THE STATE OF TEXAS § COUNTY OF TARRANT § CITY OF RENNEDALE § CITY OF RENNEDALE RESOLUTION NO. 43 PUBLICATION OF NOTICE OF INTENTION TO TAX AND REVENUE CERTIFICATES OF WHEREAS, the City deems it advisable to give notice of intention to issue one or more series of Certificates of Obligation in the maximum principal amount of $475,000 for the acquisition of a fire truck and acquisition and construction of certain improvements for its water system, including the acquisition of well control equipment and the relocation of water lines in the City and to pay legal, fiscal and engineering fees in connection with this project; and WHEREAS, it is hereby officially found and determined that the meeting at which this Resolution was passed was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RENNEDALE: 1. That attached hereto is a form of the Notice of Intention to issue Certificates of Obligation, the form and substance of which is hereby adopted and approved. 2. That the City Secretary shall cause said notice to be published in substantially the form attached hereto, in a newspaper of general circulation in said City, and published in said City, on the same day in each of two consecutive weeks, the date of the first publication thereof to be at least 14 days prior to the time set for the first reading of the ordinance authorizing the issuance of such certificates of obligation as shown in said notice. 3. That this Resolution shall become effectively immediately upon adoption. PASSED AND APPROVED ON THIS 8TH DAY OF FEBRUARY, 1996. The City Council of said City convened in Regular Meeting on the 8th day of February, 1996, at the designated meeting place, and the roll was called of the duly constituted officers and members of said City Council, to wit: Bill Abbott Mayor Mark Wright Mayor Pro tem Tom Boone Councilmembers Ron Kovach Robert Mundy George Barrett Kathy Turner City Secretary and all of said persons were present, except the following absentees: N/A , thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION was duly introduced for the consideration of said City Council and read in full. It was then duly moved and seconded that said Resolution be adopted; and, after due discussion, said motion carrying with it the adoption of said Resolution, prevailed and carried by the following vote: AYES: All members of the City Council shown present above voted "Aye" except as shown below. NOES: N/A ABSTAIN: N/A 2. That a true, full and correct copy of the aforesaid Resolution adopted at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Resolution has been duly recorded in said City Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the adoption of said Resolution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly arid sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for adoption at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. 3. City S chary Mayor (SEAL) S1','141ARTS 6011 CITY OF KENNEDALE NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION The City of Kennedale does hereby give notice of intention to issue one or more series of Combination Tax and Revenue Certificates of Obligation, in the maximum principal amount not to exceed $76" for paying all or a portion of the city's contractual obligations for the acquisition of a fire truck and acquisition and construction of certain improvements for its water system, including the acquisition of well control equipment and the relocation of water lines in the City and to pay legal, fiscal and engineering fees in connection with this project. The City proposes to adopt an ordinance which will provide that the Certificates of Obligation shall be secured by a pledge of funds received from the levy and collection of ad valorem taxes in the City as provided by law, and from a limited pledge of the surplus revenues (the "Surplus Revenues ") of the City's Waterworks and Sewer System, remaining after payment of all operation and maintenance expenses thereof, and all debt service, reserve, and other requirements in connection with all of the City's revenue bonds or other obligations (now or hereafter outstanding), which are payable from all or any part of the net revenues of the City's Waterworks and Sewer System; provided that if there are Surplus Revenues available to pay all or part of the Certificates of Obligation in any fiscal year, the levy of the ad valorem taxes shall be reduced by the amount of Surplus Revenues which are available to pay debt service on the Certificates of Obligation .
