Summary:
The Commission did not have time to discuss this item during the past few meetings. For
your reference, the staff report from the March meeting is provided below.
March 8, 2010 Staff Report
The broker I've been speaking with offers two alternatives to a two -year maintenance
bond. (1) We could reauire a subdivision bond in addition to the maintenan bond Mr.
Zinecker recommends requiring the developer to escrow funds, stating that "the surety will
like this anyway, if not require it." He added that the surety will probably want to issue the
maintenance bond when the improvements are accepted by the city, rather than waiting for
the two -year time period to start at an uncertain point in the future (at a certain percent build -
out). (2) Consider requiring or accepting a letter of credit instead of the maintenance bond
Because subdivision bonds may be difficult to obtain in Texas due to the limited
number of companies that offer them, if the Commission recommends to Council requiring
subdivision bonds in addition to maintenance bonds, I recommend allowing the developer to
provide a letter of credit instead, if he or she is unable to secure a subdivision bond.
I asked Mr. Zinecker about whether maintenance bonds could be issued for one year
and then renewed in a lesser amount so that developers could have the option of reducing
the bond amount as a subdivision is built out. Here is his response:

If the choice is between a maintenance period in excess of two years and an
annually renewable maintenance period, I believe all sureties would choose the
annually renewable option. Two things: first, I do not know what charge they would
make, so it might be relatively expensive and second, the renewal would have to
be at the surety's option and nonrenewal shall not constitute an event of default.

Background and Overview of site.
This property is the site of gas well drilling and
minor agricultural operations; it was recently
rezoned to Agricultural zoning. Part of this
property was originally intended to be included in
the Steeplechase subdivision and was never
completed. The property abuts a public street and
is served by city water and sewer lines. The
proposed plat meets the minimum lot size for the
zoning district.
Plat drawing and other requirements.
We reviewed the plat for compliance with the
comprehensive land use plan, future land use plan,
and thoroughfare plan and did not find a conflict.
However, there are several corrections that should
be made to the plat drawing before it should be
approved. For example, the plat should dedicate a
drainage easement along the length and width of the
floodplain, and it should show existing lot lines to
be removed.
Road / secondary access to Steeplechase subdivision
Because the last phase of Steeplechase directly
affecting this property was never built, Coker
Valley Drive and Steeplechase Trail are dead end
streets. Secondary access to the subdivision is an
ongoing concern for residents of Steeplechase and
city staff. During the public hearing to rezone this
property at the March 2010 city council meeting,
the property owner (and replat/final plat applicant)
indicated that he would be give a right -of -way to
the city for the extension of Coker Valley Drive if
the City could extend the roadway without going
through the middle of the property.
Although an extension of Coker Valley may not be
possible without going through the middle of the
property, two other options for secondary access
are possible. There are two sections of
Steeplechase. The section branching off of
Steeplechase Trail could have access by extending
Glenview south and to the west toward an eventual
connection with Glaze Lane; although connecting
the road to Glaze Lane would require the city to
obtain right -of -way from other property owners
between the subject property and Glaze, this
connection would allow secondary access without a
significant loss of land on the subject property.
The section of Steeplechase branching off Coker
Valley could gain secondary access by connecting
Glenbrook to Joplin. This connection could run
along the north eastside of the subject property.
We've discussed these options with the property
owner, and he is amenable to allowing access from
Glenbrook and Glenview [VERIFY]
Corrections required for plat drawing.
■ Owners of record for neighboring property should be noted (some owner names
are shown but some are missing)
■ Zoning for subject property and for neighboring properties should be noted
■ Drainage easement along floodplain should be shown, as was done for the nearby
and adjacent Falcon Wood and Steeplechase subdivisions
■ Right -of -way dedications, as described above, should be shown
■ Existing property lines should be shown
Recommendations.
By city code, after you have reviewed the plat, the Commission may make one of
the following recommendations to city council:
• Approve the plat as presented;
• Approve the plat with conditions; or
• Disapprove the plat.
Staff recommends that the Commission recommend approval of the final plat
and replat with the following conditions:
(1) that the plat drawing to be corrected to meet the requirements for plat
drawings as described in the city code
(2) that the applicant dedicate rights -of -way for public secondary access
to the Steeplechase subdivision, with the understanding that the location
and size of the dedication will be negotiated between the city and the
applicant before the city council public hearing on this case.
The city council will hold a public hearing on this case on July 8, 2010.

Background and Overview of property.
The subject property is composed of ten (10) unplatted lots. The properties are
zoned C -2 and Planned Development and Industrial; the zoning would not change with
platting. The subject property has access to the I -20 frontage road and to Gilman Road,
and an access easement along the west side of the property providing access to the lot
immediately south of the property. The property has access to an existing 10" water line
across Gilman to the south. The property is not connected to sewer but should dedicate
easements for connection to city sewer lines.
Plat drawing and Other Requirements.
Staff reviewed the plat in terms of compliance with the comprehensive land use
plan, future land use plan, and thoroughfare plan and did not find a conflict. However,
there are several corrections that should be made to the plat drawing before it should be
approved. For example, an existing building is located on the subject property; the owner
has indicated that this building remain after the property is platted. If it encroaches on
setback lines, the structure will be nonconforming. The applicant should show the
existing building on the plat.
Plat drawings should show the width of all existing and proposed public street
rights -of -way and be consistent with the minimum requirements contained in the design
manual and the master thoroughfare plan. The right -of -way for Gilman is not shown and
should be added; in addition, the city plans to build a public road along the easement to
the Rebar addition, shown on the west site of property, if the necessary right -of -way can
be acquired from the neighboring property owner. Right -of -way required for this road
should be depicted, as well.
Other than the corrections needed to bring the plat drawing into compliance with
city code requirements, staff has no objection to approval of this plat request.

CASE # PZ 10 -05 to consider and receive comments regarding a request
for a re -plat and final plat of approximately 45.696 acres located 1257,
1301, and 1409 Swiney Hiett Road, an unaddressed property on N Joplin
Rd, and an unaddressed property on Coker Valley Dr, as requested by
Bowerman Oil and Gas. The legal descriptions are Ben Jopling Survey A
866 Tract 3B, James R Hawkins Survey A 792 Tract 1B, and Swiney
Subdivision Lot 6A, Lot 4 less SW corner, and W Pt 5, City of Kennedale,
Tarrant County, Texas.
Background and Overview of site.
This property is the site of gas well drilling and planned minor agricultural
operations; it was recently rezoned to Agricultural zoning. Part of this property was
originally intended to be included in the Steeplechase subdivision and was never
completed. The property abuts a public street and is served by city water and sewer lines.
The proposed plat meets the minimum lot size for the zoning district.
Plat drawing and other requirements.
Staff reviewed the plat in terms of compliance with the comprehensive land use
plan, future land use plan, and thoroughfare plan and did not find a conflict. However,
there are several corrections that should be made to the plat drawing before it should be
approved. For example, the plat should dedicate a drainage easement along the length
and width of the floodplain, and it should show existing lot lines to be removed. We are
working with the applicant to have these corrections made to the plat drawing before the
council meeting.
Road / secondary access to Steeplechase subdivision
Because the last phase of Steeplechase directly affecting this property was never
built, Coker Valley Drive and Steeplechase Trail are dead end streets. Secondary access
to the subdivision is an ongoing concern for residents of Steeplechase and city staff.
During the public hearing to rezone this property at the March 2010 city council meeting,
the property owner (and replat /final plat applicant) indicated that he would be willing to
give a right -of -way to the city for the extension of Coker Valley Drive if the city could
extend the roadway without going through the middle of the property.
An extension of Coker Valley may not be possible without going through the
middle of the property, but two other options for secondary access are possible. There
are two sections of Steeplechase. The section branching off of Steeplechase Trail could
have access by extending Cross Creek south and to the west toward an eventual
connection with Glaze Lane. Although connecting the road to Glaze Lane would require
the city to obtain right -of -way from other properly owners between the subject property
and Glaze, this connection would allow secondary access without a significant loss of
land on the subject property. The section of Steeplechase branching off Coker Valley
could gain secondary access by connecting Glenbrook to Joplin. This connection could
run along the north east side of the subject property. The city would like to pursue both
options so that both parts of the subdivision would have secondary access.
City staff asked the Planning & Zoning Commission to include conditions with its
approval, if it approved the plat; the requested conditions were (1) that the plat drawing
be corrected to be consistent with what is required by city code and (2) that the property
owner be asked to make the right -of -way dedication(s) as part of this plat, with the exact
location and dimensions of the right -of -way to be established later. We are still working
on the location and dimensions of the right -of -way and plan to have a correct drawing to
council before the meeting on Thursday. In the meantime, we have included a copy of
the originally submitted plat drawing in the council packet for your review.
Corrections required for plat drawing.
■ Owners of record for neighboring property should be noted (some owner names
are shown but some are missing)
■ Zoning for subject property and for neighboring properties should be noted
■ Drainage easement along floodplain should be shown, as was done for the nearby
and adjacent Falcon Wood and Steeplechase subdivisions
■ Right -of -way dedications, as described above, should be shown
■ Existing property lines should be shown
Past Action.
The Planning & Zoning Commission held a public hearing on this case during its
meeting on June 17, 2010 and recommended approval with the conditions recommended
by staff.
