O221c or CITY OF KENNEDALE ORDINANCE N0.221 AN ORDINANCE FIXING AND LEVYING MUNICIPAL AD VALOREM TAXES FOR THE CITY OF KENNEDALE, TEXAS, FOR THE YEAR 2001, DIRECTING THE ASSESSMENT AND COLLECTION THEREOF; PROVIDING A SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE CLAUSE. BE IT, THEREFORE, ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,TEXAS: WHEREAS, the City of Kennedale, is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the Board of Aldermen has approved by a separate ordinance adopted on the 11th day of September, 2001, the budget for the fiscal year beginning October 1, 2001, and ending September 30, 2002; and WHEREAS, the City has complied with all statutory and constitutional requirements concerning the levying and assessing of ad valorem taxes. SECTION 1. For the current expense of the City of Kennedale and for the general improvements of the City and its property, there is hereby levied and ordered to be assessed and collected for the year of 2001 on all property situated within the corporate limits of the City limits of the City of Kennedale, and not exempt from taxation by valid laws, an ad valorem tax rate of $0.692500 cents on the One Hundred ($100.00) Dollars valuation of such property. $0.579841 For the purpose of maintenance and operation. $0.112659 For the purpose of interest and sinking. $0.692500 Total tax rate All monies collected and hereby appropriated are set apart for the specific purposes indicated and the funds shall be accounted for in such a manner as to readily show balance at any time. SECTION 2. That the taxes herein are levied according to law and shall be due and payable on October 1, 2001, and the same shall become delinquent on February 1, 2002. Should any taxpayer fail to make payment before the date of delinquency, the penalty as provided by law shall be assessed until the unpaid taxes and penalty have been satisfied. Taxes herein levied and uncollected as of January 1, 2002 shall be a first and prior lien against the property, which lien shall be superior and prior to all other liens. SECTION 3. Taxes are payable at the offices of Tarrant County Tax Assessor- Collector. The City shall have available all rights and remedies provided by law for the enforcement of the collection of taxes levied under this Ordinance. c:\citysec\council\ord\taxrate\(09-06-01) Page 1 SECTION 4. In the event any section, sub-section, clause, sentence, or phrase of this ordinance shall be declared or adjudged invalid or unconstitutional, such adjudication shall in no means affect any other section, sub-section, clause sentence, or phrase of this ordinance, but all the rest thereof shall be in full force and effect just as though the section, sub-section, sentence, clause or phrase so declared or adjudged invalid or unconstitutional was not originally a part thereof. SECTION 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
