BROADWAY ST. -COMMUNITY CENTER Mayor Wright called the public hearing to order at 7:35 p.m. Members present: Mayor Wright, Councilmember Clark, Hoover, Barrett, Vaughn, and Kovach. Members absent: None Staff present: Ted Rowe, Kathy Turner, Linda Royster, Mort Wetterling, and legal counsel, Wayne K. Olson. PUBLIC HEARING NO. 1- To receive citizens comments to amend the City Code Schedule of Uses to include utilization of a tent to conduct religious services and meetings. Requested by Marvin E. Raines. Mr. David Conroy, Chairman of the Planning & Zoning Commission informed Council that when this request came before the Commission, no one was present to give a presentation. The Planning & Zoning Commission discussed the issue based on the written request and decided against the request to grant utilization of a tent for long term use. No other persons signed in to speak for or against the request for utilization of a tent to conduct religious services and meetings. Mayor Wright closed public hearing number one at 7:40 p.m. and entered into public hearing number two. PUBLIC HEARING NO. 2 - To receive citizen's comments regarding zoning change from "R- 1" Single Family to "R-3" Single Family. The property is identified as Tracts 2 and 2C, Abstract 1075, E.R. Mingus Survey. Requested by Mr. O.V. Di Sciullo, Managing Partner of VLS Partners. Mr. Rusty Di Sciullo, residing at 1419 Country Club Road, Arlington, Texas, and Managing Partner of VLS Partners signed in to address Council. During his presentation Mr. Di Sciullo stated that he had made a bad presentation before the Planning & Zoning Commission which he felt led their decision to deny his zoning request. Mr. Di Sciullo said that he had plans to develop a nice subdivision for the area, which would consist of 143 "R-3" Single Family lots and would have no objections to build "R-2" Single Family lots on the area that was adjacent to Shady Creek. Mr. David Conroy, Chairman of the Planning and Zoning Commission spoke before Council on the findings of the zoning request. Mr. Conroy stated that the property is bound by the north and east by the City of Arlington and carries a zoning classification comparable to the City of Kennedale's "R-3" zoning; to the west by Kennedale, which is zoned planned development district; and to the south by Kennedale, which is zoned "R-3" and "R-2" Single Family districts. After considerable review, the Commission felt that due to lot density, drainage problems, and ingress/egress inquiries, they had no choice but to either table or deny the request. A split 2414 decision was rendered to deny the request. Mr. Conroy went on to say that he did not see a problem with the area carrying a "R-3" zoning classification. Mayor Wright adjourned public hearing number two at 8:00 p.m. and entered into public hearing number three. PUBLIC HEARING N0.3 - To receive citizens comments regarding a zoning change from "R- 1" Single Family to "C-2" General Commercial. The property is identified as Tracts 54A3 and 54A3A, Abstract 1375, Shelby County School Land Survey located at 320 South Dick Price Road. Requested by Mr. Omar Elhamad. Mr. Omar Elhamad, residing at 1343 E. Seminary Drive, Fort Worth, Texas signed in to speak on behalf of his zoning change request for 320 Dick Price Road located in Kennedale city limits. Mr. Elhamad stated that he had purchased the property in 1980, which consisted of an old gas station and house. Since that time, Mr. Elhamad has removed the underground storage tanks and is seeking a general commercial zoning since being annexed as temporary "R-1" single family district. Chairman Conroy, of the Planning and Zoning Commission addressed Council on this request and stated that at last month's meeting no one was present to address the commission with their questions, therefore the commission voted unanimously to deny the request. Mr. Conroy did say the commission reviewed the surrounding areas and felt that either industrial or commercial zoning would fit the area, but without a Master Land Use Plan in place for the area they could not make a recommendation. Mayor Wright recommended to Mr. Elhamad that he readdress the Planning and Zoning Commission with specific ideas as to what he wanted in the building so a recommendation could be brought forth.
