R18CITY OF KENNEDALE RESOLUTION NO. 18 A RESOLUTION RATIFYING THE MAYOR'S ACTION IN SUBMITTING AN APPLICATION TO THE FEDERAL COMMUNICATIONS COMMISSION FOR CERTIFICATION OF THE CITY TO REGULATE CABLE RATES FOR BASIC SERVICE AND FILING A REQUEST THAT THE FCC REGULATE NON -BASIC TIER RATES; AND PROVIDING AN EFFECTIE DATE. WHEREAS, the Federal Communications Commission ( "FCC ") has determined that rates charged subscribers for cable television service are excessive and in many cases unreasonable and pursuant to the Cable Television Consumer Protection and Competition Act of 1992, has adopted rules establishing a process for local regulation of cable rates for basic service; and WHEREAS, in order to assure that the city's citizens have the advantage of the new federal law and are required to pay only the most competitive rates for their cable television service; and WHEREAS, the city must act expeditiously to initiate its regulation of basic cable rates and to seek FCC regulation of other cable rates; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: SECTION 1. That the action of the Mayor in submitting an application to the FCC for certification of the city to regulate basic cable rates in filing with the FCC, a request that the FCC regulate non -basic tier cable rates is hereby ratified. SECTION 2. That this resolution shall take effect from and after its passage, and it is accordingly so resolved. RESOLVED AND PASSED this 11' day of November, 1993.
