O508A. • - • • • _ • - • - i A - 114 .. • WHEREAS, the City of Kennedale owns real property and various improvements thereto (commonly known as the Old Library Building) located at 201 New Hope Road in the City of Kennedale, which was previously used for a library; and WHEREAS, the City Council deems it prudent to sell and convey the real property and any improvements thereto, pursuant to a valid contract and subject to any restrictions contained within the contract; and WHEREAS, Chapter 253 of the Texas Local Government Code permits a municipality to sell land or an interest in land and any improvements thereto that it owns. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS, THAT: SECTION 1. The Mayor and /or City Manager is hereby directed and authorized to enter into a contract to sell and convey the property owned by the City of Kennedale, located at 201 New Hope Road (Old Library Building), such sale and conveyance to be subject to the terms and conditions set forth in the contract. SECTION 2. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.
