Kennedale's zoning code classifies permitted land uses by the following types: permitted by right; permitted with a conditional use permit; and permitted with a special exception. Uses permitted by right are allowed within a particular zoning district without additional permission from the city. For example, single family homes are permitted by right in single family zoning districts. Uses are permitted by special exception require a review by the Board of Adjustment. A special exception is a tool cities use to consider a proposed land uses on a case -by -case basis. For example, on some properties, an auto inspection station or tire repair shop would be compatible with surrounding uses and would not be considered a nuisance. In some cases, however, these uses would be unsuitable. Certain criteria must be met to receive a special exception; for example, the person or company applying for the special exception must be able to argue that the proposed use won't endanger public health or impair the ability of a neighboring property owner to have the full use and enjoyment of his or her property. When a special exception is requested, the city's Board of Adjustment holds a public hearing to consider the request. The Board of Adjustment is a quasi - judicial board and can only consider information brought to it during the hearing. The public hearing process is as follows: 1. We are under the understanding that the development of this well site has been put in jeopardy due to the opposition of David and Diane Hunn who we sold our property to on July 29, 2008. It was indicated in our contract when we sold Mr. and Mrs. Hunn the property that they would agree to negotiate with the gas company and the city for the approval of a gas well permit. Although our contract specified for a period of one year, since the well was delayed, we truly hoped Mr. and Mrs. Hunn would honor this agreement. Mr. and Mrs. Hunn negotiated with us to receive 2.4 acres of mineral rights in order for us to make the sell which would also give them an interest in the well. If we had known at the time that there would be a problem with the approval of the well, we would not have sold the property to Mr. and Mrs. Hunn along with the 2.4 acres of mineral rights. The house that is within 600' of the well site belonged to my Dad, H. Elmer Clark, and was sold, "as is" because my Dad lived to be 93 years old he had not been able to make the necessary repairs. Parts of the floor were rotted out, the roof leaked, the pipes and wiring need to be repaired or replaced, some of the ceiling tiles were falling down, etc. The house was built in the 1930's and was moved to the property in about 1968. Our real estate agent told us at the time that no one had shown any real interest in the house just the property. We believe the Case site would be a perfect place to put a well. It is far enough from the town of Kennedale that it would not cause a problem with the trucks and traffic since there is a direct access to 1 -20. This location shouldn't cause a problem with noise during the drilling process because it is isolated enough that there are very few houses close enough to be able to hear any noise and Chesapeake has assured us that every precaution will be taken to prevent any pollution to the ground water or environment. Although we have never personally met Diane or David Hunn, from everyone that we have communicated with, we know that they are very nice and personable people. Mr. Hunn is a very smart, well- educated professional, and has many outstanding accomplishments as the chief scientist and director of the technical staff at Lockheed Martin Missiles and Fire Control. He is also Chairman of the Planning and Zoning Commission for the city of Kennedale. We realize that Mr. Hunn wants to make a profit for agreeing to sign the waiver to approve the Case well site and we have no problem with that as long as he is willing to receive what is customary and usual for these services and be willing to come to an agreement with Chesapeake to determine that amount. When Mr. Hunn became a member of the Planning and Zoning Commission, he signed an Ethics Policy statement for the city of Kennedale which states: It is the desire of the Kennedale City Council to promote and encourage the highest standard of conduct for elected City Officials and officials appointed to City Boards and Commissions who represent the citizens of Kennedale. It States: They should act in a manner which avoids even the appearance of impropriety and always act in the public interest rather than in the furtherance of self- interest. It States: that the public is best served when officials make decisions and act in a manner which promotes confidence by the citizens of Kennedale in the process of City government. Mr. Hunn's ethical behavior appears questionable since he knew when he bought the land a well would be drilled at the Case site and appears to be unreasonable with his inability to come to an agreement with Chesapeake. As a result, it could be putting in jeopardy the success of the Case well site and possibly preventing the ability of the people who leased their minerals to Chesapeake and the city of Kennedale from benefiting from the much needed revenue that the well would provide for them during this recession. This well site will benefit approximately 300 to 400 citizens and business owners of the City of Kennedale and 2 from Colorado. Since this recession has been devastating to many families with lost jobs and rising cost of living, the revenue will be God sent for many of us. We appeal to the Board of Adjustments that they approve the Special Exception waiver and consider the benefits that this well will bring to the City and the Citizens of Kennedale and 2 from Colorado. Joplin Rd and 1257 Swiney Hiett Rd, more particularly described Bowerman Addition, Block A, Lot 1 in Kennedale, Tarrant C unty, Texas. Background WELLS ALREADY PERMITTED AT THIS LOCATION: 8 DATE FIRST PERMIT ISSUED: SEPTEMBER 2008 DATE LAST PERMIT ISSUED: APRIL 2010 4 wells permitted September 2008 4 wells permitted April 2010 All permitted wells have been fracked. This case was first heard by the Board last December but was tabled for 60 days due to lack of adequate information submitted by the applicant. The case was heard again at the February meeting and was again tabled for 60 days. Staff Review In an effort to address concerns from residents about activities at this pad site, Chesapeake has held two meetings with residents of the Steeplechase neighborhood. On March 7, Chesapeake held an information meeting in an open house format and invited residents from the Steeplechase neighborhood to attend and ask questions about drilling and leasing operations in general. This meeting was held at the Kennedale community center. On March 21, Chesapeake invited city staff and three residents from the Steeplechase neighborhood to discuss their concerns. Two residents were able to attend, and city staff members were also present. The meeting was held at Chesapeake's building in downtown Fort Worth. Then on April 1, Chesapeake met with three residents from Steeplechase and with a city staff member to discuss concerns about sound monitoring. For your reference, we are providing below a description of the concerns we have heard expressed at public meetings for this pad site. We are also including a recommendation for how to address the concerns in the next section of this report. Water quality The public works department conducts water quality testing each year. Water is tested for hydrocarbons annually, and the distribution lines are tested for quality on a monthly basis. We believe this testing is sufficient for now and no additional testing is needed at this time. Air quality Chesapeake maintains that the diesel fumes and other fumes emitting from their site during fracking are in compliance with state and federal air regulations, but emissions that meet regulations can still be an irritant and a nuisance. We asked Chesapeake about the equipment used during fracking and were told that the equipment they use is necessary for their operations. To ensure Chesapeake has explored all viable options, we are requesting that Chesapeake submit a statement to the city about what less noxious options are available for fracking and why other options are not used. In addition, staff is still working to select an air sampling consultant to do testing on behalf of the city, but in the meantime, Chesapeake has been conducting testing at this site. The most recent report (from January) is included with your packet. Noise Chesapeake is considering adding an additional sound wall on the north side of the site and will have a determination about this matter on Monday, April 4. The city will use gas well permit fees to purchase ANSI - certified handheld sound monitoring equipment. City staff will be trained in how to use this equipment; city staff taking charge of sound monitoring would eliminate concerns about third- party sound monitoring. Dust CHK has worked with city staff to resolve this issue, and staff believes any problems that arise again can be resolved at the staff level. Communication Chesapeake has provided a toll -free number at the entrance to its well site that residents can call with questions about operations. The number goes to a Chesapeake command center that monitors activities at well sites. For logistical and operational issues that arise from the city staff perspective, staff will be holding one person accountable for each well site and will direct all staff concerns to that one person. Mineral rights This is a civil matter between private persons (corporation and mineral rights holders), and is not a matter for city involvement. ISSUES MENTIONED IN THE STAFF REPORT FROM FEBRUARY 2011: Chesapeake has made the site improvements requested by the city to help with dust and pad site conditions. This includes adding a shaker at the gate to the pad site and installing crushed rock at the pad site. In terms of remote connections for fire safety, our fire chief believes the hydrant locations and water line capacity are adequate for fire safety. Staff may need to work with Chesapeake to move one of their connections, but this can be worked out at the staff level as part of the permit process. As described above, Chesapeake has held several meetings with residents near this pad site to discuss and attempt to resolve community concerns. For unresolved issues, staff proposes a list of conditions of approval, shown below. Just as staff has requested Chesapeake to be more proactive in dealing with issues that arise, staff is also taking a more proactive approach for the issues we have the authority to address. Chesapeake has maintained that there are no more wells proposed for this site at this time, other than the two requested through this special exception. The staff position is that it would be best to approve the request for a special exception, subject to the conditions listed below, so that activity at this site can be completed. In this way, owners of mineral rights would have access to their minerals, while at the same time, the residents most affected by the nuisance aspects of drilling have an end to drilling and related activities for the time being. Conclusion and Recommendation Staff recommends the request for a special exception be granted with the following conditions: (1) Chesapeake is required to submit to the city a statement noting whether less noxious methods for drilling and fracking are available, what those options are, and why a less noxious approach, if available, is not used. (2) Operator will install an additional sound wall to block sounds reaching the Steeplechase neighborhood; if sound monitoring by city staff or by the operator determines that noise levels are in violation on other sides of the pad sites, operator will install sound walls on other sides if requested by the city. (3) Chesapeake will continue to conduct air sampling and testing at this pad site until the City selects and hires an air sampling consultant. Air sampling and testing shall be done during the following times at a minimum: once during drilling, once during fracking, and once after the well is in production. (4) Operator will maintain adequate surface materials at the pad site. (5) Operator will clean up any material tracked off site immediately; if excessive amounts of materials are tracked offsite, the traffic going to and from the site will be required to cease until the problem is corrected and approved by city staff. (6) City staff shall have the discretion and authority to determine any questions about the meaning, intent, implementation, or enforcement of these conditions.
