CALL TO ORDER Chair Lin Eason called the meeting to order at 7:10pm. Overview of Chapter 4 BUILDING AND BUILDING REGULATIONS, Article IX. Building Board of Appeals Development Services Director James Cowey gave a brief overview of the regulations of the board for the benefit of new board members and residents in attendance of the meeting. IV. Overview of Chapter 15 NUISANCES, Article II. Dangerous and Substandard Buildings James Cowey presented information on the specific purposes and intent of Article II, describing in detail the sections of the article, and all processes involved. V. Hold Public Hearings and consider Requests for Abatement of Substandard Buildings as listed below: A. Public Hearing and Action on CASE #BBA -11.01 for the Board to consider the substandard structure at 737 W Kennedale Pkwy, legal description, Triangle Business Park Addn Blk 1 Lot 9R owner as Anarkali Enterprises Inc. James Cowey and Glen Greenwood presented information on the property. 405 Municipal Drive, Kenneclale, TX 76060 1 Telephone: 817.985.2132 1 Fax: 817- 478 -7169 Chair Lin Eason opened the Public Hearing. Property owner Barkat Ali approached the board, stating that he has been unable to find a tenant to lease the property and therefore it has been vacant for several years. Mr. Ali expressed a desire for more time to complete several updates to the property to bring it up to code. • There were no other requests to speak during the public hearing. Chair Lin Eason closed the Public Hearing. A motion to give the property owner of 737 W Kennedale Parkway thirty days to bring the property up to code and to work with city staff to come up with a plan to fix structural problems, with the understanding that if these parameters are not met the case would be brought to the next level was made by Brian Cassady, second by Jeffrey Nevarez. The motion passed 4 -0. B. Public Hearing and Action on CASE #BBA -11 -02 for the Board to consider the substandard structure at 705 E Kennedale Pkwy, legal description, Boaz, Ca Subd of J B Renfro Blk 13 Lot 9R owner as Davidson, Dale K. James Cowey and Glen Greenwood presented information on the property, noting that the building was built as a residence and that zoning has since changed to commercial. Chair Lin Eason opened the Public Hearing. Property owner Dale Davidson approached the board, stating that he currently uses the property as a storage building and would like more time to explore his options and receive cost estimates. Y There were no other requests to speak during the public hearing. Chair Lin Eason closed the Public Hearing. A motion to allow the property owner thirty days to bring the building up to necessary standards or complete demolition himself with the understanding that if this cannot be achieved the case will be brought to the next level of the process was made by Jeffrey Nevarez, second by Brian Cassady. The motion passed 4 -0. C. Public Hearing and Action on CASE #BBA -11 -03 for the Board to consider the substandard structure at 6801 Oakcrest Drive E, Lot 2 legal description Oak Crest Meadows Mhp Pad 2 1984 Mh 14 x 68 owner as Wallace, Roxanna. 405 Municipal Drive, Kennedale, TX 76060 1 Telephone: 817.985.2132 1 Fax: 817 - 478 -7169 James Cowey and Glen Greenwood presented information on the property, noting that the structure is located in the floodway /floodplain and that the structure is not owner by the property owner. Public Hearing and Action on CASE #BBA -11 -04 for the Board to consider the substandard structure at 6801 Oakcrest Drive E Lot 9, legal description Oak Crest Meadows Mhp Pad 9 1985 Melody 14 x 52 Lb# Tex0163660 Melody owner as Hernandez, Josefina James Cowey and Code Enforcement Officer Glen Greenwood presented information on the property, noting that the structure is located in the floodway /floodplain and that the structure is not owner by the property owner. This structure is located on the same parcel as the property in question in case #BBA -11 -03 and is in considerable disrepair. Public Hearing and Action on CASE #BBA -11 -05 for the Board to consider the substandard structure at 6801 Oakcrest Dr E Lot 11, legal description Oak Crest Addn Block 1 Lot 39 owner as Archer, Barbara. James Cowey and Glen Greenwood presented information on the property, noting that the structure is located in the floodway /floodplain and that the structure is not owner by the property owner. This structure is located on the same parcel as the property in question in case #BBA -11 -03/04 and is in considerable disrepair. Public Hearing and Action on CASE #BBA -11 -06 for the Board to consider the substandard structure at 6801 Oakcrest Dr E Lot 18, legal description Oak Crest Meadows Mhp Pad 18 1977 K & B 14 x 56 Lb# Tex0086468 Wayside owner as Helton, William. James Cowey and Glen Greenwood presented information on the property, noting that the structure is located in the floodway /floodplain and that the structure is not owner by the property owner. This structure is located on the same parcel as the property in question in case #BBA -11- 03/04/05 and is in considerable disrepair. Chair Lin Eason opened the Public Hearing. • There were no requests to speak during the public hearing. Chair Lin Eason closed the Public Hearing. A motion to authorize the City of Kennedale to take action to demolish the structure in the next 30 days was made by Lana Sather, second by Brian Cassady. Motion passed 4 -0 G. Public Hearing and Action on CASE #BBA -11 -07 for the Board to consider the substandard structure at 904 Shady Oaks Dr, legal description Hilldale Addition - Kennedale Block 3 Lot 5 owner as De Larosa, Harvey. James Cowey and Glen Greenwood presented information on the property, noting that the structure experienced a garage fire in the past year. City staff has been in contact with the property owner, who has expressed interested in bringing the structure up to code. Chair Lin Eason opened the Public Hearing. • Property owner Harvery De LaRosa approached the board, explaining that due to a recent divorce the structure was left unattended for some time, but that he has been working with city staff to begin the cleanup process, as he intends to use it as his primary residence again in the near future. • There were no other requests to speak during the public hearing. Motion passed 4 -0 H. Public Hearing and Action on CASE #BBA -11 -08 for the Board to consider the substandard structure at 421 W 5th St, legal description Kennedale, City of Addition Blk 52 Lots 6 Thru 10 & E 18'11 1980 Oakmont 14 x 60 owner as Smitherman, Steve. James Cowey and Glen Greenwood presented information on the property, noting that the structure is in considerable disrepair and that city staff has been in acitve conversation with the owner. Chair Lin Eason opened the Public Hearing. e Property owner Steve Smitherman approached the board, stating that he intends to remove or demolish the mobile home as soon as possible. There were no other requests to speak during the public hearing. Chair Lin Eason closed the Public Hearing. A motion to allow the owner 30 days to bring the property up to code with the board revisiting the case at the point with proof from the owner that progress has been made was made by Brian Cassady, second by Jeffrey Nevarez. Motion passed 4 -0 Public Hearing and Action on CASE #BBA -11 -09 for the Board to consider the substandard structure at 400 North Rd, legal description Prickett, Jacob Survey A 1225 Tr 3 A owner as Casa Santa LP. Board member Nevarez noted that the structure has already been removed and that the property simply needs to be cleaned up to be complete. A motion to forgo the public hearing on case #BBA -11 -09 as it is no longer necessary due to changes with the structure and property was made by Jeffrey Nevarez second by Lana Sathers. The motion passed 4 -0. VI. ADJOURNMENT A motion to adjourn was made by Lana Sathers, second by Jeffrey Nevarez.
