BUILDING BOARD OF APPEALS
AUGUST 28, 2008

REGULAR MEETING - COUNCIL CHAMBERS - 6:00 PM
Chairman Eason called the meeting to order at 6:09 p.m.
Members present: Brian Cassady, Randall Swiney, Rick Trevino, and Lin Eason
Members absent: Todd Whatley
Staff Present: James E. Cowey, Building Official; Larry Hoover, Code Enforcement Officer;
Crystal Tort, Building Board of Appeals Secretary.
At the time of Roll Call Mr. Trevino was not present, but arrived at 6:23 p.m.
Approval of minutes for the regular meeting dated July 24, 2008.
The minutes were approved with a motion by Mr. Eason, seconded by Mr. Swiney.
Motion was passed unanimously. .
The Presiding Officer opened the meeting for review of the following cases:
II. Request for Abatement of Substandard Buildings
A. Public Hearing and Action -on CASE #BBA -08 -03 for the Board to consider the
substandard structures at 446 and 452 E. Kennedale Pkwy, legal description,
Boaz, Ca Subd of J B Renfro Lots 29 & 30, property owner John S. Hivale..
James E. Cowey explained to the Board that Staff failed to send the required Order
Notices. The Kennedale City code requires Notice of Order to be mailed to property
owner, filed with the city secretary, and be published in the newspaper within ten (10)
days after the order is issued. Therefore we are repeating these steps once again.
Mr. Cowey explained that debris is still on the property and presented current photos
to the Board. Mr. Cowey also explained that Mr. Hivale has not cleaned his property
with the ample time given to him, therefore the City will move forward with cleaning his
property.
Staff recommended the condemnation and clean up of the structures with the
understanding that the property owner has another thirty (30) days before Staff would
request Contractor to cleanup property.
BOARD DECISION: Mr. Cassady made a motion to order Condemnation and
Demolition of Structure, seconded by Mr. Swiney. Motion passed unanimously.
B. Public Hearing and Action on CASE #BBA -08 -06 for the Board to consider the
substandard main structure including the small trailer at 6800 Oak Crest Dr. W,
legal description, Oak Crest Addition Block 1 Lot 26, property owner Estate of
Adelle B. Davis.
James E. Cowey explained to the Board that Staff failed to send the required Order
Notices. The Kennedale City code requires Notice of Order to be mailed to property
owner, filed with the city secretary, and be published in the newspaper within ten (10)
days after the order is issued. Therefore we are repeating these steps once again.
Mr. Cowey explained that the property is still in bad condition and presented current
photos to the Board.
Staff recommended the condemnation and demolition of the structures with the
understanding that the property owner has another thirty (30) days before Staff would
demolish and clean the property.
BOARD DECISION: Mr. Eason made a motion to order Condemnation and
Demolition of Structure, seconded by Mr. Cassady. Motion passed unanimously.
III. Staff report on demolition of the following structures:
A. CASE #BBA -08 -02 -- 5428 High Ridge Road
B. CASE #BBA -08 -05 -- 6733 Oak Crest Drive West
C. CASE #BBA -08 -07 -- 6817 Oak Crest Drive West
D. CASE #BBA -08 -08 -- 6821 Oak Crest Drive West
Mr. Cowey presented current photos showing the above properties after demolition
and cleanup and briefly described each case.
Larry Hoover gave a staff update on City Projects and informed the Board that
Pennsylvania has been stalled due to Atmos Gas. Mr. Hoover also notified the Board
that the construction of Oakcrest Sewer Line has commenced and explained that the
surveying has begun on Bowman Springs Road.
James E. Cowey also informed the Board of the Dedication for Town Center will be
held on November 8, 2008.
IV. Adjournment'
Mr. Cassady made a motion to adjourn the meeting, seconded by Mr. Eason.
Motion was passed without opposition.
Mr. Eason adjourned the meeting at 6:44 p.m.
