08/08/1996, Public Hearing Meeting Minutes2235 MINUTES OF KENNEDALE CITY COUNCIL PUBLIC HEARING - AUGUST 8, 1996 100 E. BROADWAY ST. - COMMUNITY CENTER Mayor Mundy called the public hearings to order at 7:33 p.m. 1 Members present were Mayor Mundy, Councilmember's Wright, McCraw, Barrett, Boone and Kovach. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Michael Box, and legal counsel, Wayne K. Olson. Mr. Brooks Gomara presented the invocation. Public Hearing No. 1 - To receive citizens comments regarding a proposed zoning change from "C-1" Restricted Commercial to "C-2" General Commercial for Tracts 1E, 1E1, and 3B of Cazanda Rose Survey, Abstract 1285. Mr. Bill Dahlstrom, representing the applicant Mr. Coy Quine, informed Council they were requesting a mix use development with a "C-2" Zoning Classification for Tracts 1E, 1E1, and 3B of the Cazanda Rose Survey. In with this request, they were seeking a 9,000 square foot retail building, mini warehouses, and another 7,000 square foot future retail. Mr. Dahlstrom said all access would be off of Highway 287 through the retail addition and would remain internal with an emergency access off of Chitwood which would be controlled with a crash gate. In addition, Mr. Dahlstrom said landscaping with red tip photenias would be placed along the backside of the building so the warehouses would not be visible and the visibility of the warehouses from Mansfield Highway would be blocked by the retail addition as well as by the present Southwestern Bell facility. Next, Mr. Dahlstrom presented Council with photos of other mini warehouse facilities that Mr. Quine had developed throughout the area, and stated that mini warehouses are built better and sturdier than before. He also expressed his intentions of building a tower within the area. Mr. Dahlstrom reviewed the city's master land use plan and stated that the area was designated as commercial, and that the warehouse use is designated as a commercial use. Therefore, Mr. Dahlstrom felt that this type of use was consistent with the city's future planning needs and goals. In closing, Mr. Dahlstrom addressed several issues raised by staff which included fire access, radius requirements for fire trucks, crime data, current number of mini warehouse facilities within the city at present, and what type of increased traffic would be generated during peak hours. In relation to the above, Mr. Dahlstrom iterated that the fire access was provided off of Chitwood with a crash gate and knox box for safety, required fire lanes would be provided, police reports reflected minimal activity within warehouse facilities, and the traffic generated during peak hours was minimal. Also, Mr. Dahlstrom provided council with a letter of support from Minyard's grocery store. 2236 Councilmember Kovach questioned the letter from Minyard's on the generation of traffic and how this would reflect a profit for Minyard's. Councilmember Kovach stated that if no additional traffic was generated then how could this benefit Minyard's. Mr. Dahlstrom stated that any traffic generated would be a benefit for Minyard's. Councilman Kovach questioned Mr. Dahlstrom on his intentions for retail and what type of retail facilities would locate within the facility. In addition, Mr. Kovach questioned if Mr. Dahlstrom was planning on the mini warehouse facility generating cash flow to facilitate the retail section of the development. Mr. Dahlstrom stated that he feels that both uses will develop together and that the mini warehouse will generate cash flow. Mr. Kovach reiterated that the emphasis was on the mini warehouse facility rather than the retail and that was why the request for "C2" came about. Before allowing citizen comments, Mayor Mundy stated that he had received only two sign-in sheets for the zoning change, three against the zoning change who did not wish to speak, and five against the zoning change who do wish to speak. Mr. Wayne Winters who resides at 215 South Village Street, Kennedale, Texas stated that he is in the commercial/real estate business and has been a commercial broker for 24 years, and in his 24 years this is only the second time that he has spoken in opposition of a zoning case. Mr. Winters stated that the Master Land Use Plan called for retail/service type of uses in this area, not industrial type of uses at this particular location. Next, Mr. Winters pointed out that this area was the heart of the city, center piece of our existing retail area, and future of what is left for retail development. He also noted that the City had purchased land across the street from the proposed development for a future city complex. In addition, he addressed the upcoming election to increase the sales tax to create economic revenue funds to develop growth, and replied if this is what type of services the city is encouraging, then the city is sending the wrong message. In closing, Mr. Winters specified that "C-2" General Commercial District is the highest use category the city has that allows for heavy industrial/manufacturing uses. If the city approves the zoning request, then the city will open the doors for all industrial/manufacturing uses, and this is not what the citizens intended to be across from our school district as well as city complexes. Mr. Steve Radakovich who resides at 731 East Mansfield Highway, Kennedale, Texas commented that he was not against storage places per say, but was against a storage place at this particular location. He feels that the city can do much better than allowing this type of use in the middle of old town. Then, Mr. Radakovich replied that he felt the city should place emphasis elsewhere, and that the only person who would gain from this type of use would be the owners only. In addition, he said it would create an eyesore for the community and urged the council to consider other type of uses that would be more beneficial to the city as a whole. 2237 In closure, Mr. Radakovich said there was plenty of storage places at the present time, and also addressed crime within storage areas. Mrs. Billie Terry, who resides at 412 Crestview Drive, Kennedale, Texas addressed council with a condemned building at 301 East Mansfield Highway that she owns and problems she has encountered with trying to fix it. Mayor Mundy advised Mrs. Terry that the public hearing was regarding a zoning change and that her subject could be addressed at another time. Mr. Roy Boenig who resides at 701 Shady Creek, Kennedale, Texas stated that he has not seen very many small towns with mini warehouses in the middle of town and felt that this was not a good idea to bring into the center of town. Secondly he stated there was plenty of industrial spaces for the placement of mini warehouses. Next, Mr. Boenig briefed on the past history of the mini warehouses located on Little School Road and said their original intent was to build commercial retail along with the mini warehouse facility, but for some reason the retail space has never been built. In closing, Mr. Boenig told council that if the zoning change was approved to make sure that the retail was built to coincide with the warehouses or there would be no recourse to see that they are built. Mr. John Berry who resides at 604 Hillside Drive, owner of property adjacent to this proposed facility at 311 3rd Street and 310 4th Street stated he was a strong supporter of quality businesses within Kennedale but was opposed to changing the zoning to "C-2" General Commercial District for the "showcase" of Kennedale. In addition Mr. Berry stated that this was the only opportunity to show off Kennedale with our future city hall and library possibly locating across from this location. Next, Mr. Berry commented that he visited with each storage warehouse and presented Council with figures relating to his visit. In his statement, Mr. Berry said Kennedale Self Storage reflected 176 units and has space for another 80 units and holds a ten percent (10~) vacancy and has never been full; Colonial Self Storage has 411 units with a rough twenty-five percent vacancy (25~), and has never been full, Storage Trust has 299 units with a ten percent vacancy (10~) and has never been full. He also stressed that there are currently 886 units in Kennedale that have never been full and by bringing this proposed amount on board the city would have one storage unit for every residential house within the city limits. In addition, Mr. Berry presented letters from two of the adjacent property owners at 312 4th Street (Bruce Johnson) and 313 3rd Street (Wayne Coyer) who voiced opposition against the proposed zoning change and mini warehouse development. Again, Mr. Berry strongly urged the Council to do the right thing and deny the zoning request. Once More, Mr. Dahlstrom addressed the concerns that the speakers spoke against and expressed that he felt this would be an overall improvement to the community as a whole. 2238 Councilmember Kovach stated that the plan and facility was nice and was presented well then preceded to question Mr. Dahlstrom if there were any other areas within the city he would look at, as well as, questioning what type of retail stores would locate within these facilities. Mr. Dahlstrom replied service type retails like Pro Cuts, H&R Block and State Farm, and indicated there would be no high intensity retail. There being no further discussion, Mayor Mundy closed public hearing number one at 7:25 p.m. Public Hearing No. 2 - To receive citizens comments regarding a proposed "PD" Planned Development District consisting of 25.1 acres known as Tracts 2B and 2B2A, WM E Haltom Survey, Abstract 1791. Mr. Bobby McCaslin, who is the applicant presented council with a layout of the proposed Rolling Acres Estate which will consist of 106 lots varying in size with the minimum lot being 6,0000 square foot and will have additional land dedicated for a park. Mr. Wayne Winters, who resides at 215 S. Village Street, Kennedale, Texas spoke in favor of Mr. McCaslin's development and encouraged council's approval of the project.
