KENNEDATF ORDINANCE NO. 63-10 KENNEDALE ZONING ORDINANCE AN ORDINANCE ESTABLISHING ZONING DISTRICTS WITHIN THE CITY OF KENNEDALE, TEXAS, REGULATING AND RES- TRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, THE DENSITY OF POPULATION, THE ERECTION, CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR AND USE OF BUILDINGS, STRUCTURES AND LAND WITHIN SUCH DISTRICTS; ADOPTING A ZONING MAP SHOWING THE LOCATION OF SUCH DTSTRICTS; PROVIDING FOR A METHOD OF ENFORCEMENT, AND PRESCRIBING PENALTIES FOR THE VIOLATION OF THE PROVISIONS OF THE ORDINANCE; PRO- VIDING FOR A CERTIFICATE OF OCCUPANCY AND COMPLIANCE; DEFINING CERTAIN WORDS AND PROVIDING FOR Ti-E INTER- PRETATION OF THE ORDINANCE; PROVIDING FOR A BOARD OF ADJUSTMENT, FOR AMENDMENT AND CHANGES, CONTAINING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Kennedale, Texas, deems it necessary in order to lessen congestion on streets, to secure safety from fire, panic and other dangers, to promote the health and general welfare, to provide ade- quate light and air, to prevent the over -crowding of land, to avoid undue concentration of population, to facilitate the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements, to conserve the value of property and encourage the most appropriate use of land throughout the City, all in accordance with a compre- hensive plan, that the hereinafter contained provisions of this ordinance should be passed, promulgated and enforced; and WHEREAS, the Planning and Zoning Commission of the City of Kennedale, Texas, has held public hearing, after due notice as required by law, and has recommended the boundaries of districts and regulations as herein contained; and WHEREAS, the City Council has also held public hearing, after due notice to interested property owners and citizens as required by law, and subsequent to its receipt of the recommendation of the Zoning Commission; all with a view to enacting a comprehensive zoning ordinance for the City; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: SECTION la Title of Ordinance. This ordinance shall be known and may be cited as the "Zoning Ordinance of the City of Kennedale, Texas". SECTION 2 INTERPRETATION AND PURPOSES. In their interpretation and application, the provisions of this ordinance s .11 be held to be the minimum requirements adopted for the promotion of the public health, safety and welfare. The zoning regulations .nd districts as herein established, have been made in accordance with a comprehensive plan, for the Purpose of promoting health, safety, morals and the general welfare of the City of Kennedale; they have been designed, among other things, to lessen congestion in the streets, to secure safety from fire, panic and other dangers, to provide adequate light and pure air; to avoid undue concentration of population, and to facilitate adequate pro- visions for transportation, water, sewerage, schools, parking areas and other public requirements. SECTION 3. SCOPE. It is not intended by this ordinance to repeal, abrogate, annul or in any way impair or interfere with existing provisions of other=laws or ordinances, except as the same may be specifically repealed by the terms of this ordinance, or with private restric- tions placed upon property by covenant, deed, easement or other private agreement. Where this ordinance imposes a greater restric- tion upon land, buildings or structures than is imposed or required by other laws, ordinances, deeds, covenants or agreements, the pro- visions of this ordinance shall govern. SECTION 4. DEFINITIONS For the purposes of this ordinance, the following terms, phrases, words, and their derivations, shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular, and words in the singular number include the plural. The word "shall" is always mandatory and not merely directory. ACCESSORY BUILDING OR USE: A subordinate building on the same lot, or a portion of the main building, the use of which is clearly incidental to that of the main building; or a use customarily in- cidental to the main use of the property. ALLEY: A way which affords only a secondary means of access to abutting property, APARTI�1..�'-NT: A room or a suite of rooms within an apartment house arranged, intended or designed for a place of residence of asingle- family or group of individuals living together as a single housekeeping unit. APARTMENT HOUSE: A building or portion thereof arranged, de- signed or occupied as a residence fdr three or more families as separate housekeeping units. APARTMENT HOTEL: An apartment house which furnishes for the use of its tenants services ordinarily furnished by hotels, but the privileges of which are not primarily available to the public. AUTOMOBILE SAW AREA: An open area or lot used for the dis- play or sale of automobiles, where no repair work is done excet minor reconditioning of the cars to be displayed and sold on the premises, and no dismantling of cars or sale or keeping of used car parts or junk on the pi _mises, BASEMTT: A story below the first story as hereinafter defined. (See, STORY) . BOARDING HOUSE OR LODGING HOUSE: A building other than a hotel, occupied as a single housekeeping unit, where lodging or meals are provided for five or more persons for compensation, pursuant to pre- vious arrangements, but not for the public or transients. BUILDING: A structure having a roof supported by columns or walls for the housing or enclosure of persons, animals or chattels. BUILDING, BEIGHT OF: The vertical distance measured from the curb level to the highest point of the roof surface, if a flat roof; to the deck line of a mansard roof; and to the mean height level be- tween eaves and ridge for a gable, hip or gambrel roof, provided, however, that where buildings are set back from the street line, the height of the building may be measured from the average elevation of the finished grade along the front of the building. CLINIC: Offices for one or more physicians, surgeons, or dentists engaged in treating the sick or injured, but not including rooms for the abiding of patients. COMNUNITY CENTER: A buildhg dedicated to social or recrea- tional activities, serving the City or a neighborhood thereof and owned and operated by the City of Kennedale, or by a non-profit organization dedictited to promoting the health, safety, morals or general welfare of the City. COURT: An open unoccupied space other than a yard, on the same lot with a building, and which is bounded on three or more sides by the building. DAY NURSERY: A place where six or more children are left for care a part of the twenty-four hours cf the day. DWELLING, ONE FAMILY: A detached building designed for or occupied exclusively by one family. DWELLING, TWO FAMILY: A detached building designed for occu- Pancy by two families as separate housekeeping units. DWELLING, MULTIPLE: A building or portion thereof, used or designed as a residence for three or more families as separate housekeeping units, including apartments, apartment hotels and row houses with party walls. FAMILY: Cne or more persons occupying a Premises and living as a single housekeeping unit, as distinguished from a group occupy- ing a boarding house, lodging house, hotel, club, fraternity or sorority house. FRONTAGE: All the property abutting on one sie of the street between two intersecting streets, measured along the street line. GARAGE, PRIVATE: An accessory building for storage only of motor vehicles, generally Passenger automobiles belonging to the occupant of the same premises. GARAGE, PUBLIC: A building other than a private or storage garage used for the care or repair of self-propelled vehicles or where such vehicles are kept for remuneration, hire or sale. GARAGE, STORAGE: A building or portion thereof, other than a private garage, used exclusively for parking or storage of self- propelled vehicles, but with no other services provided except facilities for washing. HOBBY: An accessory use carried on by the occupant of the premises in a shop, studio or other work room, purely for personal enjoyment, amusement or recreation; provided, that the articles pro- duced or constructed in said shop, studio or work room are not sold either on or off the premises, and provided such use will not be obnoxious or offensive by reason of vibration, noise, odor, dust, smoke or fumes. HOME OCCUPATION: Any occupation which is customarily incident to the main use of the premises as a dwelling place, and is conducted by a member of a family residing in the building, and in connection with which there is kept no stock in trade nor commodity to be sold upon the premises; provided, that no person is employed other than a member of the immediate family, residing on the premises; providing further, that no mechanical equipmertshall be used which will be obnoxious or offensive by reason of vibration, noise, odor, dust smoke or fumes. The operation of beauty culture shcools, beauty parlors or barber shops, shall not be considered home occupations, HOTEL: A building occupied as the more or less temporary abiding place of individuals who are lodged with or without meals and in which there are more than twelve sleeping rooms usually occupied singly and no provision is made for cooking in any individ- ual room or apartment. HOTEL, TOURIST: A building occupied as the more or less temporary abiding place of individuals who are lodged with or with- out meals and in which there are more than five, andnot exceeding twelve, sleeping rooms usually occupied singly and no provision is made for cooking in any individual room or apartment. JUNK: This term is defined to mean and shall include scrap iron, scrap tin, scrap brass, scrap copper, scrap lead or scrap zinc, and all other scrap metals and their alloys, and bones, rags, used cloth, used rubber, used rope, used tinfoil, used bottles, old cotton or used machinery, used tools, used appliances, used fixtures, used utensils, used boxes or crates, used pipe or pipe fittings, used automobile or airplane tires, and other manufactured goods that are so worn, deteriorated or obsolete as to make them unuseable in their existing condition; subject to being dismantled for junk. KENNEL: Any lot or premises on which four or more dogs, cats or other domestic animals, at least four months of age, are housed or accepted for boarding, trimming, grooming and/or bathing for which remuneration is received. KINDERGARTEN: A school other than a public school for children of pre -public school age in which constructive andeavors„ object lessons and helpful games are prominent features of the curriculum. LEGAL NON -CONFORMING USE, BUILDING OR YARD: A use, building or yard existing legally at the time of the passage of this ordinance, which does not by reason of design, use or dimensions conform to the regulations of the district in which it is situated. A use, building or yard, established after the passage of this ordinance which does not conform to regulations of the district in which it is situated shall be considered an illegal use. LOT: Land occupied or to be occupied by a building and its accessory buildings, together with such open spaces as are required under this ordinance, and having its principal frontage upon a street or officially approved place. LOT, CORNER: A lot situated at the junction of two or more streets. A corner lot shall be deemed to front on the street on which it has its smallest dimensions, or as otherwise designated by the City Planning & Zoning Commission. LOT, INTERIOR: A lot other than a corner lot. LOT LINE,S: The Ines bounding a lot as defined herein. LOT OF RECORD: A lot which is a part of a subdivision, th,,, map of which has been recorded in the office of the County Clerk of Tarrant County, Texas. LOT, THROUGH: An interior lot having frontages on two streets; such through lot shall provide a front yard on each street. LOT WIDTH: The mean horizontal distance between side lines measured at right angles to the depth. PARKING AREA, PUBLIC: An open area other than a street,alley or place, used for the temporary parking of more than four self- propelled vehicles, and available for public use whether free, for compensation or as an accommodation for clients or customers. PARKING AREA, SEMI-PUBLIC: An open area other than a street, alley or place, used for temporary parking of more than four self- propelled vehicles as an accessory use to semi-public institutions, schools, churches, hospitals, and non-commercial clubs. SERVANTS' QUARTERS: An accessory building located on the same lot or grounds with the main building, and used as living quarters for servants employed on the premises and not rented or otherwise used as a separate domicile. STABLE, PRIVATE: A separate accessory building for the keeping of horses, or mules owned by the occupants of the premises and not kept for remuneration, hire or sale. STABLE, PUBLIC: Astable other than a private or riding stable. STABLE, RIDING: A structure in which horses or mules used for pleasure riding or driving are housed, boarded or kept for hire, in- cluding a riding track. STORY: That part of a building included between the surface of one floor and the surface of the floor next above, or if there be no floor above, that part of the building which is above the surface of the highest floor thereof. A top story attic is a half - story when the main line of the eaves is not above the middle of the interior height of such story. The first story is the highest story having its interior floor surface not more than four feet above the curb level of the street at the center front of the building, or the average elevation of the finished grade along the front of the build- ing were it set back from the street. STtT: A public or private thoroughfare which affords princi- pal means of access to abutting property. STRUCTURE: Anything constructed or erected, the use of which requires location on the ground or that it be attached to something having a location on the ground. STRUCTURAL ALTERATION: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders, or any substantial change in the roof or in the exterior walls. TOURIST CAMP, OR COURT: A group of attached or detached build- ings, containing individual sleeping or living units for temporary accommodations for tourists with garage or parking facilities con- veniently located to each such unit. TRAILER CAMP, OR COURT: A lot where parking facilities and ac- commodations are provided on a temporary or transient basis for house cars or automobile trailers used for human habitation. USED AUT©MOBIL E K AREA: An open area other than a street, alley or place, used for the dismantling or wrecking .fused automo- biles, or the storage, sale or dumping of dismantled or wrecked auto- mobiles or their parts. YARD: An open space other than a court, on the same lot with a building, unoccupied and unobstructed from the ground upward, except as other wise provided herein. In measuring to determine the width of a side yard, the depth of a front yard, or the depth of a rear yard, the least horizontal distance between the lot line and the rain building shall be used. YARD, FRONT: A yard across the full width of a lot extending from the front line of a building to the front street line of the lot YARD, REAR: A yard extending across the full width of the lot and measured between the rear line of the lot and the rear line of the main building, except that area included in the side yard as de- fined below. YARD, SIDE: A yard between the building and the side line of the lot and extending from the front yard to the required minimum rear yard. SECTION 5. ZONING DISTRICTS. In order to regulate and restrict the location of residences, businesses, trades and industries, and the location ofbuildings erected, reconstructed, altered or enlarged for specified uses, to regulate and limit the height and bulk of buildings hereafter erected, reconstructed, altered or enlarged, to regulate and determine the area of yards and other open spaces, and to regulate and limit the density of population, the City of Kennedale is hereby divided into four zoning districts to be known as follows: "A" Single Family Dwelling District, or District "A". "B" Business, Commercial and Multi -Family Dwelling District, or District "3". "C" Light Industrial District, or District D" Industrial District, or District "D". The order of classification shall be as enumerated above, with the "A" Single Family Dwelling District being the most restrictive, and the "D" Industrial District the least restrictive classification. The districts aforesaid, and the boundaries of such districts, shall be as hereinafter described, and as shown upon the map attached hereto and made a part of this ordinance, said map being designated "Zoning Map of the City of Kennedale, Texas", and said map and all notations, references and other information shown thereon shall be a Part of this ordinance the same as if all such matters and informa- tion were fully described herein. The original of said map shall bear even date with the passing of this ordinance and shall be signed by the Mayor and attested by the City Secretary, under the seal of the City of Kennedale, Texas; said original map shall be kept in the office of the City Secretary in the Kennedale City Hall, and a replica thereof shall be produced upon paper in such reduced scale as will permit its being attached to this ordinance. SECTION 6. "A" SINGIR, FAMILY DWELLING DISTRICT. DISTRICT LIMITS: District "A" shall be comprised of and shall include all of the land within the corporate limits of the City of Kennedale, Texas, save and except those areas of the City specifically described in succeeding portions of this ordinance as being included within Districts "3', "C" and "D", it being the intention of the City Council to hereby designate and zone all areas of the City as Single Family Residential unless otherwise zoned as to a particularly described area. Likewise, District "A" shall comprise and include all areas hereinafter annexed to the City of Kennedale, unless and until such newly annexed areas are otherwise zoned by proper actbn of the City Council. In accordance with the preceding paragraph, District "A", as of the date of the enactment of this ordinance, comprises and includes all of the corporate limits of the City of Kennedale, Texas, save and except the land abutting either side of U. S. Highway No. 28( ror a distance of 300 feet back from the right-of- way line of said highway, a strip of land abutting the south side of Interstate Highway No. 820 for a distance of 300 feet back TT from its south right-of-way line, that portion of the E. C. Cannon Survey, Abstract No. 378, lying between the easterly right-of-way line of the Southern Pacific Railroad on the west and U. S. Highway No. 287 on the east, all of the Oak Crest Addition, Lots 9 and 23-28, both inclusive, in Block 1, and Lots 13-21, both inclusive, in Block 2, of Woodlea Acres Subdivision, that portion of the J. Prickett Survey, Abstract No. 1225, and the Shelby County School Land Survey lying east of U. S. Highway No. 287 and north of Lot 24, Block 1, Woodlea Acres Subdivision, and a strip of land abutting the southwest right-of-way line of the Southern Pacific Railroad and extending 300 feet in width from such southwest right- of-way line (providing, however, that land lying within 200 feet of either side of New Hope Road and abutting the southwest right- of-way line of said Southern Pacific Railroad for a distance of 300 feet therefrom is not a portion of the last exclusion, but such 200 foot strip on either side of New Hope Road and within 300 feet of said southwest right-of-way line is expressly mad, a art of Distr .c "Al; ` s v�7ell as any ahrt of Br1 arw d. A - dit on jilthin 300 f any aai on s a1so exp ess_ say. � o� � go-©f-way, w� c Br�.arwoo tiart or DriS,riCt A 'USE REGULATIONS: In District "A", no building or land shall be used and no building shall be hereafter erected, reconstructed, or altered or enlarged, unless otherwise provided in this ordinance, ex- cept for one or more of the following uses: 1. One -family dwellings. 2, Churches, provided ample lot space is provided for off- street parking sufficient to accommodate automobiles of persons reasonably to be expected to attend the church being erected, with due consideration to the size of building, membership, both present and petential, and other relevant factors, 3. Public schools, elementary and high. 4. Museums, libraries, parks, playgrounds or community centers owned and operated by the City of Kennedaleo 5. Farming and truck gardening; provided, however, that such farming and truck gardening must be indidental to the use of the premises for residential purposes, and further pro- vided that no retail or wholesale business sales offices are maintained on the premises. 5. Detached accessory buildings, not exceeding the height of the main building on the preri- ses, including one private garage, private stable or servants' quarters, when located not less than sixty feet from the front lot line, nor less than the distance required for the main building from any side lot line. The garage shall provide space for not more than one motor vehicle for each 2,500 square feet of lot area, and the stable shall provide for not more than one horse or mule for each 10,000 square feet of lot area. Servants' quarters shall be occupied only by ser- vants employed on the premises, and the area of servants' quarters shall not exceed 50% of the area permitted for all accessory buildings on the pre- mises. An accessory building may be constructed as a part of the main building, in which case the regulations controlling the main building shall apply. 7. Uses customarily incident to any of the above uses when situated in the same dwelling/when not in- volving the conduct of a businessor industry, but including home occupation, as heretofore defined, such as the office of a physician, surgeon, dentist or artist. 8. Hobby shops, as an accessory use. 9. An unil lumina ted name plate for each family not ex- ceeding one square foot in area, containing the name and occupation of the occupant of the premi- ses, provided the name plate is attached flatwise to the building; and uni llurtina ted signs not exceed- ing twelve square feet in area pertaining to the sale or rental of property on which they are located; provided, however, that no advertising sign of any other character shall be permitted in District "A'. 10, A transitional use may be permitted where the side of a lot in District "A" abuts upon a lot zoned for business, commercial or . industrial use. HEIGHT AND AREA REGULATIONS: In District RfA" the height and minimum floor. space of buildings, the minimum dimension of lots and yards, and the minimum lot area per family shall be as follows: HEIGHT: No building hereafter erected, reconstructed, altered or enlarged,. shall exceed two and one-half stories,nor shall it exceed 35 feet in height. FLOOR SPACE: The main residence shall contah a minimum of t.= square feet of liveable fl or ce, exclusive of garages, porches and breezeways, FRONT YARD: There shall be a front yard of not less than 30 s feet. REAR YARD: There shall be a rear yard having a depth of not less than 20 feet. ST E YARD There shall be a side yard on each side of a main building of not less than 10 feet, and this shall be applicable to both corner and interior lots; provided, however, in the case of reversed frontage where the corner lot -abuts on the side of a lot facing the other intersecting street, there shall be a side yard on the corner of not less than 50% of the front yard required on the lot abutting the rear of the corner lot, and no accessory building on such corner lot shall project beyond the front yard line of the lots in the rear, nor shall accessory buildings be erected closer than ten feet to the line of the abutting lot to the rear. WIDTH OF LOT: The minimum width of a lot shall be 70 feet,pro- vided that where a lot of record and in separate ownership at the time of the passage of this ordinance has less width than herein required, this. regulation shall not prohibit the erection of a one - family dwelling. LOT AREA: The minimum area of a lot shall be--T,000 square feet, provided that the property is served by a public sanitary sewer main; provided that where a lot has less area than herein required and was of record and in separate ownership at the time of passage of this ordinance, said lot may be occupied by not more than one family. The minimum lot area for property not served by sanitary sewer shall be 20,000 square feet to provide adequate septic tank drainage., or any smaller area of not less than 10,000 square feet upon approval of the City Health Officer as to adequacy of drainage in view of the particular soil and terrain. SECTION 7. "B" BUS INESS, COMMERCIAL AND MULTI- FAMiLY DWELLING DISTRICT: DISTRICT LIMITS: District "B" shall be comprised of and shall include all land within the corporate limits of the City of Kennedale abutting upon the northeasterly right-of- way line of U.S. Highway No. 287 and extending back from said right-of-way line for a distance or width of 300 feet, save and except any portion thereof lying within Lot 9, and Lots 23-through 28, both inclusive, of Block 1, Woodlea Acres Subdivision, or within that portion of the J. Prickett Survey, Abstract No. 1225, and the Shelby County School Land Survey lying east of U. S. Highway No. 287 and north of Lot 24, Block 1, Woodlea Acres Subdivision; and said District "3" also including all land abutting the southwesterly right-of-way line of U. S. Highway No. 287 and extending back from said right- of-way line for a depth or width of 300 feet, save and except any portion thereof lying southwest of the Southern Pacific Railroad right-of-way, or lying within Lots 13 through 21, both inclusive, of ?lock 2, of Woodlea Acres Subdivision, or lying within the Oak Crest Addition; and said District "3" also including all land within the corporate limits of the City of Kennedele abutting upon the southerly right-of-way line of Interstate Highway No. 820 and extending back from said right-of-way line for a depth or width of 300 feet; it being the intention of the City Council to include in said District "B" a 300 foot wide strip of land along either side of U. S. Highway No. 287 and along the southerly side of Interstate Highway No. 820, except for any portions thereof hereinafter included within District C Dr istricCnont " ". (0, 1-re recruatmons notwiths anthn USE REGULATION : In District "B" no building or land shall be used an no building shall be hereafter erected, reconstructed,altered or enlarged, unless otherwise pro- vided in this ordinance, except for one or more of the following uses: 1. Any uses permitted in District "A". 2. Two -Family and other multiple dwellings. 3. Accessory buildings, the same as in District "A", except that in District "3" a private garage may provide space for not more than one motor vehicle for each 1500 square feet of lot area. 4. Boarding and lodging houses. 5. Hotels, apartment hotels or tourist hotels. 6. Private clubs, fraternities, sororities and lodges. 7. Kindergartens and day nurseries. 8. Hospitals, clinics, doctors or dentists' offices, sanitary or care homes, provide that none of the above may be used for contagious, mental, drug or liquor addict cases, or animal hospitals. Automobile parking areas, as acccessory use only, or exclusively for customers, clients or patrons. 10. Banks, offices, studios. 11. Restaurants and cafes. 12, Retail pressing, dyeing and cleaning shops. 13. Retail stores, including barber shops, beauty shops and other shops for custom work or the making of articles to be sold at retail on the_loremises. 14. Grocery stores and meat markets. 15. Photograph, portrait or camera shops and photo -finishing. 16. Tourist and trailer camps, courts or lodges. 17. Dry good and millinery stores and shops. 18. Books or stationery stores or news stands. 19. Theater or moving picture Shows. 20. Printing shops. 21. Gasoline filling stations and public garages. 22. Uses customarily incident to any of the above uses, as heretofore provided in this ordinance. 23. Any other use of a business or commercial nature, as distinguished from an industrial or manufacturing nature, similar to the uses listed in this section in type of goods or services sold, in business hours, in the number and character of persons to be attracted to the premises, and in its effect upon adjoining residence districts; provided, however, that no use shall be permitted in District "B" which constitutes a public or private nuisance or is obnoxious or offensive by reason of the emission of odor, gas, dust, smoke or noise or unsightliness, and further provided that none of the specific uses herein: authorized for Districts "C" and "D", but not named in this section, shall be permitted in "B",-Cdstrict. HEIGHT AND AREA REGULATIONS: In District "B", the height and floor space of buildings, the minimum dimensions of lots and yards, and the minimum lot area per family shall be as follows: HEIGHT: No building shall exceed two and one-half stories nor 35 feet in height, unless such building is located within 150 feet of U. S. Highway No. 287 or interstate Highway No. 820, in which event the height of the building shall not exceed three stories nor 45 feet in height. FLOOR SPACE: Each dwelling shall contain a minimum of 750 square feet of liveable floor space, exclusive of garages, porches, and breezeways, per family to be housed in said dwelling. FRONT YARD: There shall be a front yard of not less than 25 feet. REAR YARD: There shall be a rear yard having a depth of not less than 10 feet. SIDE YARD: There shall be a side yard on each side of a main building of not less than five feet on interior lot lines, and not less than 10 feet on a corner lot on the side abutting a street; provided, however, on buildings located within 150 feet of U. S. Highway No. 287 or Interstate Highway No. 820, joint or party walls for adjoining buildings shall be permissible, but if a side yard is provided, it shall be at least five feet in width. WIDTH OF LOT: The minimum width of a lot shall be 70 feet. LOT AREA: Each lot shall provide a minimum lot area of 7,000 square feet, and not less than 3,500 square feet per family; pro- vided, however, the latter regulation shall not apply to hotels, apartment hotels, and the like, where no cooking is done in the individual rooms or apartments; and further provided that where a lot has less area than herein required and was of record and in separate ownership at the time of passage of this ordi- nance, this regulation shall not prohibit the occupancy of said lot by not more than one family. If not served by public sewer, the rules of District "A't shall apply. SECTION 8. "C" LIGHT INDUSTRIAL DISTRICT. DISTRICT LIMITS: District "C" shall be comprised of and shall include all of the E. C. Cannon Survey, Abstract No. 378, lying between the easterly right-of-way line of the Southern Pacific Railroad on the west and a line drawn parallel to and 300 feet west of the westerly right-of-way line of the Old Mansfield Road on the east, and also all of the land within the corporate limits of the City of Kennedale abutting upon the southwesterly right-of-way line of the Southern Pacific Railroad and extending back from said right-of-way line for a distance or depth of 300 feet, save and except any portion thereof lying within 200 feet of either sideof the New Hope Road, and also save and except any portion thereof lying within the Briarwood Addition. USE REGULATIONS: In District "C„ no building or land shall be used and no building shall be.hereafter erected, reconstructed, altered or enlarged, unless otherwise provided in this ordinance, except for one or more of the following uses: 1. Any uses permitted in District "B". 2. Amusement or baseball parks. 3. Auto sales, new or used. 4. Bakery, laundry and candy manufacturing. 5. Public stables and riding stables, and kennels. 6. Wholesale office and sample rooms. 7. Automobile storage garages. 8. Storage warehouses. 9. Wholesale houses. 10. Mortuaries, green houses or nurseries. 11. Lumber yards. 12. Ice plants or storage houses. 13. Monument or marble works. 14. Sheet metal sholos. 15. Pattern shops. 16. creameries. 17. Bottling plants. 18. Building material storage yards. 19. Cold :Storage plants and lockers. 20. Dog and cat hospitals. 21. Electro plating and galvanizing plants. 22. Motor truck terminals. 23. Light manufacture of products from Plastics, aluminum, brass, bronze, copper, steel, tin or other metals, leather and wood, provided that Power not in excess of ten horsepower is employed in the operation of any one machine. 24. Any commercial, light industrial, recreational or amusement classification similar to the uses listed in this section in the type of services or goods sold, in the number of persons to be attracted to the Premises, or in the effect upon adjacent areas in more restrictive use districts; provided, however, that no use shall ba permitted in District "C" which is obnoxious or offensivebecause of odors, dust, noise, fumes or vibrations, or which use would constitute a public or private nuisance. HEIGHT AND AREA REGULATIONS: In District "C", the height and floorspace of buildings, the minimum dimensions of lots and yards, and the :;linimum lot area per family shall be the same as in District "B". M" INDUSTRIAL DISTRICT. DISTRICT LIMITS: District I'D" shall be comprised of and shall include all of the Oak Crest Addition, Lot 9 and Lots 23 through 28, both inclusive, in Block 1, and Lcts 13 through 21, both inclusive, in Block 2, of Woodlea Acres Subdivision, and that portion of the J. Prickett Survey, Abstract No. 1225, and the Shelby County School Land Survey lying east of U.S. Highway No. 287 and north of Lot 24, Block 1, Woodlea Acres Subdivision. USE REGULATIONS: In District "D" no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, unless otherwise provided in this ordinance, except for one or more of the following uses: 1. Any uses permitted in District "C". 2. Planing mills. 3. Cotton gins. 4. Brick works. 5. Dog pounds. 6. Egg processing, meat and poultry processing plants. 7. Forge plants. 8. Structural welding plants. 9. Manufacturing or industrial use of any kind not prohibited by state or federal law or any ordinance of the City of Kennedale, Texas; provided, however, that no use shall be permitted in District "D" which constitutes a public or private nuisance or is obnoxious or offensive by reason of the emission of dust, smoke, gas, noise or vibration; and further provided that the following uses are expressly prohibited: b d h 1 1 n 0 p q r Slaughter house. Tar or asphalt .nufacture. Used automobile junk areas, either storage or aismantling. Curing or storage of raw hides or skins. Storage, salvaging, sorting, processing or bailing of rags, iron, scrap paper or junk. HEIGHT AND AREA REGULATIONS: In District "D", the height and floor space of buildings, and the minimum dimensions of yards and lots, and the minimum lot area per family shall be the same as in District "C"; provided, however, that the Zoning Board of Adjustment shall have authority to grant variances where by reason of the intended use of property, the area of ownership of the lot and other factors, such variance will not be disruptive of the use and protection of adjoining premises or violative of the purposes of this ordi- nance. HEIGHT: No building shall exceed 60 feet in height. FLOOR SPACE: Same as District "C". FRONT YARD: Same as District C". ',.;fiv) stories nor REAR YARD: Same as District "C". SIDE YARD: Same as District "C". WIDTH OF LOT: Same as District "C". LOT AREA: Same as District "C". SECTION 10. NEWLY ANNEXED TERRITORY. All territory hereafter annexed to the City of Kennedale, Texas, shall be classified as "A" Single Family Dwelling District, unless and until otherwise permanently zoned by the City Council of the City of Kennedale, Texas. After any annexation, the City Planning and Zoning Commission may institute proceed- ings upon its own motion to determine the correct zoning classification for such annexed territory, and upon proper application of any property owner in such territory shall institute such proceedings, and the procedure to be followed shall be the same as is provided by law for the adoption of original zoning regulations. SECTION 11. OFF-S24EET VEHICLE PARKING REQUIREFENTS. In all zoning districts there shall be provided, in connection with the erection of any new improvements thereon, or the material reconstruction, alteration or enlargement of any existing improvements thereon, off-street vehicle parking sparse in accordance with the following minimum requirements: (1) In District "A" there shall be provided on each lot a vehicle parking space of at least 180 square feet. (2) in Districts "3", "C" and ""D" there shall be provided on each lot, with respect to erection of new im- provements thereon, or with respect to the material re- construction, alteration or enlargement of existing im- provements, the following minimum number of vehicle parking spaces, having a minimum area of 180 square feet per parking space, based upon the use of such improvements and premises, as follows: For dwellings, one parking space per family. ) For retail business stores, retail service establishments, private clubs, office buildings, andperriaservice establishments, one parking space for each 125 square feet of floor space in the building housing such establishment. (c) For churches, theaters, public auditoriu4is and funeral homes, one parking space for each six seats in the auditorium or chapel. (d) For private offices, banks, automobile service concerns, hospitals, wholesale houses, and manufacturing establishments, one parking space for each three employees or occupants, (3) For uses not covered by the preceding sub- paragraph, parking spaces shall be provided in Districts "3", "C" and "D" in such number as shall be determined by the Zoning Board of Adjustment upon application by the property owner and after hearing, such determination to be in keeping with the minimum standards set forth in this section, with due regard to the anticipated number of vehi- cles using such premises. S.ECTIOON 12. GENERAL REQUIREMENTS. No building shall hereafter be erected, reconstructed, altered or enlarged, nor shall any building or land be used for any ptwpose other than is permitted in the district in which such building or land is located. No buildingshall hereafter be erected, reconstructed, altered or enlarged to exceed the height or bulk limit herein established for the district in which such building is located, nor shall any building be erected, reconstructed or altered so as to provide a floor space smaller than the minimum prescribed by this ordinance. No lot area shall be so reduced or diminished that the yards or other open spaces shall be smaller than prescribed by this ordinance, nor shall the density of population be increased in any manner except in conformity with the area regulations herein established. EJery building hereafter erected shall be located on a lot as herein defined, and in no case shall there be more than one building on one lot, except as herein provided. SECTION 13. NON-CONFOR iNG USES. (a) The lawful use of a building existing at the time of the passage of this ordinance may be continued, although such use does not conform with the provisions hereof, and such use may be extended throughout the building provided no structural alterations, except those required by lava or ordinance, are made therein. If no structural alterations are made, a non -conforming use of a building may be changed to another non -conforming use of the same or more restricted classification. If such non -conforming ing building is removed, every future use of such premises shall be in conformity with the provisions of this ordinance, (b) Repairs and alterations y be made to a legal non- conforming building, provided that no structural alterations shall be de except those required by law or ordinance, unless the Adjustment building is changed to a conforming use. The Board shall have authority after hearing to grant extension torn conforming buildings not to exceed 25% of the ground area of the same in case of evident hardship, subject to the yard restrictions herein provided. (c) The lawful use of land existing at the time of the passage of this ordinance, although such use does not conform to the pro- visions hereof, may be continued, but if such non -conforming use s discontinued, any future use of such premisesshall be in conformity with the provisions of this ordinance. (d) A legal non -conforming use if changed to a conforming use may not thereafter be changed back to a non -conforming use, and if changed to a more restricted non -conforming use may not thereafter be changed unless to an equal or to a more restricted use. (e) A legal non -conforming use, when discontinued or abandoned, shall not be resumed. Discontinuance or abandonment shall be de- fined as follows: (1) When land used for a legal non -conforming use shall cease to be used in a bona fide manner for one calendar month. (2) When a building designed or arranged for a non- conforming use shall cease to be used in a bona fide manner as a legal non -conforming use cTor a continuous period of twelve consecutive months. When a building, designed or arranged for a con- forming use shall cease to be used in a bona fide manner as a legal non -conforming use br a (3) Period of six consecutive calendar months. (4) Upon evidence of hardship, the Board of Adjustment shall have the power to extend the above time limits not to exceed six months. (f) A certificate of occupancy shall be issued for all legal non -conforming uses. (g) Nothing in this ordinance shall be taken to prevent the restoration of a building destroyed to the extent of not more than 51% of its reasonable value, by fire, explosion or other casualty, or act of God, or the public enemy, nor the continued occupancy or use of such building or part thereof which existed at the time of such partial destruction. (h) Nothing herein contained shall require any change in the plans, construction or designated use of a building for which a legal building permit has been heretofore issued, provided such construction shall have been started and shall be diligently pro- secuted to completion within six months following the date of issuance of such permit. SECTION 14. BOARD OF ADJUSTMENT. There is hereby created a Board of Adjustment, consisting of five members, who shall be resident qualified electors cf the City of Kennedale, appointed by the Mayor and atproved by the City Council. The organization and procedure of the Board, its meetings, method of handling appeals, and other related matters, shall all be in conformity with the provisions of Sec. 7 of Chapter 283 of the Acts of the 40th Legislature, Regular Session (1927), being House Bill No. 87. Me -cabers of the Board of Adjustment shall serve a term of two years each, and they shall be subject to removal for cause. Any vacancy shall be filled by appointment ia like manner for the un- expired term. The Board shall elect its own chairman and a opt rules of procedure not inconsistent with the State law. The Board shall hear and decide appeals where it is alleged there is error in any order, requirements, decisions or determina- tions made by the Building Commissioner or other administrative official of the City in the enforcement of this ordinance, and it shall have the following powers; in addition to powers granted it by State law: (a) To permit, after written notice and public hearing, a temporary building for commerce or industry in a dwelling district which is incidental to the residential development, such permit to be issued for a period of not more than one year. (b) To permit, after written notice and public hearing, transitional uses on lots in dwelling districts border- ing on lots zoned for commercial, business or industrial purposes; provided, however, that a transitional use shall not have a width cf more than 100 feet and shall be limited to the allow- ing of multiple dwellings thereon. To interpret the provisions of this ordinance in such a way as to carry out the intent and purpose of the zoning map and district boundaries des- cribed herein, and to determine in cases of uncer- tainty the classification of any use not specifi- cally listed in this ordinance. (d)To authorize upon appeal in specific cases such variance from the terms of this ordinance as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship, and so that the spirit of the ordinance shall be observed and substan- tial justice done. (e)Any variance, granted under the above powers of _the Board shall terminate as provided in the permit or when abandoned, and the use bf such premises shall thereafter be in conformity with the requirements of this ordinance. SECTION 15. CERTIFICATE OF OCCUPANCY. No vacant land shall be occupied or used, except for agricul- tural purposes, and no building hereafter erected, reconstructed, altered or enlarged, shall be occupied or used until a certificate of occupancy shall have been issued by the Building Commissioner stating that the building or proposed use of a building or premises complies with the building laws and the provisions of this ordi- nance. Certificates of occupancy shall be applied for coincident with the application for building permit, and shall be issued within ten days after the erection or structural alteration of such building shall'have been completed in conformity with the providons hereof. SECTION 16. BUILDING PERMITS. All applications for building permits shall be accompanied by a drawing or plat, in duplicate, showing the lot plan, the location of the building on the lot, accurate dimensions of building and lot and such other information as may be necessary to provide for the enforcement of these regulations. This plat shall be pre- pared after the lot has been staked by a competent surveyor. A careful record of the original copy of such application and plate shall be kept in the office of the City Secretary and the duplicate copy shall be at the building at all times during construction. SECTION 17. BOUNDARI OF DISTRICTS. The boundaries of the various zoning districts shall be as described in this ordinance under the headings "District Limits", the Zoning Map being intended as merely a graphic representation of such described limits. In event of any discrepancy between the district limits herein described and as depicted on the Zoning Map, the verbal description contained in this ordinance shall control. As to property subdivided at the time of passage of this ordinance or property hereafter subdivided whereby a lot of record falls partly within one district and partly within another district as such districts are defined herein, it is the intention of the City Council that such subdivided lot shall be classified for zoning purposes in its entirety in the most restrictive zoning district within which any part of such lot lies; provided, however, that the Board of Adjustment, after written notice and hearing, transfer such lot to a less restrictive district in which more 50% of its area lies. SECTION 18. CHANGES AND AMENDMENTS. The City Council may from time to time amend, supplement or change by ordinance the boundaries of the districts or the regula- tions herein established. Before taking action on any such proposed amendment: supplement or change, the city Council shall submit the same to the planning & Zoning Commission for its recommendation and report. A public hearing shall be held by the City Council before adopting any proposed amendment, supplement or change, notice of which hearing shall be given by publication one time in the official paper of the City of Kennedale, stating the tile and place of such hearing, which time shall not be earlier than fifteen days from the date of publication:, Unless such proposed amendment, supplemnt or change has been approved by the Planning & Zoning Commission, or if a protest against such amendment, supplement or change has been filed with the City Secretary, duly signed and ac- knowledged by the owners of 20% or more, either of the area of the lots included in such proposed changes or those immediately adjacent in the rear thereof extending 200 feet therefrom, or of those directly opposite thereto extending 200'feet from the street frontage of such opposite lots, such amendme t, supplement or change shall not become effective except by a favorable vote of three -fourths of all the members of the City Council. Written notices of all public hearings on proposed changes in classification shall be sent to all owners of property, or to the person rendering the same of city taxes, affected by such proposed changes of classification, and to all owners of property, or to the Person rendering the same for city taxes, located within 200 feet of any property affected thereby, within not less than ten days before such hearing is held. Such notice may be served by using the last known address .s listed on the city tax roll and depositing the notice, postage paid, in the United States Post Office. This shall be the method of notice for all public hearings of the Zoning Commis- sion and Board of Adjustment. SECTION 19. HOUSE TRAILERS PROHIBITED Due to the unhealthy and unsanitary conditions created by the use of house trailers, as well as to their injurious and adverse effect on property values, and in order to promote public health safety, morals and general welfare, the use of house trailers or any type of motor vehicles or motor vehicle trailers for the pur- pose of human habitation, even as a place of temporary abode, is expressly forbidden in Zoning District'!A" or any place in the City except in approved trailer camps or courts constructed in accordance with applicable ordinances. The parking or storage of a house trailer or similar vehicles on any property in Zoning District "A" for a longer period of time than 72 conse- cutive hours is expressly prohibited, unless the same is parked or stored within an enclosed building constructed in accordance with the terms of this ordinance. SECTION 20. VALIDITY. Should any section, clause or provision of this ordinance be declared by a Court tote invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. may ha n SECTION 21. VIOLATION AND PENALTIES. Any person, firm or corporation who violats, disobeys, omits, neglects, or refuseS-. to comply with, or who resists the enforcement of any of the provis_ons of this ordinance, shall be fined not less than $5.00 nor more than $200.00 for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 22. SAVING CLAUSE. All rights or remedies of the City of Kennedale, Texas, are expressly saved as to any and all violations of prior ordinances of the City of Kennedale that have accrued at the time of the effective date of this ordinance, and as to such accrued violations, any Court of competent jurisdiction shall have all the powers that existed prior to the effective date of this ordinance, and all exist- ing violations of previous building ordinances or other ordinances relating to matters covered by this zoning ordinance which would otherwise become non -conforming uses under this ordihance, shall not become legal non -conforming uses hereunder, but shall be con- sidered as violations of this ordinance in the same manner that they were violations of prior ordinances of the City of Kennedale, Texas. SECTION 23. EFFECTIVE DATE. This ordinance shall be effective and be in full force and effect immediately upon its passage and publication as by law pro- vided. The World Can Rest Easy By MIKE SHROPSHIRE NBC's daytime legions are taking on the ultimate chal- nge,forcing a head to head struggle with the unquestioned verlord of the soap operas, "As the World Turns." For years, the opposition has plugged the gap opposite he CBS soap saga with a series of game shows slotted -Jere as sacrificial goats. Now comes NBC with its ew "daytime serial," "Hid - en Faces." Such audacity. "As the Vorld Turns" has long been emarkably adept at tying sows into the heartstrings of merica's womanhood, as he good citizens of Oakdale . the Hughes, Lowells, :assens and Stewarts and all )f their illegitimate offspring plunge merrily along, weaving their own personal lisasters. "The World" can inject anough super - saturated sin end woe into a single half hour episode to last "Peyton Place" a month. Someone once referred to the after- noon soap operas as the pi- ous pornographers. AFTER CATCHING t h e opening episode of "Hidden Faces," it becomes readily apparent that "The World" shouldn't be losing any sleep. Hidden Face s, indeed. They'll really be hiding their faces after that premiere voyage, which was hilarious- ly amatuerish even by soap opera standards. The show, according to a press release, revolves about the adventures of Arthur Ad- ams, a clr'iminal trial lawyer in his mid -thirties who was involved in undercover in- vestigative work during the Korean War. The plot line in the open- ing adventure was obscure. Fortunately, the show in- troduced t h e most sinister villain this side of "Dark Shadows," a fellow with a beard and sunglasses who probably eats little babies for breakfast. He is somehow holding captive an . old man and his daughter, who are apparent- ly of f o r e i g n extraction. Judging from their accents, I'd say they're just off the boat from New Jersey. "My father and I are still your slaves," c r i e s the daughter to t h e ugly man with the beard. "You're bad! Bad!" More- over, the proposed new zoning ordi- nance would make changes in the regulations pertaining to location, size and use of buildings, structures, land and open spaces within all zoning clas- sifications and districts, so that the Proposed new ordinance entail changes of zoning regulations with respect to all property in the City of Kennedale, Texas. There is on exhibit at the Kenne- dale City Hall a large map showing such zoning districts and classifica- tions within the City of Kennedale from which each interested property owner and citizen can locate any property in the city with respect to the proposed zoning classification un- der the suggested new ordinance. Likewise, there are on exhibit in the Kennedale City Hall copies of the full text of the proposed new zoning ordinance. Both said zoning map and such proposed zoning ordinance are available for inspection and study by all interested persons during office hours at the Kennedale City Hall. The Planning and Zoning Commis- sion of the City of Kennedale, Tex- as, feels that such proposed new zon- ing ordinance and re-classification of property will promote the future growth of the city and the general welfare of its inhabitants, as well as contribute to an increase in prop- erty valu:s as the purposes of such new ordinance are achieved.
