RESOLUTION 6
ESTABLISHING 28 DAY WORK PERIOD FOR FIRE AND AMBULANCE
PERSONNEL; ADOPTION OF SECTION 7(K) OF THE FAIR LABOR
STANDARDS ACT; AND ESTABLISHED CRITERIA FOR PAY, VACATION
TIME, SICK TIME, AND HOLIDAYS.
WHEREAS
the City of Kennedale desires to
establish a 28 day work period for
fire and ambulance personnel,
effective on February 1, 1992, and,
WHEREAS
the establishment of three (3)
shifts, to be referred to as A, B,
and C shifts, will provide the most
effective use of available
personnel, and
WHEREAS
it is reasonable and desirable to
adjust pay scales, vacation time,
and sick time accrual to maintain
parity with other City employees,
and
WHEREAS
the adoption of section 7(k) of the
Fair Labor Standards Act will govern
the fire and ambulance service only,
now then,
THEREFORE, BE IT RESOLVED that the City of Kennedale hereby adopts
the provisions of the Fair Labor Standards Act, Section 7(k) for
fire and ambulance personnel and establishes the following
criteria:
1. The City has adopted Section 7(k) of the FLSA
establishing twenty -eight (28) day work period
computational method for Fire and Ambulance personnel;
and
2. The rate of pay will be computed based on 2,756 annual
hours per year divided by the annual salary.
3. As provided in Section 7(k), the City shall pay Fire
and Ambulance non - exempt personnel one half (1/2) the
regular rate of pay as allowed for all hours worked in
excess of 212 hours in a twenty -eight day tour of duty
and cease the granting of compensatory leave except as
permitted by FLSA;
4. The City shall establish a bi- weekly pay period for
Fire and Ambulance personnel. Pay periods will end on
Wednesday and paychecks issued on Friday of the same
week.
5. Vacation time will be accrued at the following rates:

6. Sick time will be accrued as follows:
69.52 per year -- 5.79 accrued monthly
7. The following holidays will be observed:
New Years Day
Good Friday
Memorial Day
Independence Day
Labor Day
Thanksgiving Day
Friday following Thanksgiving Day
Christmas Eve
Christmas Day
Presidents Day
Fire and ambulance personnel scheduled to work these
holidays will be allowed additional time off equivalent
to the hours worked on any respective holiday or paid 1/2
time for the hours work on any respective holiday at the
discretion of the Fire Chief.
ex: if employee worked seven (7) hours from midnight to
7am on an official City holiday, he /she will accrue 7
hours of holiday time to be granted at a later date, or
paid 1/2 time for those hours actually worked on the
holiday. If an employee reports to work at 7am of a
holiday and remains on duty through midnight of that
holiday, he /she will receive 17 hours of accrued holiday
time off, or paid 1/2 time for the actual hours worked.
8. For employees converting from seven (7) day work
periods to twenty-eight (28) day work periods any
existing time accrued will be adjusted in such a manner
as to be equivalent to the recorded accrual.
