AN ORDINANCE AMENDING KENNEDALE CITY CODE BY ADDING
CHAPTER 13 -23a, CREATING A NEW ZONING DISTRICT TO BE
KNOWN AS 11 E -1" MORTUARY AND CEMETARY DISTRICT "; A-
MENDING SEC. 13 -27 BY ADDING "(p) MORTUARY- FUNERAL
HOME ", PROVIDING FOR PENALTY, PUBLICATION AND EF-
FECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS,That:
Section 1. Kennedale City Code Chapter 13 is hereby
Amended by adding the following:
Section 13 -23a. "E -1" Mortuary and cemetary district.
a. Use regulations In the E -1 mortuary and
cemetary district, no buildings or land shall be used and no
buildings shall be hereafter erected, reconstructed, altered or
enlarged, unless otherwise provided in this ordinance, except
for one or more of the following uses:
(1) Cemetary
(2) Mortuary
(3) Mausoleum
(4) Undertaker
(5) Funeral Chapel
(6) Funeral Home
b. Special exceptions uses. The following uses may
be established only when authorized by the board of adjustment.
In granting a special exception permit the board of adjustment
may impose conditions which shall be as fully binding as is set
forth in detail in this section:
( 1 ) Florists shop, when used in connection with one of
the principal uses listed in a above.
( 2 ) A gift shop, when used in connection with one of
the principal uses listed in a above.
(3) Caretakers Residence
(4) The above specified stores, shops or businesses
shall be retail establishments exclusively selling merchandise
and conducted wholly within an enclosed building.
C. Prohibited uses. Cremations are hereby
prohibited as a use in this zoning district.
d. Signs. Advertising signs or structures may be
placed or erected on the ground or on the buildings, but shall
not be placed or erected in the required front or side yard,
except that single whole signs may be located in the front
yard or side yard, provided such single pole signs comply with
the following:
( 1 ) Every portion of such sign extending over the
required yard shall have a minimum clearance of 11 feet.
(2) It shall be supported by a single freestanding pole
without guide wires or braces.
(3) Area of signs shall not exceed 40 square feet.
(4) Single pole signs in the front yard shall be
located not less than 50 feet from districts A, B, C or D.
(5) Not more than one such pole sign shall be erected
in the required front yard or one for each side yard required.
(6) The pole supporting such sign shall be limited to
ten inches in diameter or a maximum dimension with allowance for
an appropriate base.
(7) Pylon type structures are prohibited.
e. Accessory buildings. Accessory buildings and
uses customarily incident to any of the uses listed in A above
and purely incidental to the main activity permitted on the
premises. No accesory use shall be construed to permit the
keeping of articles or materials in the open or outside building.
f. Height and area regulations. In the E -1
District, the height of buildings, the minimum dimensions of
yards, and the minimum lot area shall be as follows:
(1) Floor space:
a. No limit on floor space for stores, shops, or
business except as provided herein.
(2) Height: No building hereafter erected, re-
constructed, altered, or enlarged shall exceed two and one -half
(2 1/2) stories nor shall it exceed thirty -five (35) feet, except
that where the frontage on one side of the street between two
intersecting streets is located partly in District "E -1" and
partly in a district permittiang a greater height, the height
limitaion for District "E -1" may be increased to three stories,
but not to exceed forty -five (45) feet.
(3) Front Yard: There shall be a front yard of not
less than thirty (30) feet.
(4) Rear Yard: For dwelling there shall be a rear
yard having a depth of not less than twewnty -five (25) percent of
the depth the lot, provided such yard need not exceed twenty -five
(25) feet; otherwise there shall be a rear yard of not less than
(10) feet except where the "E -1" District abuts on a dwelling
district there shall be a rear yard of not less than fifteen (15)
feet.
(5) Side Yard: For dwellings the side yard for
buildings not exceeding two and one -half (2 1/2) stories in
height, there shall be a side yard on each side of a main
building of not less than eight (8) feet, and the sum of the
side yards shall be twenty (20) percent of the lot width, but
said sum need not exceed thirty (30) feet; for buildings more
than two and one -half (2 1/2) stories in height, each side yard
shall increased one (1) foot in width for each story above the
second floor; provided however, in the case of reversed frontage
where the corner lot abuts on the side of a lot facing the other
intersecting street, there shall be a side yard on the corner
lot of not less than fifty (50) percent of the front yard
required on the lot abutting the rear of the corner lot, and no
accessory building on such corner lot shall project beyond the
front yard line of the lots in the rear, nor shall accessory
buildings be erected closer than ten (10) feet to the line of
the abutting lot to the rear; for building other than dwellings
no side yard shall be required; but, if provided, it shall be
not less than three (3) feet, except where a lot abuts upon the
side of a lot zoned for dwelling purposes there shall be a side
yard of not less than eight (8) feet.
Section 2. Kennedale City Code Sec. 13 -27 is hereby
amended by adding the following:
"(p) Mortuary - funeral home: one space for each four seats
in the funeral chapel."
Section 3 A11 other provisions of Chapter 13 not in
conflict with this ordinance shall remain in full force and
effect.
Section 4 Any person, firm or corporation violating any
of the provisions of this Ordinance shall be guilty of a
misdemeanor and upon conviction thereof, shall be fined in an
amount not to exceed $1,000.00.
Section 5 This ordinance is directed to be published and
shall be in effect from and after publication in accordance with
state law.
PASSED IN OPEN SESSION of the City Council of the City of

NOTICE OF PUBLI HEARING
The City Council of the City of Kennedale will
hold a public hearing at 7:15 p.m. on January 8, 1987,
at the Community Center, 100 E. Broadway Street, Kennedale,
Texas, to consider the designation of a new zoning class-
ification of "E -1" Commercial for cemetery and associated
businesses only and to assign the new "E -1" Commercial
zoning to the land described and identified on an area map
on the attached page. According to the City Tax Records,
you are the owner of real property within the area of the
proposed change or within two hundred feet.
The property is presently zoned "A" Single Family and
"E" Commercial District. The proposed change is for "E -1"
Commercial Zoning District. You are advised that the City
Council is authorized to refuse a zoning change, grant the
proposed zoning or zone some intermediate classification
they deem appropriate.
This is not a summons to appear at the hearing, but
if you care to attend, you will be given full opportunity
to be heard. Additional information is available from the
Office of the City Secretary, City Hall, 478 -5418.
