Mundy reconvened into open session at 8:25 p.m. Councilmember Barrett moved to approve Ordinance No. 121 authorizing zoning change 96-10 to "MH" Manufactured Home District for Lot 1, Block 1, Kim Addition, seconded by Councilmember Boone. Motion did not carry. Councilmember Wright moved to table item number two, seconded by Councilmember McCraw with all members voting in favor. Mayor Mundy scheduled a special meeting for Monday, December 16, 1996, in reference to item number two. ITEM NO. 3 - Consideration of Ordinance No. 122 changing a portion of the corporate boundaries of the City of Kennedale to annex the access road for East Bound Interstate 20 between Business 287 to the West and Village Creek to the East. Councilmember Kovach moved to approve Ordinance No. 122 changing a portion of the corporate boundaries of the City of Kennnedale to annex the access road for East Bound Interstate 20 between Business 287 to the West and Village Creek to the East, seconded by Councilmember Barrett. Motion carried with no opposition. J 2273 ITEM NO. 4 - Consideration of Ordinance No. 123 adopting the 1996 NEC and Regional Amendments. Councilmember Boone moved to approve Ordinance No. 123 adopting the 1996 NEC and Regional Amendments, seconded by Councilmember Kovach. Motion carried unanimously. ITEM NO. 5 - Consideration to accept Petition for Annexation, for Clairemont Court located in the 800 block of Pennsylvania Avenue, requested by Mr. Daniel Ortiz. Councilmember Wright moved to accept the Petition for Annexation of Clairemont Court, requested by Mr. Daniel Ortiz, direct the City Secretary to prepare a Service Plan, Ordinance, and publish required notices, seconded by Councilmember Barrett. Motion carried with all members voting in favor. ITEM NO. 6 - General Discussion. Mayor Mundy spoke briefly on the annual Christmas Tree Lighting and wished all city staff a Merry Christmas. Next, Mayor Mundy talked about the budget process and requested this to be an item on the upcoming January agenda. Mr. Rowe invited all councilmembers to the Economic Development Corporation training that will be held on December 17th. Mr. Box stated that the trout release would be held on the 13th of January, 1997 and the City would receive approximately 2,500 fish. Mr. David Conroy, Chairman of the Planning & Zoning Commission, briefed council on some of the issues they are looking into for the upcoming year. There being no further discussion, Mayor Mundy entered into executive session at 9:00 p.m. ITEM NO. 7 - Executive Session. (A) The City Council met in closed session to discuss advice about pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas conflicts with the Texas Open Meetings Act, including discussion on any item posted on the agenda, pursuant to Section 551.071, Texas Government Code. 1) Fern McKinley v. City of Kennedale, Cause No. 17-159579-95. 2) Ken Pearce v. City of Kennedale, Cause No. 352-156704-94. 3) Michael C. Kerr v. City of Kennedale, Cause No. 4-96CV-474-Y [l 1 2274 (B) To deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee, pursuant to Section 551.074, Texas Government Code. 1) Consideration on renewal of employment contract for City Administrator. 2) Consideration on renewal of employment contract for Police Chief. Mayor Mundy reconvened into open session at 9:15 p.m. ITEM NO. 8 - Action of executive session, if necessary. Councilmember Kovach moved to approve the employment contracts for the City Administrator and Police Chief, seconded by Councilmember Boone. Motion carried with all members voting in favor.
