AN ORDINANCE AMENDING ORDINANCE NO. 86 -5; ANNEXING THE
HEREINAFTER DESCRIBED'TERRITORY TO THE CITY OF KENNEDALE
TARRANT COUNTY, TEXAS AND EXTENDING THE BOUNDARY LIMITS
OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED
PROPERTY WITHIN THE CITY LIMITS, AND GRANTING TO SAID
TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY
ALL OF THE RIGHTS AND PRIVILEDGES OF OTHER CITIZENS AND
BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND
ORDINANCES OF THE SAID CITY; AND FURTHER ESTABLISHING THE
ZONING FOR SAID TERRITORY AS F ZONING.
WHEREAS, a petition for annexation has been duly signed and
acknowledged by each and every person or corporation having an
interest in the following described territory, to -wit:
0.750 acre situtated in the DAVID STRICKLAND SURVEY,
Abst. No. 1376, City of Kennedale, Tarrant County,
Texas, being a protion of that certain tract of land
conveyed to Marvin Dunlap Et Ux by :deed recorded
in Vol. 2246, Pg. 564, Deed Records, Tarrant County,
Texas, and being more particularly described by metes
and bounds as follows:
Beginning at a 1/2" iron at the intersection of the
north line of Mansfield highway (U.S. Highway No. 287
a 100 foot R.O.W;) and the east line of Interstate
Highway Loop No. 820 (R.O.W. width varies).
THENCE N 32 0 58' E, along the cast line of said Interstate
Highway Loop No. 820, a distance of 71.00 feet to a T.H.D.
concrete monument.
THENCE N. 45 ° 54' E, continuing along the east line of said
Interstate Highway Loop No. 820, a distance of 72.30 feet to
a T.H.D. concrete monument at the southwest corner of a
tract of land conveyed to The Trademark of Enterprises, Inc.
by deed recorded in Vol. 3891, Pg. 557, Deed Records,

NOW THEREFORE, KNOW ALL MEN BY THESES PRESENTS that Delores
Jo Ann Dunlap Harris and Dallas L. Harris do hereby adopt
the plat shown hereon to be known as:
Lot 1', Block 1, DUNLAP SUBDIVISION
An Addition to the City of Kennedale, Tarrant County, Texas
and do hereby dedicate to the public's use forever the
streets and easements shown hereon.
WHEREAS, said tract of land is contiguous and adjacent to
the City of Kennedale, Texas, and is not more than one -half (1/2)
mile in width, and
WHEREAS, said petition was presented to the City Council on
the 6th day of March, 1986, such date being not less than 5 and
not more than 90 days from the date hereof, and
WHEREAS, after hearing such petition and the arguments for
and against the same the City Council has voted to grant such
petition and to annex said territory to the City of Kennedale,
Texas;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF : THE CITY
OF KENNEDALE, TEXAS, that
Section 1. That the following described property to -wit:
A tract of land out of the David Strickland Survey, Abstract 1376
of Tarrant County, Texas containing .750 acres of land be and the
same is hereby annexed to the City of Kennedale, Tarrant County,
Texas, and that the boundary limits of the City of Kennedale,
Texas, be and the same are hereby extended to include the above
described territory within the city limits of the City of
Kennedale, Texas, and the same shall hereafter be included within
the territorial limits of said city, and said land and the future
inhabitants thereof shall hereafter be entitled to all rights and
privileges of;other citizens of the City of Kennedale, Texas, and
shall be bound by the acts and ordinances of said city.
Section 2. The zoning for the above described tract of
land is hereby established as F zoning.
Section 3. The City Clerk is hereby directed to file with
the County Clerk of Kennedale, Texas a certified copy of this
ordinance.

Section 4. Ordinance No. 86 -5 is hereby amended for the
reason that Ordinance No. 86 -5 contained errors in the legal
description of the property annexed.

Don Driver needs to correct Ordinance 86 -5 - Annexation
of the Dallas Harris property. The metes and bounds descrip-
tion was taken from Deed Vol. 2301 -page 604 dated April 6,
1951, per Mike at TAD. According to Mike�Harold Reynolds,
property was also annexed, south corner.
Attached is the information you requested. I do not know
if it would be appropriate to use the Dunlap Subdivision descrip-
tion or to add a save and except clause. I think Don Driver
should determine what needs to be done.
If further information is needed please let me know.
Immediate action on this matter would rectify the 1987 tax
roll and will be greatly appreciated.

This refers to 14 annexations (Ordinance Nos. 72 -13, 74 -3
74 -8, 81 -13, 82 -10, 83 -8, 84 -11, 85 -18, 85 -19, 85 -28 (as
corrected by 87 -7), 86 -5 (as corrected by 87 -6), 86 -6, 87 -11, and
93 -34) to the City of Kennedale in Tarrant County, Texas,
submitted to the Attorney General pursuant to Section 5 of the
Voting Rights Act of 1965, as amended, 42 U.S.C. 1973c. We
received your submissions on September 27, 1993; supplemental
information was received on November 18 and 23, 1993.
The Attorney General does not interpose any objection to the
specified changes. However, we note that Section 5 expressly
provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the
changes. See the Procedures for the Administration of Section 5
(28 C.F.R. 51.41).
