Cirmo City Secretary/Communications Coordinator (817) 985 - 2104 acirmo @cityofkennedale.com For Release - Thursday, May 19, 2011 Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item No: I_A Subject: Comprehensive Land Use Plan update Originated by: Rachel Roberts, Planner City staff and the consultant are reviewing input from citizens, existing conditions within the city, and previous planning efforts to develop a series of potential growth scenarios for Kennedale and possible tools to use to guide future growth within the community. A meeting with the Comprehensive Plan Advisory Committee will be scheduled for late May / early June to review these scenarios and strategies and decide which direction to take for the completion of the future land use plan and thoroughfare plan. Staff Report to the Members of the Planning & Zoning Commission Date: May 9, 2011 Agenda Item No: I -B Subject: Outdoor display regulations Originated by: Rachel Roberts, Planner I made the changes to the proposed ordinance requested by the Commission during the April meeting and am presenting the revisions under this agenda item for your review, prior to consideration under public hearing, below. Because I was not at the April meeting, I wanted to provide you an opportunity to review the changes, in case they are not quite what you wanted. Changes made: • Add farmer's markets as a use exempted from the outdoor display regulations proposed under Section 12 -4(c) and the definition of outdoor display to be provided under Section 17 -431. • Add language from Section 12 -4(c) to the definition of outdoor display provided under Section 17 -431. • Remove salvage yards from the exemptions provided under the definition of outdoor display in Section 17 -431. Staff Report to the Members of the Planning & Zoning Commission Date: May 9, 2011 Agenda Item No: I -C Subject: Noise (nuisance) regulations Originated by: Rachel Roberts, Planner I am reviewing Portland's noise regulations, along with noise regulations from cities in the Dallas /Fort Worth area and plan to bring recommendations to you within the next few months. The kind of changes proposed by the Commission will be very useful in making existing regulations clearer and easier to enforce. They are rather wide in scope, though, and drafting recommended changes so that they fit the city's needs and are consistent with the city's other regulations may take some time. We will move forward as quickly as possible. Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item No: I -D Subject: Oil and gas ordinance Originated by: Rachel Roberts, Planner * *The Commission did not have time to discuss this item during the April meeting. The report for the April meeting is reprinted below. ** During the April BOA meeting, the Board expressed concern about how the code revisions provided for an exception to the habitable structure waiver requirement. The revisions provided a special exception process, but special exceptions apply to land uses, and the waiver issues is about the process of applying for a drilling permit, and does not really concern a land use. BOA would prefer a different means of providing for an exception to the waiver requirement. We are working on revisions to this section and plan to have more information to you in the coming months. We will also research whether other cities have a limit to how many wells may be drilled on a particular pad site or if they set a maximum time frame for drilling activity (for example, no more than 2 years). After we have collected enough information and prepared a report for the Commission to review, we recommend the Commission present the report to city council to ask for direction from the council. Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item Number: I -E Subject: Form -based codes Originated by: Rachel Roberts, Planner "The Commission did not have time to discuss this item during the April meeting. The report for the April meeting is reprinted below." The Commission requested this item be placed on the work session agenda. As the fiscal year draws to a close, we will know whether we have funding available to invite an expert to train board members and council members about form -based codes (what they are and how to implement them). Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item No: I -F Subject: Bowman Springs and Little Road Originated by: Rachel Roberts, Planner * *The Commission did not have time to discuss this item during the April meeting. The report for the April meeting is reprinted below. ** The Commission asked this item to be placed on the work session agenda. Our engineers have provided a draft of the revised zoning map showing the new roads. We have included a section of the map with this report for your reference to help with your discussions. Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item No: I -G Subject: Overlay District Zoning Originated by: Rachel Roberts, Planner * *The Commission did not have_time to discuss this item during the April meeting. The report for the April meeting is reprinted below. ** The Commission asked staff to place this item on the work session agenda. If time permits during the work session, staff requests Commission members to describe their concerns on this issue so we may prepare a report for your review. Staff Report to the Members of the Planning & Zoning Commission Date: May 11, 2011 Agenda Item No: 1 -H Subject: Incompatible zoning districts and properties Originated by: Rachel Roberts, Planner * *The Commission did not have time to discuss this item during the April meeting. Staff Report to the Members of the Planning & Zoning Commission Date: May 12, 2011 Agenda Item No: I J Subject: List of Items for Future Consideration Originated by: Rachel Roberts, Planner In addition to the items listed below, the Commission may add items to the list for future discussion. Commission members may discuss each item in order to determine how to direct staff to bring it to the Commission as a future action item, but no action may be taken at this time. a. Alcohol Ordinance b. Green / Environmental Regulations C. Storm Water Ordinances and Creek Ordinances d. Salvage Yard Ordinance Staff Report to the Members of the Planning & Zoning Commission Date: May 9, 2011 Agenda Item No: III Subject: Case PZ 11 -06, to review and consider action on an ordinance amending outdoor display regulations Originated by: Rachel Roberts, Planner The Planning & Zoning Commission has been working for some time to clarify and strengthen the city's regulations governing outdoor display. Sections 4 -226 and 4 -227 were adopted last year, and the code revisions proposed under this agenda item will further clarify the city's regulations on how merchandise should be (and should not be) displayed outdoors. The proposed changes would permit only one item to be displayed at a time and the item must clearly be indicated as a display item, for example, it must be removed from its original packaging. Exceptions from some the new regulations would be provided for automobile sales or industrial equipment of comparable size or larger, farmer's markets, feed stores, and plant nurseries.
