O85-11ORDINANCE NO. 85_11 AN ORDINANCE REGULATING ACCUMULATIONS OF WEEDS, GRASSS, BRUSH OR DISCARDED WASTE MATERIALS; PROVIDING FOR THE CUTTING AND REMOVAL OF SAME BY THE CITY WITH THE COST INCURRED TO CONSTITUTE LIEN; PROVIDING PENALTY AND EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS, that; Section 1. (a) Accumulations of Weeds, Grass, Brush or Discarded Waste Materials, etc. It shall be unlawful for any person owning, claiming, occupying or having supervision or control of any real property to permit weeds, grass, brush, or any objectionable or unsightly matter to grow to a greater height than twelve (12) inches upon any such real property or to permit the accumulation of any other objectionable, unsanitary or unsightly matter including, but not limited to dead grass, tree limbs and stumps, waste paper, scrap wood or lumber, scrap metal, discarded or abandoned construction material. Provided that all vegetation not regularly cultivated which exceeds twelve (12) inches in height shall be presumed to be objectionable, unsanitary and unsightly, and all wood, metal, concrete, asphalt, equipment and appliances shall be presumed to be discarded and abandoned after remaining as such for ten (10) days after first notice of the non - compliance with the provisions of this Ordinance. It shall be the duty of such person to keep the area from the line of his property to the curb line next adjacent to it free and clear of the matter referenced to above. (b) City May Remove Weeds, Grass, Brush, etc., or Discarded Waste Materials; Notice of Same (1) In the event that any person owning, claiming, occupying, or having supervision or control of any real property fails to comply with the provision of Section 1 (a) and if such owner fails or refuses to do so within ten (10) days after notice in writing or by letter addressed to such owner at his post office address, or by publication as many as one time within ten (10) days within the official newspaper, if personal service may not be had as aforesaid, or the owner's address be not known, the City may do such work or may cause the same to be done and may pay therefore and charge the expenses incurred in doing or having such work done or improvements made, to the owner of such property as herein violating the provisions of Section 1 (a) above. (2) In addition to the remedy in Subsection (1), the City may issue a citation for violation of Section 1(a) and /or institute immediate abatement in case of immediate fire hazards. (c) Expense Incurred in Obtaining Compliance to Constitute Lien on Property The City, in addition to the remedy specified in Section 1(b) above, shall also have the power to cause any of the improvements abovementioned to be done at the expense of the City on account of the owners, and cause such expense thereof to be assessed on the real estate, or lot or lots upon which such expense is incurred. On filing with the County Clerk of Tarrant County, Texas, a statement by the Mayor of the City of such expenses incurred, the City shall have a privileged lien thereon, second only to tax liens and liens for street improvements to secure the expenditure so made and ten percent (10 %) interest on the amount from the date of such payment. For any such expenditures and interest, as aforesaid, suit may be instituted and foreclosure had in the name of the City; and the statement so made as aforesaid, or a certified copy thereof, shall be prima facie proof of the amount expended in any such work or improvements. Section 2. Any person, firm or corporation who violates any provision of this ordinance shall be guilty of a separate offense for each day or portion of the day during which the violation is committed, continued or permitted, and each violation is perishable by a fine not to exceed $200.00. Section 3. This Ordinance is ordered to be published and will be effective from and after the p5 day of Auizust 1985.
