AN ORDINANCE AUTHORIZING THE POSTING OF STOP
SIGNS ON 5TH STREET, 4TH STREET, KENNY
STREET, SPILLER STREET, CAYLEBAITE STREET,
AND CHITWOOD STREET; PROVIDING FOR PENALTY,
PUBLICATION AND EFFECTIVE DATE.
Be it ordained by the City Council of Kennedale, Texas
that:
SECTION 1.
Kennedale City Code Chapter 16, Article 4
Sections 16 -41, is hereby amended by adding the following stop
sign locations to the existing ordinance:
(75) On 5th Street at its intersection with North Road,
requiring a stop by vehicular traffic westbound on 5th Street
before entering said intersection.
(76) On 4th Street at its intersection with North Road,
requiring a stop by vehicular traffic westbound on 4th Street
before entering said intersection.
(77) On Kenny Street at its intersection with 3rd
Street, requiring a stop by vehicular traffic northbound on Kenny
Street before entering said intersection.
(78) On Spiller Street at its intersection with 4th
Street, requiring a stop by vehicular traffic northbound on
Spiller Street before entering said intersection.
(79) On Caylebaite Street at its intersection with 4th
Street, requiring a stop by vehicular traffic northbound on
Caylebaite Street before entering said intersection.
(80) On Caylebaite Street at its intersection with 5th
Street, requiring a stop by vehicular traffic northbound on
Caylebaite Street before entering said intersection.
(81) On Chitwood Street at its intersection with 5th
Street, requiring a stop by vehicular traffic northbound on
Chitwood Street before entering said intersection.
(82) On Kenny Street at its intersection with 5th
Street, requiring a stop by vehicular traffic northbound on Kenny
Street before entering said intersection.
(83) On Kenny Street at its intersection with 5th
Street, requiring a stop by vehicular traffic southbound on Kenny
Street before entering said intersection.

(84) On Sulphur Street at its intersection with 5th
Street, requiring a stop by vehicular traffic northbound on
Sulphur Street before entering said intersection.
(85) On Sulphur Street at its intersection with 5th
Street, requiring a stop by vehicular traffic southbound on
Sulphur Street before entering said intersection.
(86) On Chitwood Street at its intersection with 5th
Street, requiring a stop by vehicular traffic southbound on
Chitwood Street before entering said intersection.
(87) On Caylebaite Street at its intersection with 5th
Street, requiring a stop by vehicular traffic southbound on
Caylebaite Street before entering said intersection.
(88) On 5th Street at its intersection with Spiller
Street, requiring a stop by vehicular traffic westbound on 5th
Street before entering said intersection.
(89) On 5th Street at its intersection with Spiller
Street, requiring a stop by vehicular traffic eastbound on 5th
Street before entering said intersection.
SECTION 2. All other sections of Article 4 not in
conflict with this ordinance shall remain in full force and
effect.
SECTION 3.
Any person violating this ordinance shall be
guilty of a misdemeanor, and upon conviction shall be fined in
an amount not to exceed $200.00.
SECTION 4. This ordinance is directed to be.. published
and shall take effect on the 1st day of February, 1989.

ITEM NO. 5 - Approval of Food Health Inspection Ordinance 88 -14
and 88 -15 and Permit Fee.
The Council discussed adopting the ordinances and contracting out to
the county for inspections. The Council wanted to review the final
county contract before making a decision.
Motion was made by Bill Abbott, seconded by Mark Wright, to table this f °'
item until next month. Motion carried.
ITEM NO. 6 - Approval of a Volunteer Fire Fighter Retirement Plan.
Council discussed costs and benefits of the retirement and death /disability
benefit program as explained by data from the State Fireman's Pension
Commission. Several questions remained about buy -back costs for firemen
over 40 years mold and about the additional costs for that provision.
Motion by Jerry _Mitchell,.seconded by John'Mallory to approve participation
in the program without buy -back for those over 40. Motion failed with a
3 to 2 vote.
Motion by Bill Abbott with second by Mark Wright to table this agenda item
until the December meeting to allow staff time to obtain additional
information. Motion carried.
ITEM NO. 7 - Approval of Additional Stop Sign Locations.
Staff recommended approval of an amendment to Chapter 16, Kennedale City
Code, Article 4, Section 16 -41, page 195 -196.1 "Stop and Yield Right -
of -Way Intersections." The following locations are added for stop signs:

the above stated stop sign locations. Motion carried unanimously.
Al Singletary of Lone Star Gas Company briefed the Council on a new
marketing plan for rebates on buying gas appliances.

ITEM NO. 6 - Approval of Participation in State Fire Fighter Retirement
and Benefit Plan.
Ted Rowe recommended this item be tabled so more information may be gathered
on comparative programs. Mr. Rowe indicated that there may be commercial
insurance programs that would be of a greater benefit at a lower cost.
Motion was made by Pete Kirkpatrick, seconded by Mark Wright, to table this
item for further study. Motion carried without opposition.
ITEM NO. 7 - Approval of final Plat of Lots 19R1, 19R2 and 19R3, Block 2, A Al
Shady Creek Addition, Phase I.
Council was informed that the engineering fees had been paid on this plat.
Council discussed prior engineering fees due in the amount of $10,659.05
on plats from the Robbins Companies. Mr. Cooper was furnished a letter
informing him that plat requests, zoning matters, and request for building
permits would be held without action, pending receipt of the required payment.
Motion was made by Bill Abbott, seconded by Pete Kirkpatrick, to approve the
plat of Lots 19R1, 19R2, and 19R3, Block 2, Shady Creek Addition, Phase I
and for the city and The Robbins Companies to come to an agreement on the
prior charges. Motion carried unanimously.
NO. 8 - Approval of Additional Stop Sign Locations.
Chief David Geeslin recommended additional stop sign locations to aid in
providing safe and efficient traffic flow in "Old Town ".
This would amend Chapter 16, Kennedale City Code, Article 4, Section 16 -41
(pp 195 -196) "Stop and Yield Right -of -Way Intersection" to add the following
locations for stop signs:

Motion was made by Pete Kirkpatrick, seconded by Jerry Mitchell, to approve
the amendment Chapter 16, Article 4, Section 16 -41 by adding the above named
street locations. Motion carried, with none opposed.
o` ITEM NO. 9 - Approval of Ordinance 88 -16 to Establish the Kennedale
Emergency Management Organization.
Fire Chief Jim Smith pointed out that this is the only alternative to stay
in compliance with Title 3. Fort Worth will head the operation because they
f have more expertise in that field.
Motion was made by Pete Kirkpatrick, seconded by John Mallory, to approve
Ordinance 88 -16, Emergency Management Organization. Motion carried.
ITEM NO. 10 - Approval of Joint Resolution - Interjurisdictional
Emergency Management Plan.

the joint resolution of Interjurisdictional Emergency Management Plan.

ITEM NO. 11 - Approval of Amendment to Chapter 3, Art. 1, Building
Code, Requirements for Residential Housing Units.
The Planning and Zoning Commission reviewed and approved a proposed ordinance
for all site -built homes, mobile homes, manufactured housing and houses
moved into Kennedale. Subject ordinance requires a roof pitch of 4 x 12
or greater, certain roof eave overhang measurements and compliance with all
adopted building, electrical, plumbing, mechanical and fire codes. It was
the consensus of the council that the roof eave overhang requirements were
not feasible.
Motion was made by Bill Abbott, seconded by Jerry Mitchell, to table this item
for further information. Motion carried without opposition.
