07/11/1996, Public Hearing Meeting Minutes2228 MINUTES OF KENNEDALE CITY COUNCIL PUBLIC HEARINGS - JULY 11, 1996 100 E. BROADWAY ST. - COMMUNITY CENTER Mayor Mundy called the public hearings to order at 7:38 p.m. Members present were Mayor Mundy, Councilmember's Wright, McCraw, Barrett and Boone. Councilmember Kovach was absent. Staff present were Ted Rowe, Kathy Turner, Vicki Thompson, Michael Box, and legal counsel, Elizabeth Elam. Public Hearing No. 1 - To receive citizens comments regarding a proposed zoning change from "C-1" Restricted Commercial to "C-2" General Commercial for Tracts 1E, 1E1, and 3B of Cazanda Rose Survey, Abstract 1285. Mr. Coy Quine who petitioned the city for the zoning change was unable to attend this meeting, and sent a letter requesting that this public hearing and final action be rescheduled until the August 8, 1996, regular city council meeting. In addition, Mr. Quine stated he would pay for all expenses relating to the rescheduling of this event. No other persons signed in to speak for or against this hearing. Public Hearing No. 2 - To receive citizens comments regarding a proposed zoning change from "R-1" Single Family Residential to "C-2" General Commercial for Tract 31C, David Strickland Survey, Abstract 1376. No one signed in to speak for or against public hearing number two. Public Hearing No. 3 - To receive citizens comments regarding a proposed zoning change from "PD" Planned Development to "C2" General Commercial for Lot 1, Block 1, Dunlap Subdivision. No one signed in to speak for or against public hearing number three. Public Hearing No. 4 - To receive citizens comments regarding a proposed Ordinance amending Chapter 11, "Licenses, Taxation and Miscellaneous Business Regulations" of the Kennedale City Code (1991), as amended: providing for the Licensing of Sexually Oriented Business; providing different types of Sexually Oriented Businesses; providing for appeals; providing that this Ordinance shall be cumulative of all Ordinances; providing a severability clause; providing for publication in pamphlet form; providing for publication in the official newspaper as well as an effective date. Mr. Ted Rowe, City Administrator presented a map to Council showing potential sites for sexually oriented businesses within the city limits of Kennedale, as well as addressing the advantages/disadvantages of using 800 feet to 1,000 feet separation from conflicting uses. Mr. Michael Box, Director of Community Development and Enforcement reviewed several crime history studies relating to sexually oriented businesses that were conducted by other cities. The studies indicated that there was a need for control of such businesses within a city in order to protect adjoining uses within 1,000 feet of the sexually oriented businesses. 2229 No other persons signed in to speak for or against public hearing number four.
