KENNEDALE CITY COUNCIL
PUBLIC HEARING - DECEMBER 12, 1996

Mayor Mundy called the public hearing to order at 7:30 p.m.
Members present were Mayor Mundy, Councilmember's Wright, McCraw,
Barrett, Boone and Kovach.
Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Linda
Royster, Michael Box, and legal counsel, Wayne K. Olson.
Public Hearing - To receive citizens comments regarding a zoning change
from "R-3" Single Family Residential District to "MH" Manufactured Home
District for Lot 1, Block 1, Kim Addition, located at 501 South New Hope
Road, requested by Mr. and Mrs. Perry McCreight.
Mr. Perry McCreight, who resides at 501 S. New Hope Road was present and
spoke before the Council requesting a zoning change for Manufactured
Housing. With this change, he said this would allow better living
conditions for himself, his wife, and two children.
In addition, Mr. McCreight said that he understood the concern that
everyone had of him wanting the manufactured housing zoning, but his
intentions were only for one double wide, and if there was any other way
he could do this, he would.
Mr. David Conroy, Chairman of the Planning and Zoning Commission, stated
that the Commission approved the zoning change request, but there were a
few conditions he would like Council to be aware of.
First, he advised that with the approval of the zoning change, any use
that complies with that change can go in without approval, and at
present, the only place you can put a mobile home is in a manufactured
home district.
Second, he pointed out that a large portion of the property was in the
floodway, and it is known that plotting of property is prohibited for
this type of area, so the possibility of a mobile home park in this
location would be prohibited.
Third, Mr. Conroy explained that this zoning change would be going in an
area that is primarily residential and agriculture, but once this type
of zoning is established, it opens the door for other types of similar
zoning requests which would be easily justified next to this property.
Last, he related the majority of people who testified at the public
hearing spoke in favor of the change as did most of the commission
members. The commission forwarded their recommendation to Council with
a split decision.
Councilman Wright questioned the aspect of spot zoning. Commissioner
Conroy replied that this particular area contains approximately 10 acres
and is not what he considers spot zoning.
Councilman Barrett inquired about the ..possibility of Mr. McCreight
subdividing his lot into acreage. Commissioner Conroy said if he was to
do that then the subdivision ordinance would come into play.

Councilmember Wright questioned the difference between a mobile home and
a manufactured home. Mr. Rowe replied that anything built before 1976
was a mobile home and after that time, they are referred to as
manufactured homes.
There being no further discussion, Mayor Mundy adjourned the public
hearing at 7:44 p.m.
