O1944 ~ ~ . . ~. n . :~: ORDINANCE NO. 194 ~:~~`~ I r'~a s''~; _ ~_ ~~~~~ AN ORDINANCE OF THE CITY OF KENNEDALE AMENDING ORDINANCE NO. 153 TO INCREASE PARK DEDICATION REQUIREMENTS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on July 9, 1998, the city council of the City of Kennedale, Texas, adopted Ordinance No. 153, establishing requirements for neighborhood park land dedication or payment of cash in lieu of land; WHEREAS, the city council has determined that a larger dedication of land or cash in lieu of land is necessary upon the platting of residential subdivisions because of the impact on neighborhood park land and park improvements; and WHEREAS, the City Council has conducted a public hearing on the proposed regulations contained herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: SECTION 1. NEIGHBORHOOD PARK DEDICATION Section 1(a) of Ordinance No. 153 is hereby amended to read as follows: (a) Requirement: No final subdivision plat for any property zoned for residential use in the City of Kennedale shall be approved unless such plat shall include a dedication of land to the City of Kennedale for neighborhood park purposes. Such dedication shall be on the basis of one (1) acre of land per each 75 residential units on the plat, or the payment of cash in lieu thereof, as hereinafter provided. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Kennedale, Texas, (1991) as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and W:\Kennedale\ORDINANC\ParkDedicAmend.wpd (05/24/00) Page 1 such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall be in full force and effect from and after its passage, and it is so ordained.
