EXECUTIVE SESSION The BOA will meet in closed session pursuant to Section 551.071 of the Texas Government Code for consultation with the City Attorney pertaining to any matter in which the duty of the City Attorney under the Texas Disciplinary Rules of Professional Conduct may conflict with the Open Meeting Act, including discussion of any item posted on the agenda and legal issues regarding amortization of nonconforming uses; and litigation, settlement offers, and /or claims regarding the follow matters: a. Orientation of New Members b. Compliance of Business 287 District Overlay c. Non - Compliance Issues B. RECONVENE INTO CHAMBERS Reconvene into chambers for regular session and consider action, if any, on items discussed in Executive Session. C. PUBLIC HEARING 1) BOA 05 -27 to receive citizen's comments for a Variance to the City Code Section 17 -405 (d) 0) to allow an encroachment of 4 feet into the side yard setback at 1114 Kennedale Sublett. Legal description is Block Lot 5R of the J M Estes Home Tracts Addition in the City of Kennedale, Tarrant County, Texas as requested by Herb Snedeker, D. VISITORS /CITIZENS FORUM At this time, any person with business before the Board of Adjustment not scheduled on the Agenda may speak to the Commission, provided that a "Speaker's Request Form" has been completed and submitted to the Board of Adjustment Secretary prior to the start of the meeting. All comments must be directed towards the Chairman, rather than individual BOA members or staff. All speakers must limit their comments to the subject matter as listed on the "Speaker's Request Form." No formal action can be taken on these items. E. REGULAR ITEMS 1) Approval of Minutes dated October 4, 2005. 2) BOA 05 -27 to consider approval of a Variance to the City Code Section 17 -405 (d) 0) to allow an encroachment of 4 feet into the side yard setback at 1114 Kennedale Sublett. Legal description is Block Lot 5R of the J M Estes Home Tracts Addition in the City of Kennedale, Tarrant County, Texas as requested by Herb Snedeker. 3) BOA 05 -25 to consider approval for a Variance to the City Code under Section 17 -405 (d) to reduce the required front yard setback by 10 feet from a 50 foot setback to a 40 foot setback at 1218 Hunters Haven Drive. Legal Description is Lot 8, Block 6 of Falcon Wood Estates in the City of Kennedale, Tarrant County, Texas as requested by Keith and Kathy Schneider. 4) BOA 05 -26 to consider approval for a Variance to the City Code under Section 17 -421 (a) to reduce the amount of parking spaces required by this ordinance due to TxDOT "taking" his parking spaces at 205 E Kennedale Parkway. Legal Description is Block Lot 1 R2 of the H R Clarks Sub - division in the City of Kennedale, Tarrant County, Texas as requested by Troy Anderson. F.
