The commission discussed the options and asked staff to make several changes to what they had presented. We have made the changes and included them with this report. The amendments are summarized as follows: • Added language about sign material • Specified that only one sandwich board sign may be used per tenant • Clarified that digital signs were not allowed If you have any questions about the amendments, please let me know. Proposed Amendments to the City of Kennedale Sign Ordinance Sec. 17 -514. - Prohibited signs. In addition to signs not specifically described or allowed in this article the following signs are specifically prohibited. (7) Portable signs, with the exception of sandwich board signs which comply with the regulations set forth in section 17 -516. (a.) Digital sandwich board signs are prohibited. (b.) Signs with swinging frames, permanent vinyl lettering or numbering, or reader boards with tracks for changeable letters and numbers, or three dimensional letters and numbers are prohibited. Staff Report to the Members of the Planning & Zoning Commission Date: September 8, 2010 Work Session Agenda Item No: I I -C Subject: Guarantees and Maintenance Bonds for Subdivisions Originated by: Rachel Roberts, Planner The commission asked staff to bring this item to public hearing this month, but when we looked at the calendar, we realized we'd be out of town when it went before the council, and therefore we would not be there to present the case. We plan to bring it to public hearing before the commission for the October meeting. We have made the changes to the amendments requested by the commission, and we also added a definition for "built" so that it is clear to future city staff and developers what will be required. Proposed Amendments to the City of Kennedale Maintenance Bond Requirements for Subdivisions [from Chapter 17 of the city code] Sec. 17 -250. Maintenance bond requirements. The developer's contractor shall be required to file a maintenance bond with the director of development and enforcement, prior to beginning construction by the city, in an amount and form satisfactory to the public works director, in order to assure the satisfactory condition of the required improvements for a period of two (2) years after the date of their acceptance by the city. (1) Extension of maintenance bond requirement. At the end of the two -year period, the City will inspect the improvements and the maintenance bond shall be extended if: a. the lots are not fifty (50) percent built or, b. construction, materials, or workmanship of the improvements is deemed unacceptable by the public works director A maintenance bond may be extended if the lots are not seventy (70) percent built, as determined by the director of public works. A maintenance bond may be renewed for an additional two (2) years until all improvements are deemed acceptable by the City or until the minimum build -out requirement is met. ,(2) Reduction in maintenance bond coverage. At the discretion of the public works director, the amount of coverage for maintenance bonds may be reduced based on the percentage of lots built at the end of the initial two (2) year period. The maintenance bond may be reduced to an amount equal to fifty (50) percent of the cost of the construction of any public improvements (and /or private improvements being constructed in lieu thereof) if more than fifty (50) percent of the lots are built after the initial two (2) year period covered by the maintenance bond. If, after the first extension, the minimum build -out requirement is not yet met, the maintenance bond may be renewed on an annual basis not exceeding an additional two (2) years. (3) Definitions. For the purposes of this section, a lot shall be considered "built" if the required public improvements have been made and accepted by the city and if a permanent, rp imary structure has permitted, constructed, and passed a final inspection to city standards. Sec. 17 -248. - City - developer agreements. (c) Bonds; escrow agreement. Whenever public improvements (or private improvements in lieu thereof) are to be constructed in connection with the subdivision, the developer shall submit the following bonds to the city, executed by a surety company holding a license to do business in the State of Texas and in a form acceptable to the city: (3) Maintenance bond. Prior to acceptance by the city of any improvements, a maintenance bond will be furnished in an amount equal to the cost of the construction of any public improvements (and /or private improvements being constructed in lieu thereof) insuring the repair and replacement of all defects due to faulty materials or workmanship that occur within a period of two (2) years from the date of acceptance of the improvements by the city. At the end of this period, maintenance bonds may be renewed in the event that construction, materials, or workmanship are deemed substandard or if a certain percentage of lots have not vet been built upon. (Refer to Section 17.250.) Sec. 17 -251. - Public works construction permit required. Construction shall not start on any street, sidewalk, drainage, utility or public improvement until a public works construction permit and an acceptable two -year maintenance bond has been issued for all facilities in the subdivision or the approved phase of the said subdivision. (Provisions regarding maintenance bonds requirements are set forth in Section 17.250. Staff Re to the Members of the Planning & Zoning Commission Date: September 7, 2010 Work Session Agenda Item No: I -D Subject: Comprehensive Plan update Originated by: Rachel Roberts, Planner We submitted a grant application to the Department of Housing and Urban Development for funding to pay for most of the costs of the comprehensive plan update. The grant recipients have not yet been announced, and it isn't clear from the grant announcement when recipients will be selected. We know that recipients will not be announced before September 15 but we don't know how long we will have to wait to find out if we were awarded a grant. Staff Report to the Members of the Planning & Zoning Commission Date: I September 8, 2010 Work Session Agenda Item No.: I I -E Subject: I Regulations concerning sales of alcohol / alcoholic beverages Originated by: I Rachel Roberts, Planner We are still researching options for this agenda item. The adopted ordinance will need to address hours in which sales are allowed, distance requirements (from churches, schools, hospitals, day care facilities, and any other protected use as determined by the Texas Alcoholic Beverage Code), and in which areas of town sales would be permitted. We have a copy of the Texas Alcoholic Beverage Code, which spells out what local governments are allowed to regulate, and we are comparing ordinances in cities in the region to see how they address this issue. We will more information for you at the meeting. During the August meeting, the question arose of how certain sections of the town came to be wet. If I've understood the Alcoholic Beverage Code correctly, wet and dry areas were established by precinct, and that status remains in effect until another local election.
